Red Bull Design Competition




Red Bull Australia is currently on the search for the most talented creative designer to design a surfboard for Australia’s No.1 pro surfer Sally Fitzgibbons. She’s also the No.2 female pro surfer in the world!

If you win, not only will you have the honour of having your design on Sally’s board while she compates in 2012. You will also get 2 return tickets to the Roxy Pro in Coolangatta to watch Sally surf on your design as well as $1500 cash. The people’s choice won’t go unnoticed either, the design that gets the most ‘likes’ will also take home $1000 cash.


So jump on the Red Bull website, register and download the kit to start designing. Make sure you submit it by the 22nd of Janurary 2012, as Sally will be handpicking her top 20 for an exhibit in Sydney in Feburary where the winner will be announced. If you make the top 5, you will be flown to Sydney with a mate for the announcement… not bad.

Red Bull Design Sally’s Board Competition Promotion Rules and Conditions of Entry

Information on how to enter and these Promotion Rules and Conditions of Entry and our Privacy Policy at www.redbull.com.au/sally (the “Website”) constitute the entire agreement between Red Bull Australia Pty Limited (ABN 67 085 840 259) (the “Promoter”) and each participant in the Promotion (the “Participant”) in relation to participation in the Red Bull Design Sally’s Board Competition (the “Promotion”).
The Promoter is holding the Promotion during December 2011 and March 2012.
By entering the Promotion each Participant expressly accepts all risks associated with their involvement with the Promotion. In consideration of the Promoter accepting the Participant’s entry and allowing them to participate in the Promotion, the Participant must fully and unconditionally agree, acknowledge and accept these Promotion Rules and Conditions of Entry, which are a condition precedent to their participation in the Promotion:
The Promotion
1. The Promotion aims to allow:
(1) one (1) Major Prize winning Participant chosen by Sally Fitzgibbon to have their design (“Winning Design”) featured on Sally Fitzgibbons 2012 competition board for the ASP Women’s World Tour (“Competition Surfboards”) and receive a replica Sally Fitzgibbons DHD surfboard featuring the Winning Design and $1,500 cash (“Major Prize”);
(2) five (5) finalists and a friend will be flown to Sydney in early February 2012 to the gallery and unveiling event where the winning design will be announced;
(3) the top twenty (20) designs will be exhibited at the gallery and unveiling event in Sydney early February 2012; and
(4) the one (1) design with the most Facebook “Likes” in the online gallery will win the People’s Choice Prize (“People’s Choice Design”) and will receive a DHD surfboard featuring the People’s Choice Design and $1,000 cash.
2. The Promotion will be conducted from 1 December 2011 until 1 March 2012 (the “Promotion Period”).
3. To become a Participant in the Promotion an eligible person must register their required details and their Surfboard Design on the Promotion page at the Website. The details required include, but may not be limited to, the Participant’s full name, address, contact number and email address.
4. False, incorrect, indecipherable or incomplete registration information will deem the entry invalid, making that Participant ineligible to enter the Promotion and to win any prizes.
5. The Promotion is a game of skill and merit; chance plays no part in determining the eventual winners. The Participants with the best Surfboard Design, as judged by Sally Fitzgibbons (in relation to the Winning Design) and the general public (in relation to the People’s Choice Design) will win. Promoter’s decision in relation to all matters pertaining to the Promotion is final and no correspondence will be entered into.
6. Participation in the Promotion is deemed to be an acceptance of these Promotion Rules and Conditions of Entry. The Promoter reserves the right to amend these Promotion Rules and Conditions of Entry at any time without prior notice.
Eligibility:
7. The Promoter reserves the right, at any time, to verify the validity of entries and Participant’s (including a Participant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Promotion Rules and Conditions of Entry, who tampers with the entry process or interferes with the Promotion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Incomplete or incorrect entries will be deemed invalid.
8. Entry to the Promotion is only open to Australian residents over the age of 16 years who are selected by the Promoter for participation in the Promotion in accordance with these Promotion Rules and Conditions of Entry. Entry to the Promotion is not open to employees (and their immediate family members) of the Promoter and their associated agencies and companies. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin. If an entrant is under the age of 18, then that entrant must possess legal parental or guardian consent from a parent or guardian who has read and consented to these Promotion Rules and Conditions of Entry.
Entry:
9. To participate in the Promotion, Participants must submit a surfboard design created in accordance
with these Promotion Rules and Conditions of Entry into the Promotion (“Surfboard Design”) by:
(1) loging onto the Website and fully complete and submit the on-line registration form to
register as a Participant;
(2) following the instructions on the Website to download the Surfboard Design template
(“Template”) which must be used to submit your Surfboard Design;
(3) using the Template to create their Surfboard Design as follows:
(a) any colouring on the Template may only extend to the border of the Template;
(b) colour may be added to the Template in any way including, without limitation, digitally or with oil paints, charcoal, collage, ink, paint and aerosol;
(c) sponsor logos on the template must be visible and not covered;
(d) submitted designs must not include any commercial, inappropriate or brand-related material unless otherwise expressly approved by the Promoter.
(4) the Surfboard Design must be submitted to the Promoter by 23:00 on 22 January 2012 either digitally (by uploading the Surfboard Design via the appropriate link in your registration email) or by posting the Surfboard Design to Red Bull Australia, Attn: Brent Nassibian, Locked Bag 3100, Strawberry Hills, NSW, 2012;
(5) all Surfboard Designs must be received by the Promoter no later than 23:00 on Sunday 22 January 2011.
Promotion period:

