Terms and Conditions

Wildfire Interactive, Inc. (“Wildfire,” “we” or “us”) provides this website (in these terms we call this site and any successor websites, and any software provided by Wildfire for use with the site, the “Site”) to you subject to these terms and conditions of use (“Terms” or “Agreement”). Please read these Terms carefully before using the Site. By accessing, using, or by merely browsing the Site you agree to be legally bound by these Terms and all terms, policies and guidelines incorporated by reference in these Terms. If you do not agree with these Terms in their entirety, you may not use the Site. In these Terms, our customers and any person to whom customers give access to their Wildfire account are called “Subscribers.” Wildfire customers offering promotions via the Site are called “Sponsors” and individuals who participate in promotions via the Site are called “Entrants.” In these Terms users of the Site, whether they are Subscribers, Sponsors, Entrants, members of the Wildfire forum, people who post comments on the Wildfire blog, or casual browsers of the Site, are called “Users.” This Site is not intended to be used by children. Users must be at least thirteen (13) years of age to use this Site. Subscribers and Sponsors must be at least eighteen (18) years of age to create a Wildfire account. Wildfire reserves the right to change or modify any of the terms and conditions contained in these Terms, or any policy or guideline of the Site, at any time and in its sole discretion. If we do so, we will notify you at the email address you provide in your registration information or by other means identified in these Terms. If you do not agree with the changes, you can cancel your account with us without further obligation, except any amount due if applicable. Unless otherwise specified, any changes or modifications will be effective immediately upon posting of the revisions on the Site, and your continued use of the Site after such time will constitute your acceptance of such changes or modifications. You should from time to time review the Terms and any policies and documents incorporated in them to understand the terms and conditions that apply to your use of the Site. The Terms will always show the ‘last updated’ date at the top. If you do not agree to any amended Terms, you must stop using the Site. 1. Privacy Policy

Please refer to the Wildfire Privacy Policy, available at http://www.wildfireapp.com/buzz/privacy_policy for information on how Wildfire collects, uses, and discloses personally identifiable information from its users. By using the Site you agree to our use, collection and disclosure of personally identifiable information in accordance with our Privacy Policy.
2. Registration Data; Account Security

If you register for an account on the Site, you agree to (a) provide accurate, current and complete information as may be prompted by any registration forms on the Site (“Registration Data”); (b) maintain the security of your password; (c) maintain and promptly update the Registration Data, and any other information you provide to Wildfire, and to keep Registration Data accurate, current and complete; and (d) accept all risks of unauthorized access to the Registration Data and any other information you provide to Wildfire. You are responsible for all activity on your Wildfire account, and for all charges incurred by your Wildfire account.
3. Fees; Charges; Taxes

Fees and any other charges for the use of the Site are described on the Site at: http://www.wildfireapp.com/pricing. Fees may change from time to time. If we change them, we will give you at least 30 days’ notice before implementing the change. If they do change, your continued use of the Site after the change indicates your agreement with the new fees and charges after the effective date of the change. Any change to fees and other charges will not be applicable to the billing period in which the change occurs. You are responsible for all taxes applicable to the fees, if any, in any applicable jurisdiction.

Fees paid to Wildfire for products and service offered on the Site, unless otherwise specified in writing, are non-refundable. If your use of the Site is terminated by us because of your breach of these Terms, we will retain fees and charges paid by you for your use of the Site. If we terminate your use of the Site for any reason other than your breach of these Terms, we will refund your subscription fee on a pro rata basis.
4. Ownership, Copyright and Trademarks

