Take 5 Judy Nunn Competition Terms and Conditions
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

Entry is open to all Australian residents aged 18 years and over. Employees of the Promoter and their immediate families and agencies associated with this promotion are ineligible to enter.
3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
4. Promotion commences 2/11/11. Entries close last mail received on 14/11/11. The promotion is a game of skill and chance plays no part in determining the winners. In all matters, the Promoter’s and/or judges’ decision is final and no correspondence will be entered into. Each entry will be individually judged based on a combination of literary and creative merit and originality.
5. To enter, entrants must send their name, address and phone number and answer in 25 words or less “why you’d love a copy of the book.” Completed entries are to be sent to Take 5 Judy Nunn Competition, PO Box 441, Eastern Suburbs MC, NSW 2004 by last mail 14/11/11.

Multiple entries permitted, subject to the following: Each entry must (a) be substantially unique; and (b) be submitted separately and in accordance with entry requirements. All entries become the property of the Promoter and will not be returned. Incomplete, illegible and invalid entries will not be included in the judging.

The best 25 entries, as determined by the judges, will each receive a signed copy of the Judy Nunn book Tiger Men, valued at $32.95. Winners will be notified by mail. It is a condition of accepting the prize that the winner agrees to their entry maybe featured in a future issue of Take 5 magazine. Inclusion of any such feature (including but not limited to creative control and date of inclusion) will remain at the complete discretion of the Promoter.

Total prize pool is $823.75. Prizes are not transferable or exchangeable and cannot be taken as cash. Prize does not include any ancillary costs associated with redeeming the prize. These are the responsibility of the winner.
9. In the event that a prize(s) is not available, the Promoter reserves the right to substitute prize(s) in their sole discretion to the same and equal recommended retail value and/or specification (including but not limited to providing the winner with a reading from an alternative spirit guide reader in the event that Jenny Smedley is unable to meet her obligation for any reason whatsoever).
10. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
11. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to (a) disqualify any entrant; and/or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
12. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
13. The prize of the psychic reading is for guidance and entertainment only. Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; and/or (f) use of any prize.
14. All entries submitted (including photographs) become the property of the Promoter. Entries will not be returned to any entrant. As a condition of entering into this promotion, each entrant licences the Promoter to use their entry in any media for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes. Each entrant warrants to the Promoter that (a) each photograph submitted is an original artistic work of the entrant which does not infringe the rights of any third party, (b) that the photograph submitted is of the entrant; and (c) if other parties are pictured in a submitted photograph, that the entrant has obtained all necessary permission to submit the photograph for the purposes of the promotion. The entrant agrees to indemnify the Promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
15. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers. Entry is conditional on providing this information. Unless otherwise advised, the Promoter may also use the information for promotional, marketing and publicity purposes including sending electronic messages. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter. The collection, use and disclosure of personal information provided in connection with this competition is governed by the Privacy Notice (see Contents page in Take 5 magazine for location).
