CONDITIONS OF ENTRY1. Information on how to enter and prizes form part of these Conditions of Entry. Participation in this promotion is subject to these Conditions of Entry.
2. Entry is only open to Australian residents aged 14 years or over. The directors, management and employees (and their immediate families) of the Promoter or its related entities, franchisees and associates are not eligible to enter.
3. Entrants aged between 14 and 17 years must obtain the consent of at least one parent or legal guardian to enter the promotion and provide personal information about themselves. All entries of entrants who are under 18 and enter the promotion without disclosing (or attempting to conceal) their actual age, where required or who do not provide the required parental consent, will be deemed invalid. These Conditions of Entry will bind the entrants and any parent or guardian who gives their consent ). At the discretion of the Promoter, if any prize winner is aged between 14 and 17 years, the prize may be awarded to the parent or legal guardian who consented to the winner entering the promotion on behalf of the winner.
4. Promotion commences 9am AEST on 1 October 2011 and ends 3pm AEST on 30 November 2011 ("Promotional Period").

Entrants can locate the "B&D GARAGE DOORS WHAT'S BEHIND YOUR B&D GARAGE DOOR" PROMOTION application on the "Facebook Promo" tab on the B&D Garage Doors & Openers page on Facebook (

6. Entrants must "Like" the B&D Garage Doors & Openers Australia page on Facebook (
www.facebook.com/BnDGarageDoors) and agree to accept the "B&D GARAGE DOORS WHAT'S BEHIND YOUR B&D GARAGE DOOR" PROMOTION application.
7. Entrants must use the "B&D GARAGE DOORS WHAT'S BEHIND YOUR B&D GARAGE DOOR" PROMOTION application to upload either a photograph or short video (of no more than 1 minute in length) of themselves featuring examples of what can be found behind a B&D Garage Door. Upload your videos to YouTube and send us your link, videos must not exceed 1 minute in duration.
8. Entrants must complete and submit (in full) the online entry form in the manner required.
9. Entries must not contain any material determined by the Promoter in its absolute discretion to be obscene, offensive or inappropriate or which otherwise falls within any of the categories in Clause 20. The Promoter will review each photograph and video for suitability for entry into the promotion. The Promoter will then determine, in its absolute discretion, whether to upload the photograph or video to appear in the application. The Promoter reserves the right, at any time, to refuse to accept any entry or remove any entry from display that it deems, in its absolute discretion, to be obscene, offensive or inappropriate, or potentially infringing upon the rights of any third party.
10. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who is ineligible or who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry or selection process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
11. Incomplete, indecipherable, inaudible or illegible entries may be deemed invalid.
12. Only one entry is allowed per person.
13. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. For the avoidance of doubt, in the event that multiple individuals are featured in an entry, the individual who submitted the entry will be deemed the entrant.
JUDGING AND PRIZES14. The entries will be individually judged based on creative merit. The judging will take place from 4pm AEST on 30 November 2011.
15. The best valid entry as determined by the judges in their sole discretion, will win AUD$5,000. The runner-up will be awarded AUD$2000. Prizes will be awarded in the form of a cheque.
16. The total prize pool value is AUD$7,000. Prizes are not transferable or exchangeable.
17. Winners will be notified by phone on the number provided in the entrant's application form. The Promoter's decision is final and no correspondence will be entered into.
18. A prize will only be awarded following any winner validation or verification that the Promoter requires in its sole discretion.
OWNERSHIP OF MATERIAL; PRIVACY19. All entries become the property of the Promoter including all materials submitted as part of the entry such as videos, photographs, comments, recordings and images ('Content'). The entrant hereby assigns to the Promoter all rights in relation to the entry and Content and must not use the entry or Content for any other purpose or allow anyone else to do so. Entrants consent to the Promoter or any assignee or licensee doing anything with the entry or the Content which would otherwise infringe the entrant's moral rights. Entrants warrant that they have the full authority to grant these rights. Entries and Content will not be returned to Entrants.
20. Entrants agree that they are fully responsible for the Content they submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may edit or remove any Content without notice for any reason whatsoever. Entrants warrant and agree that: (a) they will not submit any Content that is unlawful, or that could breach any intellectual property, privacy or other rights, or is defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, discriminatory, objectionable, not suitable for children , or otherwise unsuitable for publication; (b) they will obtain prior consent from any person or property that appears in their Content; (c) they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (d) their Content shall not contain viruses or cause injury or harm to any person or entity; and (e) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
21. Each entrant indemnifies the Promoter for any breach of Clauses 20 and 21.
22. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter or any related or associated entity or distributor.
23. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including contractors and service providers. By entering into this promotion, you consent to the Promoter using the personal information you provide for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant, unless you advise us otherwise. OTHER IMPORTANT INFORMATION24. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right (a) to disqualify any entrant; or (b) to modify, suspend or cancel the promotion, as appropriate.
25. Entrants are solely responsible for any costs they incur in connection with the promotion.
26. Nothing in these Conditions of Entry excludes or restricts liability that cannot by law be excluded, including any guarantees provided under the Competition and Consumer Act ("Non-Excludable Guarantees"), if applicable.
27. Except for any liability that cannot by law be excluded, the Promoter is not responsible for and excludes disclaims all liability arising in any way out of the promotion, including any loss of damage arising in any way out of: (a) any technical difficulties or equipment malfunction, (b) any theft, unauthorised access or third party interference, (c) any entry or prize claim that is late, lost, altered, damaged or misdirected, (d) any tax liability incurred by a winner or entrant (entrants should contact their own tax advisor in this regard) or (fe) use of a prize.
