DELL XPS 14Z SERENADE COMPETITION TERMS AND CONDITIONS
1. The promoter of the “Dell XPS 14z Serenade” competition (Competition) is Wunderman Pty Ltd (ABN 92
003 866 788) of level 7, 150 William St, Sydney, NSW 2011, Australia (Promoter).
2. Entry into the Competition constitutes acceptance of these terms and conditions on the Dell Australia for
Home Facebook page  https://www.facebook.com/DellAUSHome. All entry instructions and prize
information published by the Promoter also form part of these terms and conditions.
Competition dates
3. The Competition commences at 11:00am (AEDT) on Wednesday 30
th
November 2011 and closes at
11:59pm (AEDT) on Sunday 18
th
December 2011 (Competition Period).
Qualifying Criteria
4. Before individuals can enter the Competition, they must meet the following criteria (Eligibility Criteria):
a. an individual must be an Australian resident;
b. an individual must not be a director or employee of the Promoter or agencies associated with this
promotion, or an immediate family member of a director or employee of the Promoter or agencies
associated with this promotion; and
c. an individual must be 18 years of age or over.
5. Entry into the Competition is free and all entries must be submitted to Promoter within the Competition
Period.
Entering the Dell XPS 14z Serenade Competition
6. Entrants can submit one (1) entry into the Competition. Entry to the competition starts from 11:00am
AEDST on Wednesday 30
th
November 2011.

7. To enter the Competition, individuals must ‘Like’ the Dell Australia for Home Facebook fan page
https://www.facebook.com/DellAUSHome, accept the ‘Serenade Competition’ application (Application)
by clicking “Allow” when prompted, and via the Application, upload an original video of the individual
singing the song (video) and submit it using the process below:
a. click on the lyrics tile located on the Dell Australia for Home Facebook page to download the lyrics
(PDF document) of the song;
b. complete the competition entry form on the Application  at
https://www.facebook.com/DellAUSHome; and
c. follow the instructions to upload their video to the Application at
https://www.facebook.com/DellAUSHome.
8. Videos must be submitted in the following format:
a. only AVI, MOV,QT or FLV and must not exceed file size 50 MB;
b. the entrant must sing the full song with no background music. The song must be the same song as
specified on the music sheet provided (the PDF document) and no variations to the lyrics are allowed.
The entrants must not play any musical instrument in the video. The entrant must feature by
themselves in the video and no other person is to feature in the video; and 
c. it is compulsory that the entrant must wear headphones while singing the song or the entry will not
be eligible.
9. Videos must not contain information that:
a. is patently offensive and promotes racism, bigotry, hatred or physical harm of any kind against any
group or individual;
b. harasses or advocates harassment of another person;
c. exploits people in a sexual or violent manner;
d. contains nudity, excessive violence, or offensive subject matter;
e. constitutes or promotes information that they know is false or misleading or promotes illegal
activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
f. contains or constitutes or promotes an unauthorised copy of another person's copyright work or
photograph;
g. uses sexually suggestive imagery or any other unfair, misleading or deceptive content;
h. violates the privacy rights, publicity rights, copyright, trademark rights, contract rights or any other
rights of any person; and/or
i. contains any virus, Trojan, worm, disabling code and/or bugs. 2
10. The Promoter or its representatives may review a video before posting it on the Application at
https://www.facebook.com/DellAUSHome and/or the Dell Australia YouTube Channel
http://www.youtube.com/dellaustralia. All valid entries will be displayed on the Application at and/or the
Dell Australia YouTube Channel for public viewing and voting. By entering this Competition, entrants
consent to the Promoter publishing their video on these websites.
11. The Promoter reserves the right to reject or refuse to publish any entry at the Promoter’s absolute
discretion. The Promoter, in its sole discretion, may contact an entrant and provide the entrant with the
opportunity to resubmit their entry. Resubmitted entries are intended to allow entrants to update/modify
their video or to provide a video in a different file format. Any resubmitted entry must be accepted by the
Promoter to become a valid entry into the Competition. A resubmitted entry is not complete and accepted
until this step has occurred. The decision by the Promoter to accept or reject a resubmitted entry as a
valid entry is in the Promoter’s sole discretion and no correspondence will be entered into. 
