1. This competition is open to Australian residents aged 18 years or over. It commences 01/12/2011. Entries close at 11:59pm (Sydney time) on 30/01/2012. The winner will be declared at Reader’s Digest, 80 Bay St Ultimo NSW on 31 January 2012 at 4:30pm.
 
2. To enter individuals must complete the form found at www.readersdigest.com.au.
 
3. The promotional material, information on how to enter and prize details form part of these rules. You must reply in accordance with the conditions specified in this promotion. Employees of Reader's Digest and members of their immediate families are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
 
4. The winner will be determined based on their answer to the skill-based question. Each entry will be judged according to literary and creative merit of the answer provided to the promotional question. There will be one (1) winner declared. The winner will receive two (2) concert tickets to the Rod Stewart concert in Sydney on 14/02/2012, return flights to and from their nearest capital city and one night’s accommodation. The winner must make their own way to and from the airport and venue (transport and personal incidental expenses are not included in the prize). Concert tickets, flights and accommodation to be organised by the promoter. Total number of prizes: 1. Prizes are not transferable or exchangeable; nor are they redeemable for cash or alternative concert times or dates.
 
5. The provisional prize winner will receive a Reader’s Digest official notification email and telephone call. The provisional prize winner will need to respond to their Reader’s Digest official notification email within 48 hours to claim their prize. In the event that the provisional winner does not respond to their Reader’s Digest official notification email within 48 hours, he/she will forfeit any right to the prize and the next best entry, as determined by the judges, will become the next provisional prize winner.
 
6. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. The promoter's decision on all matters pertaining to this promotion is final and no correspondence will be entered into.
 
7. The promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process or is in any other way responsible for compromising the orderly operation of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
 
8. Incomplete, indecipherable or illegible entries will be deemed invalid.
 
9. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
 
10. Limit of one (1) entry per person. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The promoter accepts no responsibility for late, non-directed, misdirected or delayed entries/e-mails, for any technical hardware or software failures of any kind, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any human error which may occur in the receipt or processing of entries. Further, the promoter accepts no responsibility for damage to computer systems from downloading any information necessary to participate in the promotion. The promoter reserves the right to terminate or modify the promotion at any time if the Reader’s Digest on-line service is no longer available or is compromised by any virus, bugs, or other intervention beyond the promoter’s control. In either of these events, prizes may be awarded based on entries received prior to date of termination. The Rod Stewart concert is subject to the event venue and ticket terms and conditions, including any applicable age restriction. The promoter and event organizers hereby expressly reserve the right to eject any winner (and/or his/her companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in the prize.
 
11. All entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the entrant.
 
12. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter a promotion repeatedly is prohibited and will render all entries submitted by that entrant invalid.
 
13. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
 
14. If for any reason the prize winner does not take the prize at the time/dates stipulated by the promoter, then the prize will be forfeited.
 
15. As a condition of entering into this promotion, each entrant licences the promoter to use their entry (including the literary work) in any media for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes. Each entrant warrants to the promoter that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party. The entrant agrees to indemnify the promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
 
16. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
 
17. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
