Terms & Conditions

    Definitions
        Competition means MMS Search (Mr and Miss Schoolies Search)
        Competition Period means the period of time commencing on the day the entry forms may first be submitted online via the website www.mmssearch.com.au and ceasing on the day when the winners (one male and one female) are announced
        Entrant means an individual that has submitted a valid entry form via the website (www.mmssearch.com.au)
        Promoter means MLM Corp Pty Ltd
    Standard Terms
        Information on "how to enter" and details of prizes form part of the conditions of entry.
        If you enter the Competition you are deemed to have accepted all of the conditions of entry.
    Eligibility (who can enter)
        By entering this competition you verify that you:
            are an Australian citizen or permanent resident for the past 6 months;
            are between 14 and 21 years of age - proof of age and residency may be required before collecting the prize - this proof must be in the form of legally issued documentation and the Promoter reserves the right to require further proof for any reason;
            hold a valid passport or be eligible to hold one;
            will finish year twelve in the year 2011;
            are fit and healthy; and
            are not bound by any contract that may impact on your ability to participate in the competition or accept any prize.
        Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter. The Promoter reserves the right to call your parent or guardian to check that they have granted permission for you to do this.
        We reserve the unfettered right and discretion at all times, in the best interests of the Competition or the reputation of the Promoter to:
            withdraw you from the Competition at any stage on the grounds that you have committed a breach of any undertaking or warranty given on your part in this agreement or have committed an illegal or immoral act or have acted in a manner which is harmful to the image of the Competition or which could, in our view and at our sole discretion.
            cancel, postpone or bring forward any provisional date for the Competition or change the Competition venue or change the manner in which the Competition has traditionally been held due to reasons beyond our reasonable control.
            in the case of any dispute, withhold any award of the title or prize until any dispute is settled, in our absolute discretion.
    Entering the Competition
        You can only enter the Competition once.
        You can enter the Competition by going to the Competition Website www.mmssearch.com.au and clicking on the ENTRANTS tab and following the prompts.
        The Entrant must complete the "Entrant's information and acceptance of Terms and Conditions" and submit this completed form along with at least one full body photo of the Entrant.
        Your entry form and your photographs become the property of the Promoter. By submitting the entry form you agree to the Promoter using the photographs for promotional purposes at its sole discretion.
        Entries will be accepted from 9am EST on 1 July 2011 and entries close at 5pm EST on 1 September 2011. The Promoter, in its sole discretion, may allow entries after this date.
        You acknowledge and agree that:
            you participate in the Competition as a volunteer for no fee and that there is no employer/employee, agency, joint venture or partnership relationship between you and the Promoter;
            all copyright in all recording media used in respect of the Competition in which you appear, including without limitation photographs and other recordings of your likeness, name and voice, belongs to the Promoter absolutely and you assign any copyright you may have to us to give effect to this ownership; and
            the Promoter may use your likeness, name and voice for no fee to promote the Competition at any time in programs, in any media, in advertisements, promotions and publicity and for any other purpose.
        You must have in your possession, on arrival for the Competition, clothes that are adequate and suitable for travelling and for day-to-day wear at the Competition venue for the Competition Period. However, we reserve the right in our absolute discretion to require you to wear clothes provided by us for judging or publicity purposes.
        You must conduct yourself appropriately and not commit any act of an illegal or immoral nature, any act which would bring discredit on you or be harmful to the image of the Competition or any act which would bring the Competition or the Promoter into disrepute throughout the Competition Period.
        You must comply willingly at all times during the Competition Period with our directions, advice and counsel as to your conduct and well-being.
        You must not accept private engagements during the Competition Period without the Promoter's consent.
        You permit the Promoter to take and/or use photographs and other material concerning you for the purposes of the Competition and related publicity.
        You consent to, if requested, appearing on any print, visual and audio media, television, advertising, internet or other coverage of the Competition and related publicity.