10. The Promotion will be conducted from 09:00 on Thursday 1 December 2011 until 23:00 (AEST) on 1
March 2012 (the “Promotion Period”).
11. Entries will be deemed to be received at the time they are recorded as being received and fully
registered in the Promoter’s system, not at the time they were sent by the Participant.
Judging:
12. Each Participant who has validly entered the Promotion over the Promotion Period, registered all details and their Surfboard Design in accordance with these Promotion Rules and Conditions of Entry and has complied with these Promotion Rules and Conditions of Entry will be entered into judgment for the Promotion and their Surfboard Design will be uploaded on the Website.
13. The judging of Participant Surfboard Designs for the Winning Design will take place at Red Bull Australia Pty Ltd, 2 Huntley Street, Alexandria, NSW 2015 on 23 January 2012.
14. Surfboard Designs will be judged based on the originality and creative merit of their Surfboard Designs and the Participant with the Winning Design will win the Major Prize;
15. The top:
(1) Five (5) finalists designs and a friend that will be flown to Sydney and their artwork on
display at the exhibition and unveiling event will be notified on 25 January 2012;
(2) Twenty (20) designs that will be displayed at the exhibition and unveiling event will be notified on 25 January 2012.
(Collectively the “Finalists”)
16. The winner of the Winning Design and the Finalists will be chosen at the absolute discretion of the
Promoter and will be selected based on the originality and creative merit of their Surfboard Designs.
17. All Surfboard Designs on the Website will be judged by the general public (“Voters”) by Voters casting Facebook “Likes” at the online gallery of entries on the Website. Voting will be open between 9.00 (AEST) 12 December 2011 and 23.00 (AEST) 1 March 2012. The Surfboard Design with the most votes as at 23.00 (AEST) 1 March 2012 will be judged the People’s Choice Design and will win the People’s Choice Prize. The winner of the People’s Choice Design will be chosen at the absolute discretion of the Promoter, based on the number of Facebook “likes” received.
18. The Participant whose Surfboard Design is determined to be the People’s Choice Design will be notified by email of their selection on 1 March 2012.
19. The Participant whose Surfboard Design is judged the:
(1) Winning Design will be announced at the Sydney exhibition and unveiling event in early
February 2012;
(2) People’s Choice Design will be announced on the Website on 1 March 2012.
(Collectively the “Winners”).
20. All Participants and Voters must conduct themselves in a fair, honest and sporting manner; no cheating will be tolerated. Amongst other acts, the Promoter shall consider interfering with or harassing other Participants, unduly accessing, manipulating or influencing (i.e. “spamming” or using other malicious codes) the Competition or the Website or otherwise hindering the Promoter, or its agents or representatives to constitute cheating.
21. The Promoter may, at its sole discretion, exclude any votes for any Surfboard Design in the competition for the People’s Choice Design that it deems to have been cast in any way at odds with clause 20, above.
Winning Design:
22. Once selected, the Participant whose entry is judged Winning Design will be required to travel to the Roxy Pro at Coolangatta, Queensland for three days (such timing at the discretion of the Promoter) during the event period from 26 February 2012 to 9 March 2012.
23. The Promoter’s decision throughout the Promotion will be final and no correspondence will be entered into.
24. It is a condition of accepting any prizes or benefits in relation to the Promotion that the Winners and Finalists may be required to sign a legal release and/or further documentation in a form determined by the Promoter in its absolute discretion.
The Prizes:
25. The Major Prize consists of the following benefits, as determined, booked and arranged by the Promoter in its unfettered discretion:
(1) the right to have the Winning Design featured on Sally Fitzgibbons 2012 competition Surfboards;
(2) Flights and transfers from their nearest Australian capital city and 3 nights accommodation for two (2) people (winner and a friend) to attend the Roxy Pro in Coolangatta, Queensland;
(a) To watch Sally Fitzgibbons surf from the Roxy Pro VIP Marquee; and
(b) To meet Sally Fitzgibbons;
(3) a Sally Fitzgibbons DHD Surfboard featuring the Winning Design; and
(4) AUD$1,500 cash.
26. The Top five (5) finalist designs prize consists of the following benefits as determined, booked and arranged by the Promoter in its unfettered discretion:
(1) Flights and transfers for the top 5 selected and a friend from their nearest capital city to Sydney to attend the Sydney exhibition and unveiling event in early February 2012; and
(2) Accommodation in Sydney for one (1) night for each top 5 finalist and a friend while attending the Sydney exhibition and unveiling event in early February 2012; and
(3) A DHD surfboard featuring their design.
27. The top twenty (20) designs prize consists of the following benefits as determined booked and arranged by the Promoter in its unfettered discretion:
(1) Designs will be displayed at the Sydney exhibition and unveiling event; and
(2) Top 20 finalists will be invited to attend the exhibition and unveiling event with friends and family.
28. The People’s Choice Prize consists of the following benefits, as determined by the Promoter in its unfettered discretion:
(1) A DHD Surfboard with the People’s Choice Design featured on it; and
(2) AUD$1,000 cash.
29. The Major Prize is valued at up to $8,200, the top five (5) finalists prize are each valued at up to $1,700 each and the People’s Choice Prize is valued at up to $1,700.
30. The total prize pool is valued at $18,400.
31. Participants must (i) abide by any requirements of the Promoter, event organisers and their representatives as determined by those parties in their absolute discretion; (ii) not be under the influence of drugs; and (iii) comply with all directions of the Promoter event organisers and any regulatory authority at all times.
32. The Winners and Finalists must be available to take the prizes they are awarded and (in the case of the Winner of the Winning Design) attend Sydney or Coolangatta, Queensland on the date and at the time and location directed by the Promoter. If for any reason a Winner or Finalist does not or cannot take an element of the prize or benefit at the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited by that Winner/Finalist.

