Terms and Conditions
1. Instructions on how to enter (as featured on the promotional page within the magazine) form part of these conditions of entry.

2. Competition is open to all residents of Australia except employees of the Promoter, their immediate families and agencies associated with this promotion. If the entrant is under the age of 18 years, the entrant must have prior parental or legal guardian consent to enter. If the winner is under the age of 18 years, the prize will be awarded on behalf of the winner to the winner’s parent or legal guardian. Participation in this promotion is deemed acceptance of these conditions of entry.

3. Promotion commences 12.01am AEST September 28 2011 and closes at 11:59pm AEST on November 22 2011.

4. Only one entry per person permitted.

5. To enter, tell us in 25 words or less “why you’d like to win a Dora the Explorer bedroom set?” Include your name, daytime delivery address and daytime contact phone number. Send your completed entry via email with ‘Dora the Explorer’ in the subject line to m&bwin@acpmagazines.com.au.

6. This is a game of skill and chance plays no part in determining the winner. Each entry will be individually judged based on literary and creative merit and originality. The judges’ decision in relation to all aspects of the competition is final and binding on each person who enters, and no correspondence will be entered into.

7. Each entrant warrants to the Promoter that each entry submitted is an original artistic work of the entrant which does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition. All entries will be entered into a database and the Promoter may use the entrants’ names and addresses for future promotional and marketing purposes.

8. The Promoter is entitled to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including using the entries for future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. The promoter is entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry.

9. Entries must not be offensive, defamatory or racist. Any entry which the judges deem inappropriate will be invalid. The entrant agrees to indemnify the Promoter.

10. The promotion will be judged by a panel appointed by the Promoter and judging will begin at the Promoter’s premises on November 23 2011. The prize winners will be notified by mail using contact details provided in their entry.

11. The best five (5) entries as determined by the judges will be deemed the major prize winners and will each receive:

One (1) x Dora the Explorer bedroom set valued at $174.85. Prize includes:
One (1) x Dora Bedroom in a Box (duvet cover set, fleece throw, cushion and canvas valued at $79.95)
One (1) x Dora comforter valued at $69.95
One (1) x polar fleece throw valued at $24.95

12. Total prize pool is valued at $874.25. Prizes do not include any ancillary costs associated with redeeming the prize. These are the responsibility of the winner.

13. If the winner is under the age of 18 years, the prize will be awarded to the winner’s parent or legal guardian on behalf of the winner. It is the responsibility of the winner’s parent/legal guardian to prove their parental status/ legal guardianship at the time of winner notification. In the event that for any reason whatsoever a person/s mistakenly represents themselves to be a winners parent and/or legal guardian, then that person will be liable for all costs associated with relocating and/or re-awarding the prize (including but not limited to and administrative fees incurred by the Promoter). Where relevant, the Promoter is only responsible for ensuring that the prize is awarded to a person who is either a parent or legal guardian of the winner. The Promoter is not responsible for determining any other delivery details or taking direction that relates to any ongoing family law negotiations and/or determinations. These are the responsibility of the winner and their respective parent/s and/or legal guardian/s.

14. Products included in prize package (including but not limited to titles, colour, design, sizing, style, brand, etc) will be determined by the Promoter in its complete discretion.

15. Prize values mentioned are in Australian dollars and are the recommended retail value as provided by the supplier and are correct at the time of printing. The Promoter is neither responsible nor liable for any change in the value of a prize occurring between the publishing date and the date the prize is claimed.

16. In the event that the prize, or part of the prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification subject to any written directions from the various Lottery Departments.

17. The promoter is neither responsible nor liable for any late lost or misdirected mail (including but not limited to prizes).

18. The promoter is not responsible nor liable for any prize damaged in transit in the delivery of their prize.

19. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

20. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition.

21. Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) is not responsible for and excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions ; (e) any tax liability incurred by a winner or entrant; and (f) use of a prize.

22. If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the competition, as appropriate.

23. All entries submitted become the property of the Promoter. Entries will not be returned to any entrant. As a condition of entering into this competition, each entrant licences the Promoter to use their entry in any media for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes. Each entrant warrants to the Promoter that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).

24. All entries become the property of the Promoter. The collection, use and disclosure of personal information provided in connection with this competition is governed by The Privacy Notice (see contents page for location in this issue). By entering the competition, unless otherwise advised by the entrant, each entrant consents to the information they submit with their entry being entered into a database and the Promoter may use this information in any media for future promotional, marketing and publicity purposes without any further reference or payment to the entrant. A request to access, update or correct any information should be directed to the Promoter.
