Carlton Dry WA Motocross Promotion November - Terms and Conditions
Eligible participants in the promotion agree to abide by the terms and conditions set out in this
document (‘Terms and Conditions’).
The promoter is Foster’s Australia Limited (ABN 76 004 056 106), 77 Southbank Boulevard,
Southbank, VIC 3006.
1. Information regarding prizes and how to enter forms part of these conditions. By entering,
entrants accept these conditions.
2. Entry is open only to Australian residents aged 18 or over except directors, officers,
management and employees (and the immediate families of directors, officers, management
and employees) of the Promoter, and the directors, officers, management and employees of
the participating outlets or of the agencies or companies associated with this competition.
3. The competition begins at 9.00am (AWST) on 01/11/11 and closes at 11.59pm (AWST) on
30/11/11 (Competition Period).
4. During the Competition Period, this promotion will only be conducted at Burswood
Entertainment Complex in Western Australia.
5. To enter, consumers must, during the Competition Period: (a) purchase a bottle or glass of
Carlton Dry or Carlton Dry Fusion beer (Eligible Purchase) from the participating venue for on
premise consumption to receive an entry form; (b) fully complete the entry form; (c) and place
the completed entry form into the entry box found in that Outlet.
6. Entries must be received in the entry box at the relevant Outlet before the end of the
Competition Period. Entrants are limited to one entry per person per day, provided that each
entry is based on a separate Eligible Purchase and a separate original entry form. The
Promoter accepts no responsibility for any late, lost, incomplete, misdirected, incorrectly
submitted, delayed or illegible entries, claims or correspondence whether due to error,
omission, alteration, tampering, theft, destruction or otherwise, including failure of the entry
forms to be received at the draw location.
7. A draw will be conducted at 12noon (AWST) on 01/12/11 at the Burswood Entertainment
Complex, Great Eastern Highway, Burswood WA 6100. The first valid entry randomly drawn
from all entries received during the Competition Period will win the prize.
8. The prize to be won is a 2011 Honda CRF-450R Honda Racing Replica Motocross bike
valued at $12,539 (inc GST) and riding gear (as selected by the Promoter) valued at $1,497
(inc GST). The bike is for use on private property only. The bike cannot be registered and
cannot be ridden on public property and roads. The winner is responsible for ensuring that
they hold any necessary licences, and are aware of and compliant with any applicable laws
and regulations, regarding the use of the bike. The prize does not include comprehensive
insurance or any other accessories not specified. The winner must arrange to attend the
premises of the dealer nominated by the Promoter to collect the bike.
9. The total prize pool is valued at $14,036 (inc GST).
10. The winner will be notified by phone within 2 days after the draw.
11. The winner must, at the Promoter’s request, participate in all promotional activity (such as
publicity and photography) surrounding the winning of the prize, free of charge, and they
consent to the Promoter using their name and image in promotional material.
12. The Promoter and its associated agencies and companies, including Burswood
Entertainment Complex will not be liable for any loss (including, without limitation, indirect,
special or consequential loss or loss of profits), expense, damage, personal injury or death
which is suffered or sustained (whether or not arising from any person’s negligence) in
connection with this competition or accepting or using any prize, except for any liability which
cannot be excluded by law (in which case that liability is limited to the minimum allowable by
law).
13. The Promoter and its associated agencies and companies will not be liable for any
damage or delay in transit to prizes.
14. If a winning entry is deemed not to comply with these conditions of entry, the entry will be
discarded and a new winner of the prize will be determined by drawing a further valid entry in
accordance with paragraph 7. The judges’ decision is final and no correspondence will be
entered into.
15. If the prize is not accepted or claimed within 3 months of the draw date the winner’s entry
will be deemed invalid and the Promoter will conduct a further draw on 01/03/12 at the same
time and location as the original draw, as is necessary to distribute the prize, subject to any
requirements of the WA gaming authority. Any winner in this draw will be notified by phone.
16. The Promoter may require winners to provide proof of identity, proof of age and proof of
residency. Identification considered suitable for verification is at the Promoter’s discretion.
17. The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further
participation in this competition by, any person who tampers with or benefits from any
tampering with the entry process or with the operation of the competition or acts in violation of
these conditions, acts in a disruptive manner or acts with the intent or effect of annoying,
abusing, threatening or harassing any other person.
18. The prize is not transferable or exchangeable and cannot be redeemed for cash. The
Promoter accepts no responsibility for any variation in prize value. If the prize, or an element
of the prize, is unavailable for any reason the Promoter may substitute for that prize or that
element another item of equal or higher value as determined by the Promoter, subject to the
approval of the WA gaming authority, if required.
19. If for any reason any aspect of this competition is not capable of running as planned,
including by reason of computer virus, communications network failure, bugs, tampering,
unauthorised intervention, fraud, technical failure or any cause beyond the control of the
Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the
competition, or invalidate any affected entries, subject to the approval of the WA gaming
authority, if required.
20. The Promoter is not liable for any tax implications arising from prize winnings.
Independent financial advice should be sought. Where this competition involves, for GST
purposes, supplies being made for non-monetary consideration, entrants will follow the
Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and
services exchanged are of equal GST inclusive market values.
21. The Promoter encourages consumers to enjoy alcohol responsibly. Legal aged
consumers are advised to consider the safe drinking levels recommended in the National
Health and Medical Research Council Australian Guidelines to Reduce Health Risks from
Drinking Alcohol. A full version of these Guidelines is available at

continued participation in this competition is subject to each Outlet’s liquor serving policy.
22. All entries will be the property of the Promoter. The information entrants provide will be
used by the Promoter for the purpose of conducting this competition. The Promoter may
disclose entrants’ personal information to its contractors and agents to assist in conducting
this competition or communicating with entrants. By entering this competition, entrants
consent to the storage of their personal information on the Promoter’s database and the
Promoter may use this information for future competition and marketing purposes regarding
its products, including contacting the entrant via electronic messaging. By entering this
competition, entrants consent to receiving SMS or email messages from the Promoter that do
not contain any functional unsubscribe facility. The Promoter is bound by the National Privacy
Principles in the Privacy Act 1988. Entrants can request access to the personal information
the Promoter holds about them by contacting the Promoter at the address below.