In these Terms the content on the Site, including all information, data, logos, marks, designs, graphics, pictures, sound files, other files, and their selection and arrangement, is called “Content.” Content provided by Users is called “User Content.” User Content remains the property of the User. Wildfire’s rights to User Content are limited to the limited licenses granted in Section 5 and Section 16 of these Terms. Other than User Content, the Site, all Content and all software available on the Site or used to create and operate the Site is the property of Wildfire or its licensors, and is protected by United States and international copyright and intellectual property laws, and all rights to the Site, the Content and software are expressly reserved. All trademarks, registered trademarks, product names and company names or logos mentioned in the Site are the property of their respective owners. Reference to any products, services, processes or other information, by trade name, trademark, manufacturer, supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation thereof by Wildfire. Wildfire collects certain information and data during the normal operation of the Site. The information and data collected through the operation of the Site is the property of Wildfire unless Wildfire has agreed to collect information and data on behalf of a Subscriber. Any agreement by Wildfire to collect information and data on behalf of a Subscriber must be memorialized in a Master Services Agreement. In the event of conflict or inconsistency between any of the provisions of this Agreement and the Master Services Agreement, the Master Services Agreement shall be given precedence. Your User Content is your responsibility. We have no responsibility or liability for it, or for any loss or damage your User Content may cause to you or other people. Although we have no obligation to do so, we have the absolute discretion to remove any User Content posted or stored on the Site, and we may do this at any time and for any reason. You are solely responsible for maintaining copies of and replacing any User Content you post or store on the Site.
5. Limited License of Your User Content to Wildfire

We do not claim any ownership interest in your User Content, but we do need the right to use your User Content to the extent necessary to operate the Site, and provide the services provided by the Site, now and in the future. For example, if a Subscriber requests that we collect certain information or data on its behalf, we require your permission and license to use the information or data in the operation of the Site. Also, if you post an image utilizing the promotion builder application, we need your license to display that User Content on the Site. Therefore, by posting or distributing User Content, or permitting the collection of information or data by Wildfire, you (a) grant Wildfire and its affiliates and subsidiaries a non-exclusive, royalty-free, transferable right to use, display, perform, reproduce, distribute, publish, modify, adapt, translate, and create derivative works from such User Content on the Site, in the manner in and for the purposes for which the Site uses such User Content; (b) represent and warrant that (i) you own and control all of the rights to the User Content, information and data that you post and permit us to collect, or you otherwise have the lawful right to collect, post and distribute that User Content, information and data to or through the Site; and (ii) the use and posting or other transmission of such User Content does not violate these Terms and will not violate any rights of or cause injury to any person or entity. If your User Content is intended for the use of other Users or third-parties, you also grant us and our affiliates and subsidiaries a non-exclusive, royalty-free, transferable right to sublicense such User Content to such Users or third-parties for their use in connection with their use of the Site, as described in this Section. These licenses from you are non-exclusive because you have the right to use your User Content elsewhere. They are royalty-free because we are not required to pay you for the use of your User Content on the Site. And they are transferable because we need the right to transfer these licenses to any successor operator of the Site. Our rights to “modify, adapt, translate, and create derivative works from” are necessary because the normal operation of the Site does this to your User Content when it processes it for use in the Site.
6. Our Limited License of Content to You

Wildfire grants you a limited, revocable, non-exclusive, license to access the Site and to view, copy and print the portions of the Content available to you on the Site. Such license is subject to these Terms, and specifically conditioned upon the following: (i) you may only view, copy and print such portions of the Content for your own use; (ii) you may not modify or otherwise make derivative works of the Site or the Content, or reproduce, distribute or display the Site or any Content (except for page caching) except as expressly permitted in these Terms; (iii) you may not remove or modify any copyright, trademark, or other proprietary notices that have been placed in the Content; (iv) you may not use any data mining, robots or similar data gathering or extraction methods; and (v) you may not use the Site or the Content other than for its intended purpose. Except as expressly permitted above, any use of any portion of the Content without the prior written permission of its owner is strictly prohibited and will terminate the license granted in this Section, this Agreement and your account with us. Any such unauthorized use may also violate applicable laws, including without limitation copyright and trademark laws. Unless explicitly stated herein, nothing in these Terms may be construed as conferring any license to intellectual property rights, whether by estoppel, implication or otherwise. The license in this Section is revocable by Wildfire at any time. You represent and warrant that your use of the Site and the Content will be consistent with this license and will not infringe or violate the rights of any other party or breach any contract or legal duty to any other parties, or violate any applicable law. To request permission for uses of Content not included in this license, you may contact Wildfire at the address identified at the bottom of these Terms.
7. Infringement Claims; Repeat Infringers