33. The value of the prizes is accurate and, where applicable, based upon the recommended retail price(s) at the date of printing. The Promoter accepts no responsibility for any variation in the value of the prizes after that date. The prizes (including any unused portion) cannot be transferred, exchanged or redeemed for cash. The Promoter retains the right to substitute the prizes with prizes of equal or greater value (including where the prizes are unavailable). The prizes must be taken as offered and cannot be varied.
34. Unless otherwise expressly stated, prizes do not include spending money for the prize winners or transport, accommodation or flights for prize winners or any other individuals, or any other costs and expenses unless specifically notified and agreed the Promoter.
35. Any tax liability arising as a result of accepting any prize is the responsibility of the Participant awarded that prize.
36. Where the Promoter sees fit, the winner of the Major Prize shall be escorted by a representative of the Promoter during the duration of their attendance at any event forming an element of the Major Prize.
Promoter Discretion
37. If the Promoter determines, in its absolute discretion, that a Winner or Finalist is not in the necessary condition to safely participate in any element or the prize, the Promoter reserves the right to refuse to award to that Participant part of that prize.
38. The Promoter may, at its absolute discretion, disqualify any Participant that does not comply with these Promotion Rules and Conditions of Entry to its satisfaction and in its sole discretion.
39. The Promoter’s decision in all matters relating to the Promotion shall be final, and no correspondence will be entered into, including in the event of a dispute.
40. If for any reason this Promotion is not capable of running as planned, the Promoter reserves the right in its discretion to modify the terms of the Promotion including the prizes, these Promotion Rules and Conditions of Entry and to postpone, cancel or amend the Promotion without compensation to any Participant or third party.
41. The Promoter, in their absolute discretion, at all times reserve the right to:
(1) prevent any Participant from participating in the Promotion if, at any time, they reasonably believe that the Participant poses a safety risk or for any other reason, including but not limited to, acting in a manner which is likely to bring the Promoter into disrepute, or is likely to cause harm to Participants, the Promoter’s employees, contractors or volunteers, any other third party or their property;
(2) change the format of the Promotion for any reason including but not limited to number of entries, time constraints or any unforseen incidents; and
(3) cancel the Promotion if any conditions are deemed dangerous.
If the Promotion is varied for any reason beyond the control of the Promoter it may not be rescheduled and no compensation will be offered.
Publicity
42. The Winners and Finalists agree to participate in any news media activities surrounding the Promotion. It is a condition of entry that each Participant agrees that their image and/or voice, and likeness as recorded, photographed or filmed during the Promotion and (including but not limited to as part of the Promotion), may be broadcast or published by the Promoter or its related entities worldwide in any media, including but not limited to television, radio, internet, newspapers, magazines, or any other advertising, marketing or publicity purposes in connection with the Promotion or any future event in perpetuity and throughout the world without additional compensation or further consent being obtained. Participants consent to any use of the above created materials in a way which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
Surfboard Design Ownership
43. In consideration of the opportunity to participate in the Promotion and win the prizes, all Participants hereby assign their rights, title and interest (including copyright) in and to their Surfboard Design to the Promoter and/or their nominees and acknowledge that the Promoter and/or their nominees may use, reproduce, modify, adapt, publish and display the Surfboard Design for any purpose in any media, without restriction to use.
44. In further consideration of the opportunity to participate in the Promotion and win the prizes, all Participants waive any moral rights to the extent permitted by law and where not permitted by law, Participants consent to all acts or omissions, including all acts or omissions which, but for this consent, would infringe your moral rights or any similar rights in respect of the design in any jurisdiction.
