1. Information on how to enter the promotion forms part of these terms and conditions of entry. Acceptance of the prize is deemed acceptance of these terms and conditions.

5. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
6. Eligible Entrants receive one automatic entry into the competition when, during the Promotion Period, they:
(a) visit qantas.com;
(b) book an international Qantas ticket online which has a QF flight number. Each booking counts as one entry, regardless of the number of tickets on the booking; and
(c) pay for the booking, either wholly or in part, with monetary consideration. (Eligible Entry).
8. Multiple entries are permitted.
9. The Promoter is not responsible for any technical malfunction of any communications network or any late, lost, incorrectly submitted, delayed, ineligible, incomplete, corrupted or misdirected entry whether due to error, transmission interruption or otherwise.
10. There will be 19 prizes. Each prize is an international flight refund of up to AU$5000 to be applied to the winning booking accordance with these terms and conditions. The maximum value of each prize applies even if the total value of tickets with a QF flight number on the winning booking exceeds the maximum prize value. The maximum total prize pool value is AU$95,000, based on the recommended retail value at the time of printing. The Promoter accepts no responsibility for any variation in the value of the prizes. There will be 1 prize draw at the conclusion of the promotion for all the flight refunds.
11. The international flight credit refund applies to all tickets with a QF flight number booked on the winning booking up to the maximum value of the prize.
12. Flight refunds may only be applied towards the value of the tickets that have QF flight numbers on the winning booking. The refund cannot be applied towards tickets that do not have a QF flight number.
13. The refunds will only be applied in relation to the portion of the booking that was paid for with monetary consideration. Qantas Frequent Flyer Points will not be refunded.
14. If the total value of the tickets with a QF flight number on each winning international flight booking is under AU$5000 value, the winner will only be refunded the total amount paid for the tickets with a QF flight number.
15. Refunds are not valid on cancelled or changed bookings.
16. Refunds will be paid within 28 days of departure of the first ticket with a QF flight number or, if such departure has already occurred when the winner claims the prize, within 28 days of the winner claiming the prize.
17. The results of the draws are final and no correspondence will be entered into.
18. The 19 draws will be computer generated and will take place at 11.00am (AEST) on 10 August 2011 at the offices of Mike Da Silva and Associates (Aust) Pty Ltd (ABN 50 003 894 022) (MDSA) at 15 Grosvenor Street, Neutral Bay, NSW 2089.
19. One entry will be drawn from all entries received on each day of the Promotion Period. The first entry drawn from each day will win an international flight refund. The maximum value of each prize draw is $5,000
20. The primary traveller on the booking will be deemed the winner.
21. The winners will be notified by email immediately after the draw and their names will be published on qantas.com/flyfree by the 11 August 2011 and in The Australian newspaper on 17 August 2011.
22. The prize is a cash prize and does not include travel insurance, passports, visas, meals, taxes not included in the price of the ticket, ground transportation or any other costs of a personal nature not stated. Compliance with any health or other government requirements is the responsibility of the/each prize-winner and their companions. Prize travel is subject to Qantas' General Conditions of Carriage.
23. Winners will be given the option of being refunded their flight value via direct deposit to their nominated bank account or via crossed cheque. Winners are still eligible to accrue Qantas Frequent Flyer points on the travel refunded.
24. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. Prizes are not exchangeable or redeemable for other goods or services. A prize cannot be transferred to any other person, unless agreed to by the Promoter.
25. The Promoter reserves the right to redraw in the event of a winner being unable to satisfy these Terms and Conditions or forfeiting or not claiming a prize. For any prize that remains unclaimed on 10 November 2011, and subject to any written direction given under applicable law, the Promoter may instruct MDSA to conduct a redraw at the same place and time as the original draw on 24 November 2011. Any winner/s will be notified by email immediately after the draw and their names will be published at qantas.com on 14 November 2011 and in The Australian newspaper on 1 December 2011.
26. The Promoter, its related bodies corporate and their respective officers, employees, contractors and agents (Promotion Parties) will not be liable for any losses, damages, expenses, costs or personal injuries arising out of this promotion, the promotion of this promotion or the use of any prize, including but not limited to any breach of these terms and conditions, contract or tort (including negligence) and any other common law, equitable or statutory remedy (Damages) whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Promotion Parties.
27. The exclusion of liability in clause 26 does not apply to limit or exclude liability:
a) for personal injury or death suffered or sustained in connection with the supply of goods or services which are supplied by the Promoter in the ordinary course of business. To remove doubt: third party goods or services, which other than in connection with this promotion, are in the normal course of business supplied by a third party unrelated to the Promotion Parties, are not supplied by the Promoter in the ordinary course of business; and the Promoter's Conditions of Carriage and general booking conditions (and any exclusions contained therein) apply despite any statement to the contrary in these terms and conditions; or
b) to the extent it is not permissible at law to limit or exclude liability in the manner contemplated in that clause (in which case that liability is limited to the maximum extent allowable by law).
28. If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations and the Promoter reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend this promotion.
29. Entry details remain the property of the Promoter. The name and photograph of winners may be used for promotional purposes by the Promoter, unless a winner otherwise notifies the Promoter at the time of accepting a prize. Entrants consent to the Promoter using personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any prizes. Without limiting the foregoing, entrants' personal information provided in connection with this promotion will be handled in accordance with the Promoter's Privacy Statement, a copy of which is available at available at qantas.com/privacy.