Wildfire will process and investigate proper notices of alleged copyright or other intellectual property infringement related to material on its websites or servers and will respond appropriately, following the guidelines of the Online Copyright Infringement Liability Limitation Act and other applicable intellectual property laws. Where appropriate, and regardless of the merits of the alleged infringement, our response may include removing or disabling access to material claimed to be the subject of infringing activity. If we remove or disable access in response to such a notice, we may notify the owner or administrator of the affected site or content so that he or she can make a counter notification. Wildfire will, following appropriate investigation, terminate or disable access by repeat infringers. Claims of alleged copyright or other intellectual property infringement must be in writing and directed to Wildfire's designated agent. Misrepresentations made in your notice regarding whether material or activity is infringing may expose you to liability for damages (including costs and attorneys' fees). Accordingly, if you are not sure whether material available online infringes your copyright, we suggest that you first contact an attorney.
8. Use of Interactive Areas and the Site

The Site may contain interactive areas including interactive advertising and promotion areas, discussion forums, bulletin boards, review services or other forums in which you or third-parties may post content, messages, reviews or other materials on the Site (“Interactive Areas”). You are solely responsible for your use of such Interactive Areas and use them at your own risk. User Content submitted to any public area of the Site will be considered non-confidential. By using any Interactive Areas, you expressly agree not to post, upload to, transmit, distribute, store, create or otherwise publish through the Site any of the following: 1. Any message, data, information, text, music, sound, photos, graphics, code or other material that is unlawful, libelous, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent or otherwise objectionable; 2. Content that would constitute, encourage or provide instructions for a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any local, state, national or international law; 3. Content that may infringe any patent, trademark, trade secret, copyright or other intellectual or proprietary right of any party; 4. Content that impersonates any person or entity or otherwise misrepresents your affiliation with a person or entity; 5. Unsolicited promotions, political campaigning, advertising or solicitations; 6. Private information of any third-party, including, without limitation, addresses, phone numbers, email addresses and credit card numbers, unless that third-party has expressly consented to such use; 7. Viruses, corrupted data or other harmful, disruptive or destructive files; 8. Promotion entries or Content that we know or suspect are fraudulent or otherwise violate these Terms, or violate the rules and policies supplied by the promotion Sponsor; 9. Content that is unrelated to the topic of the Interactive Area(s) in which such Content is posted; or 10. Content that, in the sole judgment of Wildfire, is objectionable or which restricts or inhibits any other person from using or enjoying the Interactive Areas or the Site, or which may expose Wildfire or its affiliates or its users to any harm or liability of any type. Wildfire has a “zero-tolerance” policy towards SPAM: you may not use the Interactive Areas or the Site generally to send commercial or other messages to any third-party if those messages are not solicited, authorized or welcomed by the third-party, and in your use of the Site you must comply with all applicable laws, including laws that apply in any jurisdiction to SPAM and marketing practices, and with any applicable marketing association guidelines on ethical marketing practices. Any use of the Interactive Areas or other portions of the Site in violation of the foregoing violates these Terms and may result in, among other things, termination or suspension of your rights to use the Interactive Areas and/or the Site.
9. Providing a Reliable and Secure Service

We take security seriously. We strive to maintain a reliable and secure environment for your data. However, no system is perfectly secure or reliable, the Internet is an inherently insecure medium, and the reliability of hosting services, Internet intermediaries, your Internet service provider, and other service providers cannot be assured. When you use the Site, you accept these risks, and the responsibility for choosing to use a technology that does not provide perfect security or reliability. In particular, Subscribers who choose to provide credit card information on this Site accept these risks to the security of that credit card information. Ultimately, credit card data is provided by Subscribers and Subscribers are responsible for its protection.
10. Links to Other Sites

