Terms and Conditions Tooheys Extra Dry Fanpage Promotion “TED’s Biggest Fan”

1. Information on how to enter and prizes form part of these conditions. By participating, entrants agree to be bound by these conditions. Entries must comply with these conditions to be valid.

2. Entry is open to residents of Australia who are 18 years and over. Employees and their immediate families of the Promoter and its agencies associated with this competition are ineligible to enter.

3. The promotion commences at 15.00 AEST on 05/07/11 and closes at 17.01 AEST on 02/09/11 (“Entry Period”).

4. To enter individuals must submit a valid entry through the “TED’s Biggest Fan” entry tab on the Tooheys Extra Dry Facebook page. Entries must include a photo of the entrant and a 25 words or less description of “why they are TED’s biggest fan”. The entrant must include their first name, surname, State/Territory, age, mobile phone number and email address. The Promoter supports the responsible consumption of alcohol and reserves the right to disqualify any irresponsible or offensive entries.

5. You may enter this competition as many times as you like. Entries must be received by the Promoter during the Entry Period. Entries received after 17:01 AEST on 02/09/11 will not be accepted.

6. All entries received prior to 17.01 AEST on each Friday during the Entry Period will be entered into the Weekly Biggest Fan competition. Weekly Biggest Fan winners will be notified by email or mobile phone within 5 days of judging taking place. Each entry is eligible to win a weekly prize only once. All non-winning entries will roll over into the next weekly competition.

7. The weekly winner will be judged every Friday from and including 15/07/11 until and including 02/09/11. There will be a total of 8 weekly winners chosen. The entries will be judged at Holler, Level 2, Suite 2, 2-12 Foveaux St, Surry Hills, NSW 2010, Australia. The weekly competition is a game of skill. Chance plays no part in determining the winners. All entries will be judged individually on their merits based on creativity. The most creative entry, received prior to each Friday during the Entry Period (excluding any previous weekly entries which have already won a weekly prize in this promotion) will receive a prize.

8. The weekly winner will receive a ”Biggest Fan” merchandise pack containing the following: 1 x Tooheys Extra Dry Jacket (RRP $50), 1 x Tooheys Extra Dry Watch (RRP $25), 1 x Tooheys Extra Dry Trucker Cap (RRP $20), 1 x Tooheys Extra Dry Stubby Holder (RRP $15). The value of each prize pack is RRP $110.00.

9. Entrants who enter the Weekly Biggest Fan competition in accordance with paragraph these terms and conditions will automatically be entered in the Major Prize competition.

10. The Major Prize Winner will be judged at Holler, Level 2, Suite 2, 2-12 Foveaux St, Surry Hills, NSW 2010, Australia on 05/09/2011 at 10.00am AEST. This competition is a game of skill. Chance plays no part in determining the winners. All entries will be judged individually on their merits based on creativity. The Major Prize winner will be notified by mail and phone within 5 days of the judging taking place.

11. The Major Prize winner will receive a case of Tooheys Extra Dry 24x345ml delivered to the winner’s nominated address every month for a period of 12 months, valued at RRP between $36.99 and $49.99 (depending on your State or Territory) and a ”Biggest Fan” merchandise pack containing the following: 1 x Tooheys Extra Dry Jacket (RRP $50), 1 x Tooheys Extra Dry Watch (RRP $25), 1 x Tooheys Extra Dry Trucker Cap (RRP $20), 1 x Tooheys Extra Dry Stubby Holder (RRP $15). The value of the major prize is RRP between $36.99 and $49.99(depending on the winner's State or Territory) . The total prize pool is RRP between $36.99 and $49.99 (depending on the major prize winner's State or Territory).

12. Prizes are not transferable and are not redeemable for cash. The cases of Tooheys Extra Dry forming the major prize are not redeemable in advance and cannot be taken other than as 1 case per month, over a 12 month period. The judges’ decision is final and binding - no correspondence will be entered into. The Promoter accepts no responsibility for late, lost or misdirected entries or other communications. The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then the Promoter may modify, cancel, terminate or suspend the promotion.

13. If any prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a prize of equal or greater value.

14. The Promoter reserves the right to request verification of age, identity, residential address and any other information from entrants relevant to entry into or participation in this promotion. Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to disqualify any individual who provides false information, fails to provide information, conspires with others to gain an unfair advantage or who is otherwise involved in any way in manipulating, interfering or tampering with this promotion.

15. The Promoter shall not be liable for any loss, damage or injury suffered by any winner as a result of the winner accepting and/or using a prize, except for any loss, damage or injury which is due to the negligence or wilful misconduct of the Promoter or which otherwise cannot be excluded by law.

16. Each entrant acknowledges that this promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook and, to the extent permitted by law, releases Facebook from any and all liability in relation to this promotion.

17. Before the prize is awarded, the winner and any other person(s) sharing the prize with the winner may be required to sign an agreement to release the Promoter from, and indemnify the Promoter against, any loss, damage or injury arising from the use or participation in the prize, except to the extent any loss, damage or injury is due to the negligence or wilful misconduct of the Promoter.

18. Entrants confirm and promise that their entry is original and does not infringe the intellectual property rights of any third party. Further, entrants agree that ownership of any intellectual property rights in their entry is assigned to the Promoter without the payment of any further fee or compensation. The entrant agrees to sign any further documentation required by the Promoter to give effect to this arrangement as a precondition to being awarded their prize. To the extent permitted by law, entrants unconditionally and irrevocably consent to any act or omission that would otherwise infringe any moral rights in their entry.

19. Entrants will be refused provision of an alcoholic beverage prize if it would breach any relevant laws, codes or policies, including those of the relevant liquor licensee, relating to the responsible service of alcohol. The Promoter supports the responsible service of alcohol.

20. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event that they are a winner in any media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter.

21. Entries remain the property of the Promoter. In participating in this promotion entrants are providing information to the Promoter and not to Facebook. Details from entries will be collected and used for the purpose of conducting this promotion (which may include disclosure to third parties, including local lottery authorities, for the purpose of processing and conducting the promotion) and for promotional purposes surrounding this promotion. By entering this promotion entrants consent to the use of their information as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference or payment to the entrant. Entrants may access, change and/or update their personal information and obtain a copy of the Promoter’s privacy policy by contacting the Promoter on 1800 308 388 during office hours.