12. The Promoter takes no responsibility for late or misdirected Competition entries or any delays or failures
in any telecommunications services or equipment. Competition entries will be deemed to be accepted at
the time of receipt by the Promoter and not at the time of transmission. Incomplete, inaccurate,
erroneous, ineligible or incomprehensive Competition entries will be deemed invalid.
13. When an entrant submits any materials via the Competition including comments, recordings, videos and
images (Content), the entrant, unless the Promoter advises otherwise, licenses and grants the Promoter,
its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sublicensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any
media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any
moral rights in relation to such use and warrant that they have the full authority to grant these rights.
Entrants agree that they are fully responsible for the Content they submit. The Promoter shall not be
liable in any way for such Content to the full extent permitted by law. The Promoter may remove any
Content without notice for any reason whatsoever. Entrants warrant and agree that: (a) they will not
submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any
intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic,
sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race,
religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
(b) they will obtain prior consent from any person or property that appears in their Content; (c) they will
obtain full prior consent from any person who has jointly created or has any rights in the Content, to the
uses and terms herein; (d) their Content shall not contain viruses or cause injury or harm to any person or
entity; and (e) they will comply with all applicable laws and regulations, including without limitation, those
governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or
communication systems.
Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of
the above terms.
Judging and prize draw
14. The winners will be, subject to verification by the Promoter, the videos that received the two (2) highest
total number of votes on the Application https://www.facebook.com/DellAUSHome.
15. Voting will be open between 11:00am (AEDT) on Wednesday 30
th
November 2011 and closes at 11:59pm
(AEDT) on Sunday 18
th
December 2011.
16. The prize winners will be notified in writing by the Promoter within two (2) days of the judging of
Competition entries using the contact details provided by entrants. The name of the prize winners will
also be published on Dell Australia Facebook for Home Facebook Fan page
https://www.facebook.com/DellAUSHome.
17. All winners must, if requested by the Promoter, verify their compliance with these Competition Terms and
Conditions prior to receiving a prize.  The required verification will be in a form determined by the
Promoter in its absolute discretion. If any winner does not comply with this clause they will forfeit their
prize.
Prizes3
18. The Promoter will, subject to verification, award  two (2) prizes to the top (2) most popular entries based
on voting by users of the Application at https://www.facebook.com/DellAUSHome as follows:
Major prize
19. The major prize winner will be the video which receives the highest total number of votes in the
Competition.
20. The major prize winner will win AU$10,000 cash and a Dell XPS 14z Laptop (valued at $1,199). Cash prize
will be awarded in the form of a cheque.
Runner Up Prize
21. The runner up prize winner will be the video which receives the second highest total number of votes in
the Competition.
22. The runner up prize consists of a Dell XPS 14Z Laptop (valued at $1,199).
23. This is a game of skill and chance plays no part in determining the winners.  In the event of a tie, the
Promoter will individually judge each tied entry to determine the winner/s. Each tied entry will be
individually judged based on the entrant’s song performance on the video.
Promotional and other obligations
24. By entering the Competition, entrants agree that, in the event that their entry is selected as a winner of
any prize referred to in these Competition terms and conditions, they will be available for reasonable
publicity purposes related to the Competition and that (without limiting its rights), the Promoter may
conduct interviews and take photographs to be used for such publicity purposes and publication by the
Promoter. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event
they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited
period without remuneration for the purpose of promoting this Competition (including any outcome), and
promoting any products manufactured, distributed and/or supplied by the Promoter.