        You must not at any time commercially exploit or aid the commercial exploitation of your title in any way whatsoever unless you receive the prior written consent of the Promoter.
    Becoming a finalist
        If you are one of the Entrants selected for the heats, the Promoter will notify you by phone prior to the hat in your nearest capital or regional city. Your name and photo may be published in newspapers, other periodicals or online.
        There will be 7 heats conducted around Australia, held:
            On Saturday 17 September 2011 in Brisbane;
            On Monday 19 September on the Gold Coast;
            On Thursday 22 September in Rockhampton;
            On Saturday 24 September in Melbourne;
            On Sunday 25 September in Sydney;
            On Saturday 1 October in Adelaide; and
            On Sunday 2 October in Perth.
        After each heat, the judges will select Entrants to progress to the final.
        Additional Entrants may progress through to the Final as wild cards. The wild cards may be awarded to the Entrants that receive the highest number of SMS votes or Entrants the judges consider to be deserving of a spot in the final.
        If you are one of the Entrants selected for the final, the Promoter will notify you by phone at least two (2) weeks prior to the final. Your name and photo may also be published in newspapers, other periodicals or online.
        The final will comprise a maximum of 100 Entrants and will take place on Tuesday 22 November 2011 on the Gold Coast.
        Please note that the Competition is based on skill; chance plays no part in selecting the winner. The Entrants that progress to the heat and the final will be judged based on individual style and appearance.
    Judging of the Competition
        You acknowledge the rules for the judging of the Competition as set out below and agree to be bound by them and the decisions made under them:
            The judges will pay equal attention to each applicant's aptitude for making the most of his/her abilities, and his/her attitude towards developing them. Although the judges will give equal importance in their markings to physical and other personal attributes and talent, it must be emphasised that these are not intelligence tests. The judges will be trying to assess each applicant's determination to use whatever ability he/she may have.
            The applicants will be judged in personal interviews, on personal presentation and modelling capabilities.
    Prizes for winners
        The prize pool is as follows:
            A representation contract (on standard terms) with a modelling agency in the Entrants State of residence for 12 months for one male and one female Entrant from each of Queensland, New South Wales, Victoria, South Australia and Western Australia (i.e. 10 in total) (Not able to be valued);
            A Fashion TV Photo Shoot, including appearing on Fashion TV for one Entrant to be decided by the judges in consultation with Fashion TV (Not able to be valued);
            One Crystal Trophy for each winner (one male and one female) (Not able to be valued);
            One photo shoot for the female New South Wales State finalist with ShowPony (Not able to be valued);
            One online voucher for Runway Ready Fashion (value $400);
            One photography portfolio courtesy Michael Greaves Photography (value approximately $800);
            Two Magic Carpet Boards courtesy Fiik (value approximately $800);
            Hair Products for all finalists courtesy TIGI (value approximately $60 per finalist); and
            Other prizes that may be sourced by the Promoter prior to the announcement of the winners at the final on 22 November 2011. Where additional prizes are sourced, these will be published on the Promoters website along with the approximate value of the prize.
        prize values are based upon the recommended retail prices at the time of printing (exclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
        Prizes are not exchangeable, transferable or redeemable for cash.
        Unless the Promoter states otherwise, all costs relating to the entering and competing in the Competition (including travel or accommodation) are the Entrants' responsibility.
        You are advised that tax implications may arise if you win any prizes and you may need to seek independent financial advice prior to acceptance of that prize.
    Important conditions regarding prizes
        If you enter the Competition, you agree that, if you become one of the winners, as decided by the judges, you may be required to sign a representational contract with a modelling agency in your State of residence. That contract will be in place for 12 months and you cannot accept work for any other agency during that time.
        If you win the Competition and refuse to sign the representational contract, if asked to do so, at the Promoters sole discretion you may be disqualified and the judges may select a replacement Entrant to win the Competition. If you are disqualified, you will not be entitled to any prizes and must return the prizes that have been delivered to you.
