Factorie Twilight Competition Terms and Conditions (Australia and NZ)1. The promoter is Factorie Pty Ltd (ACN 127 578 394) of 14 Shepherd Court, North Geelong, Victoria 3215.
2. Information regarding prizes and how to enter forms part of these terms and conditions. By entering this promotion, entrants accept these terms and conditions.
3. This promotion commences at 12pm AEST on 7 November 2011 and closes at 12pm AEST on 25 November 2011 (“promotion period”).
4. Entry is open to New Zealand and Australian residents aged 15 years or older (other than directors, managers, employees (and their immediate families) of the promoter and its related companies, agencies and suppliers involved in this promotion) who purchase any full priced Factorie product in a single transaction during the promotion period (“qualifying transaction”).
Individuals aged between 15 and 17 years old (inclusive) must have the permission of their parent or guardian to enter.
5. To enter, an eligible individual must complete and submit an online entry form at
www.factorie.com.au during the promotion period. Limit 1 entry per qualifying transaction. Incomplete, indecipherable, damaged or late entries will be deemed invalid. No responsibility will be accepted by the promoter for late, lost, damaged or misdirected entries. Individuals are responsible for any costs associated with accessing the promotional website which may be dependent on the Internet service provider used.
6. When submitting entries, entrants must leave their personal details including their full name, address, mobile telephone number, email address, date of birth and provide a response, in 25 words or less, to the question: “If you were a Twilight Saga Character who would you be and why?”” (“Question”).
7. Entries will be allocated into one of two categories, based on whether they are from Australian or New Zealand residents (“entry categories”).
8. Entries will be judged by a panel of the promoter’s marketing and communications personnel (“Panel”). The Panel will rank the top 11 entries from each entry category which contain the most relevant, creative and inspiring responses to the Question. All decisions of the Promoter and the Panel are final and no discussions or correspondence will be entered into.
9. The two entrants who submit the top ranking entry in each entry category will win a major prize (“winners”). The two winners will be notified by telephone and email and announced on Facebook by 30 November 2011.
10. The major prize is a private screening of THE TWILIGHT SAGA BREAKING DAWN PART 1 for each winner and 20 guests plus one THE TWILIGHT SAGA BREAKING DAWN PART 1 gift bag (total value of prize up to AUS$3,590). Screening also includes a small popcorn and Coke combo for the winners and each of their 20 guests. Prize does not include further meal or drink allowances; spending money; insurance; or any other ancillary costs.11. Winners must use their private screening before May 2012. Private screening is subject to film and theatre availability.
12. The remaining 10 top ranked entries in each entry category as judged by the Panel (“runners-up”) will receive a THE TWILIGHT SAGA prize pack (valued at $126 each).13. Each winner and runner-up will be contacted by Hoyts Distribution to arrange prize delivery shortly after being announced Before being eligible to receive a prize, each winner and runner-up must provide proof (in the form of a valid receipt, credit or bank card statement or as is otherwise sufficient in the opinion of the promoter) of having completed a qualifying transaction in relation to each of his or her respective entries into the promotion (“proof of purchase”).
14. If a winner or runner up does not claim a prize within 14 days of being announced or is unable or unwilling to provide proof of purchase, that individual may be deemed by the promoter as ineligible to receive the prize. The promoter will then reconvene the Panel to determine the next most relevant, creative and inspiring response to the Question and the entrant who submitted that entry will be deemed the replacement winner or runner-up as the case may be.
15. Prizes are not transferable or exchangeable and cannot be redeemed for cash. Prizes are subject to the further terms and conditions of Hoyts Distribution regarding cinema access and use.
The promoter accepts no responsibility for any variation in the value of prizes. Where a prize is unavailable for any reason, the promoter may substitute for that prize another item of equal or higher value as determined by the promoter.
16. The promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the maximum extent permitted by law).
17. Without limiting clause 17, the promoter and its associated agencies and companies will not be liable for any damage to any prize which occurs in transit. Each winner and runner up is responsible for any tax implications arising from winning any prize.
18. If this promotion is interfered with in any way or is not capable of being properly conducted due to any reason beyond the reasonable control of the promoter, the promoter reserves the right in its sole discretion, and to the maximum extent permitted by law, to disqualify any entrants or, subject to any written directions from a gaming authority, to modify, suspend, terminate or cancel this promotion, as appropriate.
19. All entries will be the property of the promoter. Personal information provided by entrants will be used by the promoter for the purpose of conducting this promotion and otherwise in accordance with entrants’ consent. The promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this promotion.