Your Representations
25. By submitting an entry, entrants represent that:
a. their video is original;
b. they are the sole creator of their video;
c. their video does not infringe the intellectual property rights of any third party;
d. their video has not been previously entered into in any other contest or competition;
e. their video has not been previously published in any medium;
f. their video does not violate any Australian laws;
g. their participation in the Competition does not violate their employer’s policies; and
h. they waive all claims to any moral rights that they may have in their  video and they consent to the
Promoter’s use of their video in any manner it deems fit.
Miscellaneous
26. The Promoter’s decision is final and no correspondence will be entered into.
27. The Promoter accepts no responsibility for any tax implications that may arise from the winning of any
prizes and entrants should seek independent financial advice before entering the Competition.
28. If for any reason any element of a prize becomes unavailable for any reason beyond the Promoter’s
reasonable control, then a similar prize of equal or greater value will be awarded to a prize winner in lieu.
29. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify
the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any
other implied warranties under the ASIC Act or similar consumer protection laws in the State and
Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be
excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers,
employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or
damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any
way out of the Competition.
30. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees,  the
Promoter (including its respective officers, employees and agents) is not responsible for and excludes all
liability (including negligence), for any personal injury; or any loss or damage (including loss of 4
opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical
difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft,
unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered,
damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond
the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and
Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of  prize.
31. Use of any automated system (i.e. bots, software applications which create dummy entries without any
human involvement) or any unfair means to vote for Competition entries or participate in the Competition
is prohibited and will result in disqualification.
32. The Promoter reserves the right, at any time, to verify the validity of entries, votes, entrants and voters
(including identity, age and place of residence) and to disqualify any entrant/voter who submits an
entry/vote that is not in accordance with these terms and conditions or who tampers with the
entry/voting process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the
Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
33. The Promoter reserves the right, at any time, to invalidate any votes which it reasonably suspects have
been submitted using false, incorrect, fraudulent or misleading information, including but not limited to
personal details and contact information and/or votes that have been submitted through the use of
multiple identities, email addresses or accounts, including but not limited to social networking accounts.
34. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion,
to determine the identity of the entrant.
35. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash,
unless otherwise specified.
36. Any cost associated with accessing the promotional website is the entrant’s responsibility and is
dependent on the Internet service provider used.
37. As a condition of accepting the a prize, a winner must sign any legal documentation as and in the form
required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a
legal release and indemnity form. 
38. If for any reason the Competition is not capable of running as planned (including but not limited to)
infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures,
prohibition by the relevant authorities or any other causes beyond the control of the Promoter which
corrupts or affects the administration, security, fairness, integrity or proper conduct of the Competition,
the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the
Competition as it sees fit. Any entry which is made as a result of tampering with the entry process will be
invalid and not eligible for judging and/or any prizes.
39. These Competition terms and conditions are to be construed in accordance with the law in New South
Wales and the parties submit to the exclusive jurisdiction of the courts of New South Wales.
40. The Promoter collects personal information in order to conduct the Competition and may, for this purpose,
disclose such information to third parties, including but not limited to agents, contractors, service
providers, and prize suppliers, including Dell Australia Pty Limited. Entry is conditional on providing this
information. The Promoter or Dell Australia Pty Limited may, for an indefinite period, unless otherwise
advised, use the information for promotional, marketing, publicity, research and profiling purposes,
including sending electronic messages or telephoning the entrant. Entrants should direct any request to
access, update or correct information to the Promoter. All entries become the property of the Promoter.
41. Entry and continued participation in the Competition is dependent on entrants following and acting in
accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at
www.facebook.com/terms.php.This Competition is in no way sponsored, endorsed or administered by, or
associated with, Facebook.  Entrants understand that they are providing their information to Dell Australia
and not to Facebook.  The information entrants provide will only be used for purposes as detailed in these
terms and conditions.

b. provide an answer in 25 words or less to the question ‘What is your best pickup line to the XPS 14z
Laptop?’.
8. Entries must not contain information that:

b. harasses or advocates harassment of another person;
c. exploits people in a sexual or violent manner;