    Disqualification
        The Promoter reserves the right to verify the validity of entries.
        In addition to the right to disqualify set out in any other clauses, the Promoter may disqualify an Entrant if:
            their entry includes materials that the Promoter considers to be objectionable or defamatory;
            they tamper with the entry process or enters more than once;
            they submit an entry that does not comply with these conditions;
            they (or their parent or guardian) does not sign any form that may be required by the Promoter from time to time, including without limitation the form required under clause 4;
            they (or their parent or guardian) withdraws their consent to that person being in the Competition;
            the Promoter has reason to believe that person has breached any of these conditions;
            they have, in the opinion of the Promoter, engaged in conduct in entering the Competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promoter;
            the person is engaged in any unlawful or other improper misconduct;
            the person is engaged in any misconduct calculated to jeopardise the fair and proper conduct of the Competition; or
            for any other reasonable grounds.
        The Promoter reserves the right to recover damages or other compensation from anyone who is disqualified.
        This clause 9 applies even if you are selected as an Entrant in the heats, a finalist or the Winner. If you are disqualified, you must return all prizes to the Promoter. The Promoter has the right to terminate any agreement it may have entered into with you.
    Liability
        We will not be liable under any circumstances for any loss or damage sustained by you as a result of or arising out of the exercise by us of any right or discretion or in respect of any act or decision made by us under this agreement that we decide (in our sole discretion) to be conducive to the successful running of the Competition and we will not be liable to you for:
            your non-arrival or delayed arrival on the proposed date or changed date of the Competition;
            illness, injury or other incapacity sustained by you up to and during the Competition Period; or
            loss of or damage to any of your possessions during the Competition Period.
        In the case of the intervention of any outside act, agent or event which prevents or significantly hinders our ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions.
        The Promoter, the prize suppliers and sponsors and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.
        The Promoter, the prize suppliers and sponsors and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:
            during the judging;
            whilst undertaking any travel won on or connected with their entry into the Competition; or
            in the participation in any prize;
            as a consequence of late, lost or misdirected mail;
            due to the publication of any material or the broadcast of any material relating to the Competition, including any statements made by any staff member, journalist, other Entrants or any other person.
        The Promoter reserve the right to refuse to allow any prize winner to take part in any or all aspects of the prize, if the Promoter determines, in its absolute discretion, that the prize winner is not in the mental or physical condition necessary to be able to participate in the prize.
        The Promoter reserves the right to reasonably amend or vary these terms and conditions at its sole discretion, orally or in writing.
        The judges' decision in relation to any aspect of the Competition is final and binding on each person who enters.
        Chance plays no part in determining the winner. The Promoter and the judges will NOT enter into correspondence with anyone about the result of the Competition.
    Copyright
        All Entrants agree to grant the Promoter a perpetual and non-exclusive licence to use all photographs taken of them during the Competition and all other material created for the purposes of the Competition in all media worldwide. You agree that the Promoter is able to do this without asking your permission and you are not entitled to receive any money for such use by the Promoter.
    Privacy
        The Promoter is collecting the Entrant's personal information for the purpose of conducting and promoting this Competition (including but not limited to determining and notifying winners). The Entrant may request access to his or her personal information by writing to - Attn: The Secretary, MLM Corp Pty Ltd C/- 1506/90 Surf Parade, Broadbeach, QLD 4218.
    Governing jurisdiction
        This Conditions of Entry document is governed by and is to be construed in accordance with the laws of Queensland and each party submits to the exclusive jurisdiction of its courts.
    Promotional material
        By entering this competition, the Entrant agrees to receive promotional materials, including text messages and emails from the Promoter and its affiliated partners.
    Transportation to heats and the final
        If an applicant is invited to participate in a heat and accepts the invitation, he/she will be known as an Entrant. Unless the Promoter states otherwise, it is each Entrant's own responsibility to arrange for his/her own transportation to the heats and the final. Any costs associated with attending the heats or the final will be born solely by each Entrant.