The Site contains links to third-party Web sites (“Third-Party Sites”) and third-party content (“Third-Party Content”) as a service to those interested in this information. Third-Party Sites include social network platforms, Subscriber and Sponsor sites, payment processors and other payment intermediaries that you may use in connection with your use of the Site. You use links to Third-Party Sites, and any Third-Party Content or service provided there at your own risk. Wildfire does not monitor or have any control over, and makes no claim or representation regarding, Third-Party Content or Third-Party Sites. Wildfire provides these links only as a convenience, and a link to a Third-Party Site or Third-Party Content does not imply Wildfire's endorsement, adoption or sponsorship of, or affiliation with, such Third-Party Site or Third-Party Content. Wildfire accepts no responsibility for reviewing changes or updates to, or the quality, content, policies, nature or reliability of, Third-Party Content, Third-Party Sites, or Web sites linking to the Site. When you leave the Site, our terms and policies are no longer applicable. You should review applicable terms and policies, including privacy and data gathering practices, of any Third-Party Site, and should make whatever investigation you feel necessary or appropriate before proceeding with any transaction with any third-party.
11. Promotions and Media

Sponsors distribute promotions and other media utilizing tools offered on the Site and Entrants and Users may enter or engage with such promotions and media. If you are an Entrant or User, you acknowledge that Sponsors are responsible for promotions and media distributed through the site and for ensuring that such promotions and media comply with all applicable laws, rules, and regulations. If you enter a promotion, you should carefully review the Official Rules including any applicable privacy policy, these Terms, and any additional information or links provided in the Official Rules. You are required to agree to the Sponsor’s Official Rules including all linked terms, conditions, and policies before entering any promotion. You acknowledge that Wildfire is not responsible or liable for the failure of any Sponsor (or any third-party) to comply with the rules, terms, conditions, policies, and applicable laws, rules, or regulations governing any promotion. You acknowledge and agree that Wildfire does not sponsor, administer or endorse, and is therefore not liable for, the content of any promotion or media distributed through the Site. Sponsors may require you to provide personally identifiable information in order to participate in a certain promotions. In the event that you choose to provide personally identifiable information, you acknowledge and agree that Wildfire Interactive may use any information you provide consistent with Wildfire’s Privacy Policy and these Terms. You acknowledge and agree that Wildfire is not responsible or liable for Sponsor's use or distribution of information you provide. Please see each Sponsor's promotion rules and privacy policy for details on how each Sponsor uses your personal information. If you are a Sponsor, you acknowledge and agree that Wildfire merely facilitates the distribution of promotions and media and understand that the Site provides no safeguards ensuring that your promotions and media comply with any law, rule, regulation or policy. You also acknowledge and agree that you are responsible for ensuring that your promotion or media complies with any applicable law, rule, or regulation and agree to comply with all statements and promises made to Entrants or Users (except to the extent such statements and promises violate the law). You further agree to indemnify, defend and hold harmless Wildfire and its parent companies, affiliates, and subsidiaries; and their respective officers, directors, employees, consultants, agents, representatives, professional advisors, and contractors from any and all claims, losses, liability, damages and/or costs (including attorneys' fees and costs) arising from your use of the Service. Your indemnification includes, without limitation, all claims related to the posting or removal of Content, User Content, or entries to or from the Site. Wildfire Interactive will notify you promptly of any such claim, loss, liability, or demand, and will provide you with reasonable assistance, at your expense, in defending any such claim, loss, liability, damage or cost.
12. Warranty Disclaimer

THE SITE, THE CONTENT AND THE SERVICES PROVIDED BY THE SITE ARE PROVIDED TO YOU ON AN “AS IS” BASIS WITHOUT WARRANTIES FROM WILDFIRE OF ANY KIND, EITHER EXPRESS OR IMPLIED. WILDFIRE EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WILDFIRE DOES NOT REPRESENT OR WARRANT THAT CONTENT IS ACCURATE, COMPLETE, RELIABLE, CURRENT OR ERROR-FREE, AND EXPRESSLY DISCLAIMS ANY WARRANTY OR REPRESENTATION AS TO THE ACCURACY OR PROPRIETARY CHARACTER OF THE SITE, THE CONTENT OR ANY PORTION THEREOF. While Wildfire attempts to make your access to and use of the Site safe, Wildfire does not represent or warrant that the Site or any Content are free of viruses or other harmful components.
13. Limitation of Liability; Indemnity

