Terms and Conditions

By entering the Celebrating Acts of Kindness with MYER “Game of Skill” promotion (the “Promotion”), you are agreeing
to the following terms and conditions:
1. STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry. Entry into the Promotion is deemed acceptance of
these conditions of entry.
2. WHO CAN ENTER?
2.1 Subject to clause 2.2, entry is open to all residents of Australia who are available to go shopping on Wednesday 21st December 2011 at a Myer near the winner’s home and be filmed at their home on Thursday 22nd December 2011 for a Segment that will air within Sunrise on Friday 23rd December 2011.

2.2 Employees and their immediate families of Seven Network (Operations) Limited, MYER Pty Ltd and their  associated agencies and companies are not eligible to enter.

2.3 All persons who enter must be over18 years of age.

3. HOW TO ENTER
3.1 The Promotion commences on Thursday, December 1 2011 at 05:59am (AEDST) and concludes on Monday
December 19 2011 at 09:00am (AEDST) (“the Promotion Period”)
3.2 To enter, individuals must watch the Channel Seven morning program, Sunrise within the Promotion Period where a promotion spot will run from time to time. The promotion spot will ask viewers to visit au.tv.yahoo.com/sunrise and complete the required entry fields and answer the promotion question which is “Tell us in 50 words or less what your recent Act of Kindness is that you have done for someone else ?”.

Entries will be judged on the unique level of kindness, creativity and originality.
3.3 Entrants may enter more than once Provided each entry complies with clause 3.2.
3.4 The entry must be:
(a) the original independent creation of the entrant; and
(b) free from any claims, including copyright or trademark claims, by other parties.

3.5 Entry details remain the property of the Promoter and will not be returned to the entrant. The winners agree to granting the Promoter a perpetual and non-exclusive licence to use their entries in all media worldwide and the winners will not be entitled to any fee for such use

3.65 For valid entry into the major prize draw (See Clause 5.1 for draw dates and times) entries made via email must be received by the Promoter as per the start and close dates in Clause 3.1.

3.76 All entries will be reviewed by the Promoter. The Promoter reserves the right not to upload an entry onto the promotional website, in its absolute discretion, if the entry does not comply with these Terms and Conditions.

3.87 Entry details remain the property of the Promoter and will not be returned to the entrant. Each winner grants the Promoter a perpetual and non-exclusive licence to use their entries in all media worldwide and the winners
will not be entitled to any fee for such use.

4. PRIZES
4.1 There will be one 1 major prize winner who will win the respective prize package as set out below:

4.3 The value of the prize is subject to change and is correct as at 29/11/2011

4.4 The major prize winner must be available for filming on Wednesday 21st and Thursday 22nd December of a segment that will air within the Sunrise program on Friday 23rd December 201. Total prize value for the Promotion is to a maximum of $5000 including GST AUD. Prize value is correct as at the date of printing. The Promoter accepts no responsibility for change in prize value between the dates.
4.5 The prize is non-transferable, non-refundable, and may not be redeemed for cash.
4.6 The winning Entrant should seek independent financial advice about any tax implications that may arise from the
prize winnings.
4.7 The major prize winner will be required to sign a liability waiver form to accept the prize.
4.8 Prize is subject to the standard terms and conditions of individual prize and service providers.
4.9 In participating in the prizes, the winners agree to participate and co-operate as required in all editorial activities
relating to the Promotion, including but not limited to being interviewed, filmed for broadcast, and photographed.
The winners (and their companions) agree to grant the Promoter a perpetual and non-exclusive licence to use
such footage and photographs in all media worldwide and the winners (and their companions) will not be entitled
to any fee for such use.

5. HOW TO WIN
There will be one 1 major prize winner. All entries will be judged at the promoters office at Media City, Level 6, 8 Central Avenue, Eveleigh NSW 2015 from the national pool of entries on Tuesday 20th of December 2011 at 1000amDRAFT MYER CHRISTMAS SUNRISE RAG Promotion 3 / 4 (AEST). The winner will be the entrant whose entry is judged by a panel of judges appointed by the Promoter to show the most unique level of kindness, creativity and originality.

5.1 from all entries received. The competition is a game of skill and chance plays no part in determining the winner.Winners will be notified by a phone call on the day of the judging, and a letter advising winners of their prize will also be express posted.

5.3 The judges’ decision (including any decisions as to prize distribution) is final and the Promoter will not enter into correspondence regarding the result.

5.4 It is a condition of accepting the prize that the winner (and any companions) must comply with all the conditions of use of the prize and prize supplier’s requirements.
5.5 It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion

6. NO LIABILITY
6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the
Promoter’s ability to proceed with the Promotion on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Promotion and recommence it from the start on the same conditions, subject to state government legislation.

6.2 Seven Network (Operations) Limited & affiliates, Dulux Group(Australia) Pty Ltd. and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.

6.3 Seven Network (Operations) Limited & affiliates, MNET Group Limited, Dulux Group (Australia) Pty Ltd. and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:
a) during the draw;
b) whilst undertaking any travel won on or connected with their entry into the Competition; or
c) in the participation in any prize;
d) as a consequence of late, lost or misdirected mail;
e) due to the broadcast of any program relating to the Promotion or the publication of any material,
including any statements made by any compere, staff member, journalist, other entrants or any other
person.
f) arising from or related to any problem or technical malfunction of any computer equipment, software,
internet connection, any injury or damage to entrant's or any other person's computer software related to or resulting from participation in this promotion.
