How to enter

Complete the entry form , providing contact details. Description: Tell us in 150 words or less, what makes your garden special (attach a separate sheet of paper if required). Include information on the challenges and triumphs, its size, age and location. Photographs: Please send us a minimum of six (6) photos of your garden, showing your whole garden and details. These must have been taken in the past 12 months and can be in the form of prints posted in with your entry, or digital images sent in via email or on disc.

1 Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2 Entry is open to Australian residents aged 18 years or over who are available to travel between 22 May 2012 and 26 May 2012. Employees of the Promoter and their immediate families and agencies associated with this promotion are ineligible to enter. For the removal of doubt, the entrant will be deemed to be the person who submits the entry of the Garden. Any dispute to the ownership of the Garden is the responsibility of the entrant. It is the responsibility of the entrant to enter a Garden that they have permission to do so. In the event that for any reason whatsoever a person/s incorrectly represents themselves to be a the owner of a garden that they are not entitled to enter in this competition, then that person will be liable for all costs associated with determining an outcome that allows the Promoter to deem one person an entrant and/or where relevant re-awarding the prize (including but not limited to and administrative fees incurred by the Promoter). Where relevant, the Promoter is only responsible for ensuring that the prize is awarded to the entrant. The Promoter is not responsible for determining any other details or taking direction that relates to (including but not limited to any ongoing legal negotiations, splitting of the prize and/or other determinations. These are the responsibility of the entrant.
3 Only one entry per person is permitted.
4 The promotion commences 10:00am AEST 5 September 2011 and closes at 23:59pm AEDST 5 December 2011.
5 There are two ways of entering the competition:
online log onto www.houseandgarden.com.au and follow the prompts to the entry page and submit your completed entry form. OR Mail: Complete the entry form in House & Garden Magazine and send to: H&G Garden of the Year Competition, GPO Box 4088, Sydney NSW 1028 A completed entry will include your name, address, postcode, daytime telephone number, after hours telephone number, email address, category you are entering your garden in and answer in (150 words or less) ‘What makes your Garden Special?” including challenges and triumphs, size, age and location, A plant list of 6-10 key plants in the garden, ticking boxes for all Plant design and Maintenance questions and a minimum of six (6) photographs of the garden.
Printed photographs MUST be a maximum of “6x4in” and taken in a high-resolution format. Digital images may be sent in via email to gardencomp@acpmagazines.com.au (please include your name and address to validate your entry form) or on disc. Digital images must be 2MB at high resolution and supplied in JPEG format only. Photographs must have been taken in the past 12 months. Entrants should not send in original copies of their entries. No responsibility will be taken by the promoter in the event that the original entry is lost or damaged in editing. AND the entry must not be, without limitation: a) late; b) delayed; c) incomplete;
d) incomprehensible; e) unlawful; f) obscene;
g) defamatory; h) discriminatory; i) libellous;
j) threatening; k) pornographic; l) harassing;
m) hateful; n) racially or ethnically offensive;
o) capable of encouraging conduct that would be considered a criminal offence; p) capable of violating any law; q) capable of giving rise to civil liability.
6 Incomplete, incomprehensible and illegible entries will be deemed invalid and will not be included in the judging.
7 This is a game of skill; chance plays no part in determining the winner. Each entry will be individually judged based on the following judging criteria for each category.
8 The seven (7) categories and judging criteria are as follows:
Edible Garden Judges will be looking for a variety of productive plants, the health of the plants, the level of maintenance and visual appeal.
Sustainable Garden Judges will consider water management and how well plants have been selected for a water-wise scenario. Is the garden a habitat for native fauna? Does it include an eco-system of productive plants and animals? Is there a commitment to organic practices? Are renewable/recycled/reclaimed materials used? Entertainer’s Garden Judges will assess the quality of the garden in terms of how it can be used as an entertainment area, including design, composition and aesthetic appeal, the use of hard landscaping (materials used as well as the quality of workmanship), plant selection and maintenance. Pretty Garden Judges will be looking for pretty flowering gardens in this category. Judges will consider layout and design, plant selection, maintenance, individual expression and visual appeal.