Nothing in these Terms shall limit our liability in any claim for fraud or fraudulent misrepresentation. You irrevocably waive all rights to seek injunctive or other equitable relief, or to enjoin or restrain the operation of the Site, exploitation of any advertising or other materials distributed in connection therewith, or exploitation of the Site or any content or other material used or displayed through the Site and agree to limit your claims to claims for monetary damages within the limits identified in this Agreement. You shall defend, indemnify and hold harmless Wildfire and the other Released Parties from any loss, damages, liabilities, costs, expenses, claims and proceedings arising out of your use of the Site, and if you are a Subscriber or Sponsor, from your Agent(s)’ use of the Site and from the use of the Site by any person to whom you give access to your account (such as staff), including any User Content that infringes the rights of any third-party, including the intellectual property rights, of any third-party.
14. Communications

Notices that we give you may be provided in any of the following ways. First, we may email you at the contact information you provide in your Registration Data. Second, we may post a notice to Subscribers and Collaborators in the dashboard area of their respective accounts on the Site. Third, we may post the notice at the point of entry of any promotion. Fourth, we may post the notice elsewhere on the Site. When we post notices on the Site, we post them in the area of the Site suitable to the notice. It is your responsibility to periodically review the Site for notices. Subject to the Privacy Policy, if you send to Wildfire, or post on the Site in any public area, any information, idea, invention, concept, technique or know-how (“User Submissions”), for any purpose, including the development, manufacturing and/or marketing of products or services incorporating such information, you acknowledge that Wildfire can use the User Submissions without acknowledgement or compensation to you, and you waive any claim of ownership or compensation or other rights you may have in relation to the User Submissions. We actively review User Submissions for new ideas. If you wish to preserve any interest you might have in your User Submissions, you should not post them to the Site or send them to us.
15. Applicable Law and Venue

PLEASE NOTE: This Agreement requires the use of arbitration on an individual basis to resolve disputes, rather than jury trials or class actions, and also limits the remedies available to you in the event of a dispute. The Site is controlled by Wildfire Interactive, Inc. and operated from its offices in Redwood City, California. You and Wildfire both benefit from establishing a predictable legal environment in regard to the Site. Therefore, you and Wildfire explicitly agree that all disputes, claims or other matters arising from or relating to your use of the Site will be governed by the laws of the State of California and the federal laws applicable therein. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms. Except where prohibited by applicable law, any claim, dispute or controversy arising out of or relating to these Terms; (b) the Site or Content; (c) oral or written statements, advertisements or promotions relating to these Terms or to the Site; or (d) the relationships that result from these Terms or the Site or Content (collectively, a “Claim”) will be referred to and determined by a sole arbitrator (to the exclusion of the courts). This agreement to arbitrate is intended to be broadly interpreted. It includes, but is not limited to: (1) claims arising out of or relating to any aspect of the relationship between us, whether based in contract, tort, statute, fraud, misrepresentation or any other legal theory; (2) claims that arose before this or any prior Agreement (including, but not limited to, claims relating to promotions or advertising); (3) claims that are currently the subject of purported class action litigation in which you are not a member of a certified class; and (4) claims that may arise after the termination of this Agreement. You waive any right you may have to commence or participate in any class action against Wildfire related to any Claim and, where applicable, you also agree to opt out of any class proceedings against Wildfire. If you have a Claim, you should give written notice to arbitrate at the address specified in Section 19. If we have a Claim, we will give you notice to arbitrate at your address provided in your Registration Data. Arbitration will be conducted by one arbitrator pursuant to the rules of the American Arbitration Association in effect on the date of the notice in the city of San Francisco, California. To the extent arbitration as described in the immediately preceding paragraph is prohibited by applicable law, you agree that all Claims will be heard and resolved in a court of competent subject matter jurisdiction located in San Francisco, California. You consent to the personal jurisdiction of such courts over you, stipulate to the fairness and convenience of proceeding in such courts, and covenant not to assert any objection to proceeding in such courts. If you choose to access the Site from locations other than California, you will be responsible for compliance with all local laws of such other jurisdiction and you agree to indemnify Wildfire and the other Released Parties for your failure to comply with any such laws.
16. Termination/Modification of License and Site Offerings

Notwithstanding any provision of these Terms, Wildfire reserves the right, without notice and in its sole discretion, without any notice or liability to you, to (a) terminate your license to use the Site, or any portion thereof; (b) block or prevent your future access to and use of all or any portion of the Site or Content; (c) change, suspend or discontinue any aspect of the Site or Content; and (d) impose limits on the Site or Content.

