Information on how to bid, information on prizes and information on the free sample giveaway form part of these Terms and Conditions. Participating in this promotion is deemed acceptance of these Terms and Conditions.
Definitions: "Bid" means a Bid submitted by a specific Bidder in connection with the promotion; "Bidder" means an eligible person who has placed a specific Bid Amount for the Product; "Bid Amount" means a number from 1 to 1,000; "Lowest Unique Bid" means the lowest bid placed that is the only bid at that amount; "Product" means the product offered in connection with the promotion; "Successful Bidder" means the Bidder that is determined by the Promoter to have the right to receive the Product; and "Unique Bid" means a bid that is different from any other bid amount.
Promotion is only open to Australian residents aged 18 years and over. Employees (and the immediate family) of the Promoter and its agencies associated with this promotion are ineligible.

http://www.FreeSampleOffers.com.au and complete the official online bidding form, by submitting all requested information including their Bid Amount.
The Promoter reserves the right, at anytime during or after the closing date of the promotion, to verify the validity of Bids and to disqualify any Bidder who tampers with the Bid process or who submits a Bid that is not in accordance with these Terms and Conditions. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Only one Bid permitted per person.
No responsibility accepted for late, lost or misdirected bids.
Incomplete or indecipherable Bids will be deemed invalid.
All Bids are deemed to be received at the time of receipt into the FreeSampleOffers.com.au database and NOT at the time of transmission by the Bidder.
Promotion commences 1/10/2011. Promotion closes and all bids must be received by 11:59pm AEST/AEDST on 31/3/2012. The Successful Bidder will be notified by email. Promoter’s decision in relation to all matters pertaining to this promotion is final and no correspondence will be entered into.
The Successful Bidder will be the Bidder who submitted the Lowest Unique Bid. The Successful Bidder will have the right to receive the Product. The Product received is dependent on which Product the Successful Bidder submitted the Lowest Unique Bid for. The product can only be one (1) of the following:
- $300 worth of Arnott's products
- $300 worth of Coca-Cola products
- $300 worth of Nestlé products
The Successful Bidder will have 28 days from the date of being contacted by the Promoter to accept the Product. If the Successful Bidder fails to accept the Product within this period, then they will forfeit any right that they may have to the Product. If this occurs, then the Promoter reserves right, although under no obligation to do so, to offer the Product to the Bidder who submitted the next Lowest Unique Bid and they will have 14 days to accept the Product.
If after reasonable attempts the Successful Bidder is un-contactable, and does not contact the Promoter to accept the Product within 3 months of the closing date, then they will be deemed to have forfeited their right to the Product. The Promoter reserves the right to offer the Product to the next the Bidder who submitted the next Lowest Unique Bid and they will have 14 days to accept the Product.
If there is no Lowest Unique Bid, then the Promoter will select the lowest Bid Amount with the lowest number of Bids received for that amount. The Bidders who placed these Bids will be requested to provide an answer to a nominated question, which will then be judged by the judges’ appointed by the Promoter. For the removal of doubt, if there is no Lowest Unique Bid and two (2) Bidders each submitted a Bid of 2 and two (2) Bidders each submitted a Bid of 5, only the Bidders who submitted the 2 Bid will have their answers judged. All answers will be judged based on literary and creative merit. The Bidder who submitted the best answer, as determined by the judges’, will be deemed the Successful Bidder.
The Promoter reserves the right to conduct security verification checks at their absolute discretion. The Successful Bidder may be required to sign a declaration confirming their eligibility to accept the Product.
The Promoter reserves the right to cancel, terminate, modify or suspend the promotion, in the event of war, terrorism, state of emergency or disaster or any other reason beyond the control of the Promoter which affects the proper conduct of the Promotion.
The Promoter accepts no responsibility for any variation in the value of the Product.
Product must be taken as offered and is not transferable or exchangeable and cannot be redeemed for cash.
If for any reason this promotion is not capable of running as planned (including but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the Bid process, and, to terminate, modify or suspend the promotion.
The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, (including but not limited to) any injury or damage to participants or any other person’s computer related to or resulting from participation in or down-loading any materials in this promotion.
Any costs associated with accessing the promotional website is the Bidder’s responsibility and is dependent on the Internet service provider used. Any contact details entered incorrectly on the website shall be deemed invalid.
The use of any automated software or any other mechanical or electronic means that allows a bidder to automatically Bid repeatedly is prohibited and will render all bids submitted by that Bidder invalid.
The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, as a result of taking any Product, or arising in any way out of or in connection with the promotion, except for any liability which cannot be excluded by law. It is a condition of the promotion that the Successful Bidder must execute a Deed of Acknowledgment, Release and Indemnity ("Deed") in a form prescribed by the Promoter in order to receive the Product.
All Bids remain the property of the Promoter. The Promoter collects Bidders’ personal information in order to conduct the promotion. If the information requested is not provided, the bidder may not participate in the promotion. By participating in the promotion, unless otherwise advised, each Bidder also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the Bidder electronic messages. A request to access, update or correct any information should be directed to the Promoter at their address set out below.
To be part of the free sample giveaway, the individual must visit

A verification email is then sent to the individual. The individual has to verify their email address by clicking the confirmation within the verification email. Upon verification, another email is sent to the individual advising if they qualify to claim a free sample from the Promoter.
Every 7,000th individual to validate their email address qualifies for a free sample from the Promoter.
The individual that qualifies for the free sample will have 28 days from the date of being contacted by the Promoter to accept the free sample. If the individual fails to accept the free sample within this period, then they will forfeit any right that they have to the free sample. The Promoter takes no responsibility for the individual not receiving emails from the Promoter.