Small Garden Gardens up to 400 square metres. This category is specifically for smaller plots, including courtyards and patios. Judges will look at the best use of space, the balance and originality of the design, use of hard landscaping, plant selection maintenance and overall visual appeal. Medium Garden Gardens between 401 and 1000 square metres (or the old quarter-acre block) Large Garden Gardens larger than 1000 square metres.
In both medium and large garden categories, judges will assess the overall design, the selection and arrangement of the plants, trees and shrubs, the flow (including traffic flow), maintenance and visual appeal.
Including the above category judging criteria the judges will also be assessing on the level of imagination in the layout, the presentation of the garden, how it relates to the entrants needs and the location of the garden. The key areas of judging will include: design, balance, originality, selection of plants, trees and shrubs (including variety, spacing and balance, appropriate use of plant species, use of colour and texture) design of traffic flow hard landscaping, use of driveway paving and walkways, use of stones, rocks, statuary, containers, walls, fencing and water features, cleanliness of the garden and area, free from disease and weeds, good garden practices and suitable groundcover.
9 Judges’ decision in relation to all aspects of this promotion is final and binding on all who enter and no correspondence will be entered into.
10 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including but not limited an entrant’s identity, age, place of residence and proof of purchase) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
11 The first round of judging will be judged by a panel of judges appointed by the Promoter. Judging will begin on 10 December 2011 at the promoter’s premises. The judges will determine one (1) finalist from each category. The finalists will be notified by telephone and mail using contact details provided in their entry by 5 February 2012. This promotion is being conducted for entertainment purposes only. For the removal of doubt judging will only take into consideration factors stated in the descriptions outlined in these terms and conditions of entry and will only consider other factors if they, in their judging deem such factors to be necessary in selecting a winner. Decision of what factors will be considered in the judging process is determined by the judges in their complete discretion.
The finalist judging will commence on 8 February 2012. Judges will visit each category finalist at their homes by 17 February 2012 to determine theoverall winner of the promotion. The overall winner will be notified by telephone and in writing. The overall winner’s name will be announced at the 2012 Melbourne International Flower & Garden Show to be held between 28 March 2012 and 1 April 2012. For the removal of doubt, the overall winner is not required to be present at the Melbourne International Flower & Garden Show in order to claim their prize.
12 The best seven (7) entries as determined by the judges will be deemed the Finalists prize winner’s and will each win:
$1000 – awarded in the form of a cheque made in favour of the winner, two (2) tickets to the 2012 Melbourne International Flower & Garden Show to be redeemed for both days of the show between 28 March 2012-1 April 2012. Valued at $22 per double ticket per day.
Total prize pool for finalist winners is $7308.
The best entry from all finalist entries as determined by the judges will be deemed the overall winner and will win two (2) return flights from the winner’s nearest capital city to London (UK) valued up to $6000 (depending on point of departure), five (5) nights’ accommodation in London in a standard room twin-share at a minimum of three (3) star hotel valued at up to $3800, and two (2) tickets to the 2012 RHS Chelsea Flower Show, valued at $100 each.
13 Total prize pool is valued at $17,308. Prize does not include travel to and from Melbourne for the Melbourne International Flower & Garden Show, or any ancillary costs associated with redeeming the any of the prizes. These are the responsibility of the winner.
14 The Promoter is neither responsible nor liable for any loss or damage suffered in the event that the Melbourne International Flow & Garden Show or Chelsea Flower Show is postponed, cancelled, rescheduled or relocated for any reason whatsoever.
15 Redemption of prize is subject to the standard terms and conditions of individual prize and serviceproviders.
16 The major prize must be taken between 22 May 2012 and 26 May 2012 to coincide with the Chelsea Flower Show in London. Major Prize is subject to booking and availability.
17 It is a condition of accepting a prize that the Finalists or Overall Winner agrees to be interviewed, photographed, have their garden photographed and filmed at any time during the promotional period and the acceptance of the prize by the Promoter or their agents for a story or feature on this promotion to be developed and featured in Australian House & Garden magazine (or any other form of media it deems suitable) without further remuneration or reference to the participant. Details may feature in Australian House & Garden magazine on a date to be determined by the Promoters. The inclusion of any such feature (including but not limited to creative control of the feature) will remain with the Promoter at all times.
