TERMS AND CONDITIONS

1.Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
 

2.Entry is only open to Australian residents aged 14 years or over. The directors, management and employees (and their immediate families) of the Promoter, its related entities, franchisees and agencies associated with this promotion are ineligible to enter.
 

3.Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
 

4.Entrants aged between 14 and 18 years must obtain the consent of at least one parent or legal guardian to enter the promotion and provide personal information about themselves. All entries of entrants who are aged between 14 and 18 years and enter the promotion without disclosing (or attempting to conceal) their age (as and where required) and/or do not provide the required parental consent (as and where required), will be deemed invalid. These Terms and Conditions will bind the entrants and any parent or guardian who gives their consent (for entrants between the ages of 14 and 18 years).  At the discretion of the Promoter, if any prize winner is aged between 14 and 18 years, the prize will be awarded to the parent or legal guardian who consented to the winner entering the promotion on behalf of the winner
 

5.Promotion commences 9am AEST on 08/06/2011 and ends 3pm AEST on 08/07/2011 (“Promotional Period”).
 

6.During the Promotional Period, entrants must enter the promotion by logging on to the “MCDONALD’S® CHICKEN MCWINGS™ FIRST BITE REACTION” PROMOTION” application on the Facebook Platform.  Entrants can locate the “MCDONALD’S® CHICKEN MCWINGS™ FIRST BITE REACTION” PROMOTION” application on the “McWings Promo” tab on the McDonald’s Australia Page on Facebook (www.facebook.com/mcdonaldsau).
 

7.Entrants must “Like” the McDonald’s Australia Page and agree to accept the “MCDONALD’S® CHICKEN MCWINGS™ FIRST BITE REACTION” PROMOTION” application. Entrants must use the “MCDONALD’S® CHICKEN MCWINGS™ FIRST BITE REACTION” PROMOTION” application to upload either a photograph or short video (of no more than 1 minute in length) of themselves featuring their initial reaction to tasting McDonald’s Chicken McWings for the first time. Uploaded files must be submitted in one of the listed formats (Videos - 3gp, 3gp2, 3gpp, 3gpp2, amr-nb, asf, avi, dv, flv, m4a, MOD, mov, movieclip, mp3, mp4, mpeg, mpg, MTS, qcelp, qt, wav, wma, wmv. Photos - jpeg, gif,png), must not exceed 1GB in file size or 1 minute in duration and entrants must complete and submit (in full) the online entry form in the manner required.
 

8.Entry and continued participation in the promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php.
 

9.Without limiting the generality of the above, entries must not contain any material determined by the Promoter in its absolute discretion to be obscene, offensive or inappropriate. The Promoter will review each photograph and video for suitability for entry into the promotion. The Promoter will then either upload the photograph or video to appear in the application. The Promoter reserves the right, at any time, to refuse to accept any entry or remove any entry from display that it deems, in its absolute discretion, to be obscene, offensive or inappropriate, or infringing upon the rights of any third party.
 

10.The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
 

11.Incomplete, indecipherable, inaudible or illegible entries will be deemed invalid.
 

12.Only one (1) entry permitted per person.
 

13.If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. For the avoidance of doubt, in the event that multiple individuals are featured in an entry, the individual who submitted the entry will be deemed the entrant.
 

14.This is a game of skill and chance plays no part in determining the winners.  There will be one (1) round of judging for each week of the Promotional Period (4 in total). Entries for each weekly round of judging close 3pm AEST on 17/06/2011, 24/06/2011, 01/07/2011 and 08/07/2011.
 

15.In each round each entry will be individually judged based on creative merit. The judging of each round will take place from 4pm AEST on 17/06/2011, 24/06/2011, 01/07/2011 and 08/07/2011. All judging will take place at 32 Pyrmont Bridge Road, Pyrmont NSW 2009.
 

16.Non-winning entries in each round (except the final round) will be submitted into further rounds. The judges reserve the right to select additional reserve entries which they determine to be the next best, and record them in order of merit, in case of an invalid entry or ineligible entrant.
 

17.Winners will be notified by phone. The Promoter’s decision is final and no correspondence will be entered into.
 

18.The best valid entry in each round, as determined by the judges, will each win AUD$5,000 awarded in the form of a cheque.
 

19.A prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
 

20.Total prize pool value is AUD$20,000. Prizes, or any unused portion, are not transferable or exchangeable.
 

21.When an entrant submits any materials via the promotion including comments, recordings and images (“Content”), the entrant, unless the Promoter advises otherwise, licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use. Entrants warrant that they have the full authority to grant these rights.
 

22.Entrants agree that they are fully responsible for the Content they submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove any Content without notice for any reason whatsoever. Entrants warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (b) they will obtain prior consent from any person or property that appears in their Content; (c) they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (d) their Content shall not contain viruses or cause injury or harm to any person or entity; and (e) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
 

23.Without limiting any other terms herein, each entrant indemnifies the Promoter, its franchisees and its associated agencies and companies for any breach of the above Clauses 21 and 22.
24.Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
 

25.If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
 

26.Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
 

27.Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
 

28.Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees,  the Promoter (including its respective officers, employees, franchisees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
 

29.The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
 

30.This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook.
 

31.The laws of Australia apply to this promotion to the exclusion of any other law.  Entrants submit to the exclusive jurisdiction of the courts of Australia.
