Privacy Statement
The information obtained by entering the 2011 Sydney New Yearâs Eve Photo Competition will be used by administration staff at City of Sydney and all entrants will be added to the subscription lists for the Cityâs e-newsletters including Whatâs On, Live
Green and Cycling in the City. The information will be used by the City of Sydney to conduct post event research. Supply of the information in the form is voluntary, but no entries will be considered valid without these details. The personal information obtained from the form will remain confidential. After processing, the information will be stored on City of Sydneyâs files for the purposes indicated in the Conditions of Entry.
Conditions of Entry
1. Information of how to enter and prizes form part of these Conditions of Entry for the City of Sydneyâs 2011 Sydney New Yearâs Eve Photography Competition (the âPhoto Competitionâ): Submission of a photograph in this Photo Competition is deemed acceptance of these Conditions of Entry.
2. The promoter of this Photo Competition is the Council of the City of Sydney (the âCityâ) (ABN 22 636 550 790), 456 Kent Street, Sydney, New South Wales, Australia.
3. Entry to the Photo Competition is open to any individual. Entrants under 18 years of age must have the consent of their parent or guardian to enter. Employees and their immediate families of City of Sydney are ineligible to enter. An entrant must be a person or group and not a company or an organisation.
4. The Promoter reserves the right to verify the validity of entries and to disqualify any entrant for tampering with the entry process, submitting an entry that is not in accordance with these Conditions of Entry or is engaged in any unlawful or other improper conduct calculated to jeopardise the fair and proper conduct of the Photo Competition or the Promoterâs interests.
5. Entry into the Photo Competition is free and entrants may enter multiple photographs in the Photo Competition.
6. To enter, each entrant must:
(i) Complete the Online Entry Form with all requested details including full name, contact phone number, email and suburb.
(ii) Attach and upload photo. Incomplete entries will be deemed invalid and will be discarded. Entries will only be accepted in JPEG (.jpg) or TIFF (.tiff) digital formats and maximum file size of 5MB. Entries should be the best possible quality images and unzipped.
7. Only entries of the 2011 Sydney New Yearâs Eve event will be accepted into the Photo Competition.
8. The Photo Competition opens at 12:00am EDST on Sunday 1 January 2012 and closes at 5pm EDST on Thursday 12 January 2012 (âPhoto Competition Periodâ). The Prize Winner will be announced on Monday 16 January 2012 and then notified by phone. The Prize Winnerâs name will be published on the website
www.sydneynewyearseve.com by 17/01/12. This Photo Competition will be judged at the sole discretion of representatives of the Promoter and the judges decision is final and no correspondence will be entered into.
9. All entries must be original and the entrantâs own work. By entering the Photo Competition each entrant warrants that every photograph submitted by the entrant does not infringe the intellectual property rights of a third party and each entrant further warrants that they own all rights to the photograph submitted. Entries that infringe copyright are automatically disqualified from the Photo Competition. Each entrant indemnifies the Promoter against any costs that the Promoter may incur as the result of any copyright infringement from the breach of these warranties.
10. The Prize Winner will receive an exclusive prize package including a Canon IXUS 310 Camera worth $350, $200 JB HIFI voucher, $200 worth of music CDâs and 2 VIP tickets to watch the 2012 Sydney New Yearâs Eve Fireworks in the heart of the Harbour action, at Dawes Point Reserve.
11. The Prize Winner will be notified of their prize by phone. A courier will be arranged by the Promoter to deliver the prize to the winner at their specified address.
12. Total Prize value is $2,250 (AUD), inclusive of GST.
13. All travel costs associated with the redemption of the prize(s) by the Prize Winner will be at the expense of the Prize Winner. All prize(s) are to be redeemed in Sydney.
14. Prize, or any unused portion of the prize, is not transferable, exchangeable or redeemable for cash. The Promoter accepts no responsibility for any variation in the prize value. No responsibility accepted for late, lost or misdirected entries.
15. In the event that for any reason the Prize Winner does not claim the prize by 31/01/12, then the prize is forfeited.
16. All entries become the property of the Promoter.
17. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained as a result of participating in this promotion or by taking a prize, except for any liability which cannot be excluded by law.
18. By entering the Photo Competition each entrant grants to the Promoter, Destination NSW and agencies of the NSW State Government, an irrevocable non exclusive licence to publish, reproduce, display, broadcast or otherwise use the photographs in any form of media (print or web) for any promotional, marketing, publicity or research purposes of the Promoter, Destination NSW and agencies of the NSW State Government or for any other purpose consistent with the Promoterâs, Destination NSW âs and agencies of the NSW State Governmentâs functions, without payment to or attribution of the entrant.
19. By entering a photograph in the Photo Competition which includes images of people, each entrant warrants that such people have given their permission for their image to be included in the photograph and have agreed that the photograph (including their image) may be used by the organisations named and for the purposes specified in Condition 18 of these Conditions of Entry.
20. By entering a photograph in the Photo Competition, each entrant also agrees that any other sponsor, partner or supplier of 2011 Sydney New Years Eve may reproduce the photograph (including any images of people) for the purpose of reporting their involvement in the event in a publication such as an annual report or on their website and each entrant warrants that any people in the photograph have given their permission for their image to be reproduced for such purpose.
21. If for any reason this promotion is not capable of running as planned, including tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fraud, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in their sole discretion to cancel, terminate, modify or suspend the promotion.
22. The Promoter is not responsible for any incorrect or inaccurate information or for any fault in the equipment utilised in this Photo Competition which may result in error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.
23. The Promoter collects entrants personal information in order to conduct the promotion and award the prize winner and to conduct post event research. By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant. The information will be used for adding to the subscription databases of the Citys e-newsletters including Whats On, Live Green and Cycling in the City.
24. Entrants personal information may be disclosed to the relevant State lottery department and winners names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter. The winners personal details may be released to public enquiries under the Government Information (Public Access) Act 2009.