17. Inactive Accounts; Termination of Agreement

You and Wildfire may terminate these Terms and your use of the Site at any time. If you terminate your use of the Site, and if applicable, you must pay the fees applicable for the balance of the then current billing period (if your billing period is monthly, we will prorate your account to the nearest month-end after termination). When your Wildfire account is terminated, your User Content will, shortly thereafter, not appear on the Site, except for User Content submitted to our blog, which may remain on the Site after termination. You acknowledge and agree that Wildfire has no obligation to migrate or provide assistance in migration of data from the Site. Notwithstanding the foregoing, Wildfire support may help Users with the transfer of any stored data upon request. After thirty (30) days from the date of termination, Wildfire takes no responsibility for stored data and reserves the right to delete all remaining data. If these Terms expire or terminate for any reason, Sections 4, 9, 12, 13, 15, 17 and 18, and any representation or warranty you make in these Terms, shall survive indefinitely.
18. Miscellaneous

If any provision of these Terms shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions. Wildfire may assign any or all of its rights hereunder to any party without your consent. You are not permitted to assign any of your rights or obligations hereunder without the prior written consent of Wildfire, and any such attempted assignment will be void and unenforceable. These Terms constitute the entire agreement between you and Wildfire regarding your use of the Site, and supersede all prior or contemporaneous communications whether electronic, oral or written between you and Wildfire regarding your use of the Site. The section titles in these Terms are for convenience only and have no legal or contractual effect. If a court of competent jurisdiction determines that any provision of these Terms is invalid, unlawful, void or unenforceable, that provision shall be modified or severed to the maximum extent permitted by law; however, any and all other provisions shall remain valid and be given full force and effect in a valid and enforceable manner to accomplish the purposes of these Terms.

Personal Information Collected

We collect information from you in various ways when you use our Sites and Applications. We may collect personal information you directly provide on our Sites. In addition, we may collect personal information from you as a user of our Applications. Information we may collect includes name and email address, and phone number.

In addition, when you visit our Sites some information may be automatically collected. For example, it is standard for your Web browser to automatically send information to every Web site you visit including ours. That information includes your computer's Internet Protocol (IP) address, access times, browser type and language, and referring Web site addresses. We may also collect information about your computer's operating system and information about your usage and activity on our Sites. We use this information, which does not identify individual users, to analyze trends, to administer the site, to track users’ movements around the site and to gather demographic information about our user-base as a whole.

We may automatically collect certain information through the use of "cookies." Cookies are small data files that are stored on your hard drive by a Web site. Among other things, the use of cookies helps us to improve our Sites and your experience. We use cookies to see which areas and features are most popular, to count the number of computers accessing our Sites, to personalize your experience, and to remember your preferences.

We link the information we store in cookies to any personally identifiable information you submit while on our site. If your browser is set not to accept cookies or if you reject a cookie, you may not be able to access certain features or services of our Sites. The use of cookies by our service providers is not covered by our privacy statement. We do not have access or control over these cookies. Our service providers use session ID cookies to collect data in order to enable us to provide a better user experience.
Web Beacons

We and our third party partners use Web beacons that help us better manage content on our site by informing us what content is effective. Web beacons, also known as gifs, are electronic images that may be used on our Sites or in our emails. A Web beacon may be used on our Web pages to collect information, deliver cookies, count visits, understand usage and campaign effectiveness, or in our emails to tell if an email has been opened and acted upon.
Use Of Personal Information We Collect

We use your personal information to provide you with services, to operate and improve our Sites and Applications, to send you messages, and for other purposes described in this Policy or disclosed to you on our Sites or in connection with our services. For example, we may use the information we collect from you on our Sites and Applications:

    to register for an account with us to build an application;
    to apply to become a partner;
    to personalize and improve your experience on our Sites and with our Applications;
    to respond to comments and questions and provide customer service;
    to deliver service messages and other services and content you request and to send information related to accounts and services, including confirmations, invoices, technical notices, updates, security alerts, and support and administrative messages;
    to send you information about new promotions, products, and services offered by Wildfire and our selected partners; and
    to conduct an aggregated analysis of the performance of promotions.

