TERMS AND CONDITIONS OF ENTRY


1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to Australian residents only. Employees (and their immediate families) of the Promoter, companies and agencies associated with this promotion are ineligible to enter.

3. Only one entry permitted per person.

4. Promotion commences on 31 October 2011 and Entries close at 23:59 AEDST on 7 November 2011.The judging will take place at the Promoter’s premises and being on 8 November 2011. The judging will be done by a panel of judges appointed by the promoter. The Winner will be notified by email and telephone using contact details provided in their entry.

5. To enter, entrants must log on to WWW.ZOOWEEKLY.COM.AU and follow the prompts to the competition entry page, input the requested details including name, address, postcode, email address, Date of birth, contact number, and answer the question in 25 words or less “What would you rather do, jump in the MMA cage with Australian MMA champ Richie Vas or Surf 60 ft waves at Waimea Bay with Mark Mathews and how would you go about it??” then submit the fully completed entry form as instructed.

6. Each entry will be individually judged based on its literary, creative merit and suitability of the promotion. The judges’ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.

7. The Entrant warrants to the Promoter that the entry submitted is an original artistic work of the Entrant that does not infringe the rights of any third parties. If the entry or any part of the information provided to the Entrant in relation to the entry was provided by a third party, the Entrant warrants that they have obtained the relevant copyright permission to submit the entry for the purposes of this promotion. The entrant agrees to indemnify the promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition.

8. The Promoter is entitled to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including using the entries for future promoters publications, future broadcasts, promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. The promoter is entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry.

9. Entries must not be offensive, defamatory or racist. Any entry which the judges deem inappropriate will be invalid. The entrant agrees to indemnify the Promoter.

10. This promotion is being conducted for entertainment purposes only.

11. Incomplete, indecipherable entries will be deemed invalid and discarded.

12. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

13. The best (1) entry as determined by the judges will be deemed the major prize winner and will receive

One (1) x FireWire surfboard signed by professional big wave surfer Mark Mathews
One (1) x O’Neill Psycho 2 wetsuit
Five (5) double passes to see the FIGHTING FEAR film
14. Total prize value is $1500.00. Prize does not include any ancillary costs associated with redeeming this prize. These are the responsibility of the winner.

15. Items included in the prize pack (including but not limited to title, colours, brands, designs, textures, size etc) is determined by the Promoter in its complete discretion.

16. At time of winner notification, the Promoter will ask the winner to nominate their sizing preference for the O’Neill Psycho 2 wetsuit. The Promoter will make all reasonable attempts to supply the O’Neill Psycho 2 wetsuit in the size stipulated by the winner at the time of winner notification, however in the event that for any reason whatsoever the sizing stipulated is unavailable at the time of the redemption of the prize, the Promoter will supply the O’Neill Psycho 2 wetsuit in the next sizing available closest to that stipulated by the winner at the time of winner notification.

17. Double movie passes are valid: Mondays to Fridays from November 10th, 2011 until the end of the film’s theatrical season. Prize admits two (2) people per pass. Prize
Is valid with “No Free Tickets” listings. Prize cannot be used on Public holidays or discount ticket days.
Double passes can be redeemed at the following movie theatres only. NSW: Randwick Ritz, GU Bondi Junction, GU Cronulla, GU Shellharbour, GU Newcastle, GU Coffs Harbour, Hoyts Broadway, Hoyts Chatswood/Mandarin, Hoyts Eastgardens, Hoyts Penrith, Hoyts Erina, Hoyts Tweed Heads, Dendy Byron Bay, Avoca Beach Picture Theatre, Majestic Port Macquarie, Majestic Nambucca Heads, Majestic Singleton, Majestic The Entrance, Odeon Orange, Forum 6 Tamworth, Forum 6 Wagga, Roxy Nowra, Narooma City, Bay City and Arcadia Twin Cinemas.
ACT: Hoyts Belconnen Cinemas.
VIC: Village Jam Factory, Village Geelong, Hoyts Chadstone, Hoyts Frankston, Hoyts Victoria Garden, Reading Waurn Ponds and Sorrento Athenaeum Cinemas.

This ticket must be taken as offered and is not exchangeable, for sale, transferable or redeemable for cash. Subject to seat availability. This ticket does not guarantee admission. Check local newspapers for session times. Discount days vary between cinemas, please check beforehand to avoid disappointment. Not valid at Silverscreen Village Cinema locations. Not valid at Dendy Premium Cinemas.

18. Prize does not include any costs associated with travel to and from the Movie theatre. These costs are the responsibility of the winner.

19. Where component of the prize is awarded in the form of a voucher/ letter/ ticket/ pass, any costs in excess of the value of the voucher/ letter/ ticket/ pass (including GST) and all ancillary costs associated with redeeming the prize are the responsibility of the winner. In the event that the cost of items/ services purchased using the voucher/ letter/ ticket/ pass is less than the value of the voucher, the balance of the value of the letter/ ticket/ pass /voucher will not be awarded as cash. The Promoters shall not be liable for any voucher/ letter/ ticket/ pass that has been lost, stolen, forged, damaged or tampered with in any way. Redemption of the voucher/ letter/ ticket/ pass is subject to any terms and conditions specified on the voucher/ letter/ ticket/ pass. Redemption of prize is subject to the normal business guidelines of the service provider/ venue of redemption. Prize and any unused portion of the voucher/ ticket/ letter/ pass prize is not transferable or exchangeable and cannot be taken as cash. Major prize must be redeemed in full by date stipulated by the Promoters at time of winner notification.

20. Prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash. Prize values are given by the supplier and are correct at time of printing. The Promoters accept no responsibility for any variation in the value of the prizes occurring between the publishing date and date the prizes are claimed.

21. If for any reason a winner does not take the prize or an element of the prize by the time stipulated by the Promoters, then the prize or that element of the prize will be forfeited.

22. If the prize (or part of the prize) is unavailable, the Promoters, in their discretion, reserve the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

23. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

24. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

25. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.

26. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

27. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