18 If the winner is unavailable to travel on the dates stipulated by the Promoter, the winner will forfeit the prize which they are unable to redeem. In the event that the winner is unable to redeem the prize on the dates stipulated by the Promoter, and the winner is unable to transfer the prize to a nominated person, then the prize will be forfeited by the winner and neither cash nor another prize will be awarded in lieu of the forfeited prize. In the event that the entire prize is forfeited by the winner, the Promoter will award the prize to the next valid entry drawn.
19 The winner (and their companion) are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
20 Unless expressly stated in these terms and conditions all other expenses (including travel to and from the departure point) become the responsibility of the winner.
21 A valid passport is required for all international journeys. It the responsibility of the winner and their travel companions to ensure they have all required travel documentation (including but not limited to passports and visas) as required for travel to the destination point. All costs associated with obtaining this travel documentation is the responsibility of the winner.
22 The two (2) flights must be utilised at the same time, for the same travel dates, to the same destination.
23 Transport to and from departure point including but not limited to additional domestic airfares if required, any additional meals, any extra sightseeing or activities, any additional accommodation, personal spending money, and all other ancillary costs, as well as obtaining any of these, are the responsibility of the winner and their travel companions. Prize also excludes medical expenses, items of a personal nature, beverages, optional tours not outlined, laundry, telephonecalls, additional nights, room upgrades or other ancillary costs associated with redeeming the prize other than those specified. These costs and expenses are the responsibility of the winner. Any extension to the duration of the prize is at the winner’s sole expense and subject to availability at the time of booking. For the removal of doubt, taxes for domestic travel are included in the prize winning domestic airfares provided by the Promoter.
24 It is a condition of accepting the prize that the winner may be requested to present their credit card upon arrival at any hotel to cover all incidentals they may incur including their stay at that hotel.
25 Prize must be taken as offered. The prize, or any unused portion of the prize, is not exchangeable or cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. In the event that a portion of the prize is awarded to the winner in the form of a voucher/ticket/pass/letter, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher/ticket/pass/letter. The Promoter will not be liable for any voucher/ticket/pass/letter that has been lost, stolen, forged, damaged or tampered with in any way. Redemption of prize at a venue is subject to the standard rules and regulations of that venue/s.
26 If the prize or portion of the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.
27 The Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
28 In the event of war, terrorism, state of emergency or disaster (including but not limited to natural disaster, the Promoter reserves the right to cancel, postpone, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority.
29 Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; (f) participation in the promotion and/ or (g) redemption of a prize.
30 As a condition of entering into this promotion, each entrant agrees to assign all of their rights, titleand interest in and to their entry to the Promoter. Entries will not be returned to any entrant. By entering this promotion, each entrant warrants to the Promoter that each entry submitted is an original artistic work of the entrant which does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition. The Promoter is entitled to use any of the entries (including but not limited to photographs submitted for any purposes at its discretion, including (but not limited to) for any future promotion, marketing and publicity purposes.
31 By entering the promotion each entrant consents to the Promoter publishing their entry in a feature appearing in House and Garden magazine and/or the House and Garden website. Inclusion of any such feature (including but not limited to creative control and the decision to include or not) remains with the Promoter at all times. For the removal of doubt the inclusion of an entry in any feature is only as an example of material submitted and in no way is be deemed as an announcement of prize winning status.
32 It is a condition of accepting the prize that the finalists and winners agree to interviewed and photographed at any time after finalist and winner notification by the Promoter or their agents for a story or feature on this promotion to be developed and featured in Australian House & Garden magazine (or any other form of media it deems suitable). Any such story will feature in House and Garden magazine at a time to be determined by the Promoter. All control relating to any such feature will remain with the Promoter at all times. Alternatively (to attending a photo shoot), the winner and/or runners up may be requested to provide the Promoter with a suitable photograph to be included in any such feature appearing in Australian House & Garden magazine or on the Australian House & Garden website.
33 If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
34 The collection, use and disclosure of personal information provided in connection with this competition are governed by the Privacy Notice.
35 All entries become the property of the Promoter. The collection, use and disclosure of personal information provided in connection with this competition is governed by the Privacy Notice (see Contents page of Australian House & Garden for location in this issue,).
36 By entering the competition and providing an email address, the entrant consents to receipt of any email regarding the competition, and other emails which inform the entrant of the Promoter’s other publications, products, services and events and to promote third party goods and services it may be interested in.