Lost Entries, Costs and Technical Problems
45. The Promoter and its associated agencies or companies accept no responsibility for lost, late, stolen,
damaged or misdirected entries or Surfboard Designs.
46. Any cost associated with accessing the Promotion website is the Participant’s responsibility and is dependant on the internet service provider used.
47. To the extent permitted by law, the Promoter excludes liability for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the internet or any website; or any unauthorised intervention, or any combination thereof – including any injury or damage to any Participant’s or any other person's computer related to, or resulting from, participation in this Promotion or downloading any materials in this Promotion. The Promoter accepts no responsibility for entries not received or included for any reason, including due to technical or other failure or for any periods that the website or entry mechanism is unavailable for any reason during the Promotion period.
Limitation of Liability
48. Without in anyway limiting any other provision in these Promotion Rules and Conditions of Entry, and except for any liability that cannot be excluded by law, the Promoter and event organisers (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (i) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (ii) any theft, unauthorised access or third party interference; (iii) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (iv) any variation in prize value to that stated in these Promotion Rules and Conditions of Entry; (v) if the Promotion is cancelled for any reason beyond the reasonable control of the Promoter; (vi) any tax liability incurred by a Winner or Participant; (vii) participation in the Promotion; or (viii) use of, or participation in any prize.
49. If any act or omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Promotion Rules and Conditions of Entry, the Promoter will not be liable for any failure to perform or delay in performing its obligation and the Promoter reserves the right (subject to any applicable law) to cancel, terminate, modify or suspend the Promotion.
Personal Information
50. All entries in the Promotion become the property of the Promoter. The Promoter collects Participant personal information in order to conduct the Promotion and may for this purpose disclose such information to third parties. If Participants do not provide the mandatory personal information requested then Participants will not be able to take part in the Promotion. By entering this Promotion, unless otherwise advised by the Participant, each Participant consents to the Promoter using the Participant’s personal information to administer the Promotion, announce the winners and disclosing the Participant’s personal information to organisations that assist the Promoter with administering the Promotion, and to third parties as required by law (including authorities that regulate this Promotion). The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth) and by entering the Promotion, the Participant is taken to consent to the Promoter’s privacy policy (which is available on request and at the Promoter’s website). By entering into this Promotion, each Participant also consents to the Promoter using their personal information for future marketing purposes, unless otherwise advised by the Participant. A Participant may access, update or correct any personal information held by the Promoter, upon request to the Promoter.
Intellectual Property
51. The brand names, logos and related taglines appearing on the Website, whether or not appearing in large print or with the trade mark symbol, are trade marks of the Promoter, or its related bodies corporate.
52. The use or misuse of these trade marks or any other materials, except as permitted in these Promotion Rules and Conditions of Entry, is expressly prohibited.
General:
53. Participants must follow all safety instructions of the Promoter, wear any safety equipment required
by the Promoter at any stage, and comply with all reasonable requests and directions of Promoter.
54. The Promoter reserves the right to change these Promotion Rules and Conditions of Entry at any time.
55. These Promotion Rules and Conditions of Entry are governed by the laws of New South Wales, Australia and references to times are references to the time in Sydney, Australia (AEST)
56. The Promoter is Red Bull Australia Pty Ltd (ABN 67 085 840 259) of 2 Huntley St, Alexandria NSW 2015, (02) 9023 2800.
57. If a Participant is under 18 years of age, his or her parent or guardian must sign any legal documentation on his or her behalf and complete any consents required by the Promoter to participate in the Promotion.
