Possum’s Baby Club
TERMS and CONDITIONS
1. I irrevocably consent to and license Prime Media Group Limited (“Prime”) to publish each of the following by way of broadcast on any or all of the stations within Prime’s television network (including the Golden West Network in Western Australia) and by way of display on Prime’s website www.prime7.com.au (www.gwn7.com.au in W.A.);
(a) my name;
(b) my child’s name, birth date, birth weight and birth location; and
(c) the photograph I submit of my child,
together, “the Materials”.
2. I waive absolutely and irrevocably all moral rights in relation to the Materials. For the purposes of this paragraph, a moral right may be waived by consenting to any act or omission which would otherwise constitute an infringement of that moral right.
3. Prime will only publish the Materials on television in the manner described in clause 9 below.
4. I acknowledge that a commercial endorsement involving third party branding and/or products or services may accompany the publication of the Materials.
5. I may request Prime in writing to withdraw the materials from publication. If Prime receives that request, Prime will use reasonable endeavours to withdraw the Materials from Publication. I acknowledge that, if Prime receives my request less than 6 hours prior to planned television broadcast of the Materials, Prime will not be able to withdraw them from that broadcast.
6. I acknowledge that:
(a) The selection of babies for publication by Prime is entirely at the discretion of Prime and submission by me of the Materials does not guarantee publication of the Materials;
(b) Prime may cease publication of the Materials and/or the Possum’s Baby Club at any time without notice to me; and
(c) Prime may contact me to confirm the details set out in the Materials.
7. I represent and warrant to Prime that:
(a) I am the parent or guardian of the child featured in the Materials;
(b) I have the right to give the consent and grant the licence given under these terms and conditions in relation to the Materials;
(c) the use by Prime of the Materials will not infringe upon the intellectual property or other rights of any person; and
(d) the content of the Materials is true and accurate in all respects and does not contain anything intended to bring Prime or any third party into disrepute.
8. I indemnify and release Prime against all actions, costs, losses, damages, claims, proceedings liabilities suffered or expenses incurred by Prime or its related companies arising from any breach of the warranties given by me in clause 7 above.
9. I acknowledge that the publication of my child on television will be within a panel superimposed over a Prime program as shown in this screen representation
10. These terms and conditions are governed by the laws of New South Wales Australia and the parties irrevocably submit to the jurisdiction of the courts of that state