Wildfire may store and process personal information in the United States and other countries.
Sharing Of Personal Information

We use third parties such as a credit card processing company to bill you for services, an email service provider to send out emails on our behalf, a company to provide our forums and an employment resources company to process your job applications. When you sign up for our services, we will share the personal information you provide only as necessary for the third party to provide that service.

Unless you opt for our white label campaign option or you are a Qualified Partner, Wildfire will co-own data that may include your name, email address, phone number and birth date. If we co-own your personal data all campaign entry forms will have a Wildfire mailing list Opt-In. We may use aggregate data collected for internal analysis purposes.

We do not share your personal information with third parties other than as described above and as follows:

    with third party vendors, consultants and other service providers ("Service Providers") who are working on our behalf and need access to your information to carry out their work for us;
    to (a) comply with laws or respond to lawful requests and legal process, (b) to protect the rights and property of Wildfire, our agents, members, and others including to enforce our agreements, policies and terms of use, or (c) in the good faith belief that disclosure is needed to respond to an emergency or protect the personal safety of any person; and
    in connection with any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company. In any such event, we will provide notice if your data is transferred and becomes subject to a different privacy policy.

SECURITY OF YOUR PERSONAL INFORMATION

The security of your personal information is important to us. When you enter sensitive information (such as credit card number) on our registration or order forms, we encrypt that information using secure socket layer technology (SSL).

Wildfire takes reasonable security measures to protect your personal information to prevent loss, misuse, unauthorized access, disclosure, alteration, and destruction. Please be aware, however, that despite our efforts, no security measures are impenetrable.

If you use a password on our Site, you are responsible for keeping it confidential. Do not share it with any other person. If you believe your password has been misused, please advise us immediately.
Choices About Use Of Your Information

You may "opt-out" of receiving promotional emails from Wildfire by following the instructions in those emails. You may also send requests relating to promotional messages and your permission for sharing information with third parties for their marketing purposes by emailing privacy@WildfireApp.com. Opt-out requests will not apply to transactional service messages, including messages about your current Wildfire account and services.

You may also choose to remove the Application from your Facebook account by clicking on "Settings" in the toolbar and selecting "Application Settings" from the drop-down menu. Click the "x" next to the Application's name, then click "remove" again to confirm the deletion.
Updating And Accessing Your Personal Information

If your personal information changes, we invite you to correct or update your information as soon as possible. You can request changes or access to your information by emailing privacy@WildfireApp.com.

We will retain your information for as long as your account is active or as needed to provide you services. If you wish to cancel your account, request that we no longer use your information to provide you services or delete your personal information, contact us at privacy@WildfireApp.com. We will respond to your request to have your personal information deleted within 30 days. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
Links To Other Sites

Our Site includes links to other Web sites whose privacy practices may differ from those of Wildfire. If you submit personal information to any of those sites, your information is governed by their privacy statements. We encourage you to carefully read the privacy statement of any Web site you visit.
Forward To A Friend

If you choose to use our referral service to forward one of our newsletters to a friend, we will ask you for your friend’s name and email address. We will automatically forward your friend the email as requested by you. Wildfire stores this information for the sole purpose of sending this one-time email and your friend's email address will only be used to forward this email to them, and will never be available to anyone else. If you wish to request that your personal information no longer be used to receive these emails you may opt out of receiving these emails by clicking the unsubscribe link at the bottom of the email.
Testimonials

We post customer testimonials on our web site which may contain personally identifiable information. We do obtain the customer's consent via email prior to posting the testimonial to post their name along with their testimonial. If you wish to request that your testimonial be removed you may do so by emailing us at privacy@WildfireApp.com.
Public Forums

Our Web site offers publicly accessible blogs or community forums. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. To request removal of your personal information from our blog or community forum, contact us at privacy@WildfireApp.com. In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why.
Changes To This Policy

Wildfire may change this Policy from time to time. If we make any changes to this Policy, we will change the "Last Updated" date above. If there are material changes to this policy, we will notify you by email (sent to the e-mail address specified in your account). We encourage you to review this Policy whenever you visit our Sites or use our Applications to understand how your personal information is used.
