Terms and conditions
1 Information regarding prizes and how to enter forms part of these conditions. By entering, entrants accept these conditions.
2 Entry is open only to Australian residents except directors, management and employees (and the immediate families of directors, management and employees) of the Promoter or of the agencies or companies associated with this competition.
3 The competition begins at 9.00am (AEDT) on 10/02/12 and
closes at 5.00pm (AEST) on 09/04/12 (Competition Period).
4 To enter, entrants must, during the Competition Period:
(a) visit the Garnier Australia Facebook page at
www.facebook.com/garnieraustralia;(b) follow the links to the “Competitions” tab on the Garnier Australia Facebook page; and
(c) fully complete and submit their online entry, including by providing their email address, contact number and any additional information as required by the Promoter and by
describing in 25 words or less how the entrant pledges to love their beach.
5 Entrants are responsible for their own costs associated with accessing the Internet.
6 Each entrant will receive a return online notification confirming their successful entry into the competition. By entering this competition, entrants consent to receiving this electronic message. Entrants may only enter this competition once. Entries must be received by the Promoter during the Competition Period. Errors and omissions excepted at the Promoter’s discretion. Entries are deemed to be received at the time of receipt into the Promoter’s database not at the time of transmission by the entrant. Entrants who enter using multiple email addresses and/or aliases may be disqualified.
7 The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over telephone communications, the Internet, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.
8 Entries not fully complying with these conditions of entry may be deemed invalid at the Promoter’s discretion. This is a game of skill; chance plays no part in determining the winner. Each valid entry will be individually judged (by representatives of the Promoter) based on, among other things, literary and creative merit. The judges' decisions are final and no correspondence will be entered into.
9 All entries become the property of the Promoter and will not be returned to the entrant. Each “25 words or less” answer must be the entrant’s original work. By entering this competition entrants:
(a) acknowledge that the Promoter may place the entrant’s entry (including their “25 words or less” answer) onto the Garnier Facebook page (along with the entrant’s Facebook name and profile picture);
(b) consent to the Promoter making copies of or publishing the whole or any part of their entry (including the “25 words or less” answer) and otherwise exploiting the entry and any rights in relation to the entry, to publicise this competition or for any other purposes;
(c) permit the Promoter to edit, adapt and alter their entry (including their “25 words or less” answer) for inclusion on the Garnier Facebook page;
(d) undertake to the Promoter that their entry is not, and its use by the Promoter will not be, in breach of any intellectual property rights (including copyright or moral rights) of any third party; and
(e) undertake that their entries do not include any content that contravenes any law, infringes the rights of any third party, is obscene, offensive, discriminatory, indecent, otherwise objectionable or inappropriate or makes any improper or inappropriate invasion of the privacy of any person. Without limitation, entrants must not include any content that involves malice or which may be defamatory or in contempt of court.
10 The best valid entry, as determined by the judges, will win the prize.
The prize is $5,000 (inc. GST) cash awarded by EFT. At the Promoter’s request, the winner will be required to provide the Promoter with verification of their bank account details into which the prize will be deposited, in the form required by the Promoter. The next 20 best valid entries who have not already won a prize will each receive a Garnier prize package consisting of various Garnier products (as selected by the Promoter) valued at $100 (inc GST) each. The total prize pool is valued at $7,000 (inc GST). 11 The winner will be notified by phone and in writing on 23/04/12 and their name and state/territory of residence will be published on the Garnier Australia Facebook page. By entering this competition, each entrant requests that his or her full address not be published.
12 The prize must be claimed by 16/05/12. If the prize remains unclaimed by that date, that winner’s entry will be deemed invalid and the Promoter reserves the right to distribute the prize to the next best valid entry.
13 If the winner of the prize is under the age of 18 years at the date the winner is determined, the prize will be awarded to the winner’s parent or guardian.
14 Unless expressly stated otherwise by the Promoter, inclusion of an entrant’s entry (including their “25 words or less” answer) on the Garnier Facebook page in no way represents the quality of the entrants entry or that the entrant is, or will be, the prize winner.
15 The winner must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their name and image in promotional material.
16 The Promoter may require the winner to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter’s discretion.
17 The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
18 Prizes are not transferable or exchangeable. Where a prize is unavailable for any reason, the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter.
19 The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
20 This competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants are providing their information to the Promoter and not to Facebook. Each entrant completely releases Facebook from any and all liability.
21 If for any reason any aspect of this competition is not capable of running as planned, including, but not limited to, by reason of computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries.
22 The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Where the operation of this competition results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
23 The information entrants provide will be used by the Promoter for the purpose of conducting this competition. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. If the entrant has marked the “opt-in” box on the entry form, the entrant consents to the storage of their personal information on the Promoter’s database and the Promoter may use this information for future promotional and marketing purposes regarding the Promoter’s products including contacting the entrant via electronic messaging. By entering this competition entrants also consent to the Promoter providing their information to the Surfrider Australia Foundation and to receiving communications directly from the Surfrider Australia Foundation. http://www.surfrider.org.au/about-us/privacypolicy/. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter at the address below.
