2012 Future Music Festival Ticket Giveaway - TERMS AND CONDITIONS
Acceptance of conditions

1.  Information regarding prizes and how to enter forms part of these conditions.  By entering, entrants accept these conditions.
Restrictions on entry

2.  Entry is open only to Australian residents aged 18 or over, except directors, management and employees (and the immediate families of directors, management and employees) of the Promoter (and its related corporations) or of the agencies or companies associated with this competition.
Duration of competition

3.  The competition begins at 12:00am AEDT on Monday 13th February 2012 and closes at 4.00pm AEDT on Friday 24thFebruary 2012, excluding Saturday 18th February 2012 and Sunday 19th February 2012 (Competition Period).
Method of Entry

4.  To enter, entrants must, during the Competition Period, visit http://www.facebook.com/mazdaaus and fully complete and submit the online entry form including by answering the following question:

“What futuristic feature would you give the Mazda2?”


5.  Entries must be received during the Competition Period.

6.  Entrants may only enter this competition once each.

7.  Entrants are responsible for their own costs associated with accessing the Internet.  Entries are deemed to be received at the time of receipt into the Promoter’s database, not time of transmission by an entrant.  Entrants who enter using multiple aliases/email addresses may be disqualified.  The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration,  tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise.  The Promoter has no control over mobile telephone communications, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise.  The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. 

8.  This competition is in no way sponsored, endorsed or administered by, or associated with, Facebook.  Entrants are providing their information to the Promoter and not to Facebook.  Each entrant completely releases Facebook from any and all liability.
Judging of entries

9.  Entries not fully complying with these conditions of entry may be deemed invalid at the Promoter’s discretion.  This is a game of skill; chance plays no part in determining the winners. Each valid entry will be individually judged (by representatives of the Promoter) based on, among other things, literary and creative merit.  The judges' decisions are final and no correspondence will be entered into.
Intellectual property

10.  All entries become the property of the Promoter and will not be returned to the entrant.  Each  ”Futuristic Feature” must be the entrant’s original work.  By entering this competition entrants:

(a)    consent to the Promoter editing, making and publishing copies of the whole or any part of their entry (including the ”futuristic feature”) and otherwise exploiting the entry and any rights in relation to the entry, to publicise this competition or for any other purposes; and

(b)    undertake to the Promoter that their entry is not, and its use by the Promoter will not be, in breach of any third party intellectual property rights.
Prize details

11.  Entries will be divided into state groups based on the residential location of each entrant.  The state groups will be: NSW/ACT, VIC/TAS, SA/NT, QLD and WA (State Groups).

12.  There are 40 double passes to the 2012 Future Music Festival to be won
Judging will be conducted on a daily basis at 4.30pm (AEDT) from 13/02/12 to 24/02/12 excluding 18/02/12 and 19/02/12.  Each judging day, the four most creative “futuristic features” from all entries received during the Competition Period up to 4.00pm (AEDT) on the relevant judging day as judged by the Judges in accordance with paragraph 9 will each win a double pass to the 2012 Future Music Festival.  The total number of winners for each State Group will correspond with the number of prizes given away for that State Group as set out below.  Any entries received for a State Group once its maximum number of prizes has been awarded will be deemed invalid, will be discarded and further entries will be judged for the remaining State Groups until each State Group has reached its maximum number of prizes to be given away.  No substitute prize or compensation will be awarded to State Group entrants who are not judged a winner or whose entries are received after the relevant State Group has reached its maximum number of prizes to be given away.  Each State Group will have the following number of prizes to give away:
•    QLD:  Future Music Festival Brisbane Saturday 3rd March - 9 double passes
•    WA:  Future Music Festival Perth Sunday 4th March - 8 double passes
•    NSW/ACT:  Future Music Festival Sydney Saturday 10th March - 13 double passes
•    VIC/TAS:  Future Music Festival Melbourne Sunday 11th March - 12 double passes
•    SA/NT:  Future Music Festival Adelaide Monday 12th March - 8 double passes


13.  No travel costs or expenses are covered in the prize; entrants must cover their own costs in traveling to and attending The Future Music Festival.

14.  Each prize is valued at approximately $300.00 (inc GST) and the total prize pool is $12,000 (inc GST).

15.  All passes are subject to the terms and conditions as imposed by the supplier of the passes.

Publicity

16.  The winners must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and the Promoter may use their name and image in promotional material.
Notification of winners

17. The winners will be notified by email and posted on facebook.
Awarding prizes

18. The Promoter may require winners to provide proof of identity, proof of residency and proof of age. Identification considered suitable for verification is at the Promoter’s discretion.
Disqualification of entries

19. The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
Changes in prize value

20.  Prizes are not transferable or exchangeable and cannot be redeemed for cash.  In the event for any reason a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be supplied in lieu of that element of the prize.  The Promoter accepts no responsibility for any variation in prize value.  Where a prize is unavailable for any reason, the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter.
Unclaimed prizes

21.  Each prize must be claimed by Monday 27th February 2011. If a prize remains unclaimed by that date, that winner’s entry will be deemed invalid and the Promoter reserves the right to distribute the prize to the next best valid entry that has not already received a prize.

22.  The entrant acknowledges that this timeline is crucial to ensure that tickets and attendance lists can be finalized before the event.
Risky prizes

23.  Entrants acknowledge that there are inherent risks in some of the aspects of the prize and using the prize involves participating in dangerous activities.  By entering this competition and accepting the prize, entrants accept that risk.

Exclusion of liability

24.  The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this  competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

25.  Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage in transit to prizes.

26.  All entrants, as a condition of participation in this Promotion, agree to release the Promoter from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with: (a) accessing the promotion; (b) submitting an entry or participating in the promotion; (c) the receipt, ownership or use of any prize awarded; (d) any download; (e) while preparing for, participating in or travelling to or from any prize-related activity; or (f) any typographical or other error in these terms and conditions or the announcement or offering of any prize.

Problems affecting competition

27.  If for any reason the 2012 Future Music Festival is cancelled, abandoned or postponed, the Promoter may, in its sole discretion, terminate, modify or suspend the completion or the awarding of the Prizes or offer alternative prizes of equal or greater value.

28.  If for any reason any aspect of this competition is not capable of running as planned, including by reason of infection by computer virus, mobile network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries.

Tax statement

29.  The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings.  Independent financial advice should be sought.  Where the operation of this competition results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values

Privacy statement

30.  All entries will be the property of the Promoter.  The information entrants provide will be used by the Promoter for the purpose of conducting this competition.  The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants.  The Promoter is bound by the National Privacy Principles in the Privacy Act 1988.  Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter at the below address.

31.  By entering this competition, the entrant consents to the storage of their personal information on the Promoter’s database and the Promoter may use this information for future promotional and marketing purposes regarding the Promoter’s products including contacting the entrant via electronic messaging. The Promoter may disclose personal information to contractors (such as mailing houses and IT providers) who require access to that information to perform services for the Promoter.
