The promoter is Australian Associated Motor Insurers Limited (AAMI) ABN 92 004 791 744, AFS Licence Number 238173, Level 11, 447 Collins St, Melbourne Vic 3000.
Information on how to enter the AAMI Travel Promotion 2012 (Promotion) and prizes form part of these Conditions of Entry. Entry into the Promotion is deemed acceptance of these Conditions of Entry. Entry is via Internet only.
Entry is only open to residents of Australia aged 18 years or older (inclusive) (Eligible Entrants).
Directors, management and employees of AAMI and its related entities (and their immediate families), printers, suppliers, providers and agencies associated with this Promotion are ineligible to enter the Promotion.
Promotion commences at 12:01 am (AEDT) on 13/02/2012 and
closes at 11:59 pm (AEDT) on 13/03/2012 (Promotional Period). The draw will take place at midday (AEDT) on 16/03/2012 at Contact Management Associates (VIC) Pty Ltd, 92-94 Tope St, South Melbourne VIC 3205. The winner will be notified by telephone and in writing to their nominated email address and not via Facebook. The winner's name and locality will also be published in The Australian on 21/03/2012. AAMI's decision is final and no correspondence will be entered into.
To enter the Promotion and become an Entrant, Eligible Entrants must, during the Promotional Period, either:
log on to
www.luckyaami.com.au (Promotional Website) and fully and correctly complete and successfully submit the online entry form, including providing the Entrant's full name, postcode and current and valid email address; or
log on to AAMI's Facebook page (Travel Facebook App) and "like" the Travel Facebook App, select the "Allow" button and provide the Facebook permissions as requested, and fully and correctly complete and successfully submit the Facebook entry form, including providing the Entrant's full name, postcode and current and valid email address.
for doing either of which an Eligible Entrant will receive one (1) entry.
Entrants may invite friends or relatives to enter the Promotion in two ways. To do so, Entrants must either:
if they have entered the Promotion pursuant to Condition 6 A), submit their friends' or relatives' names and email addresses (and any other required information) in the manner required and where indicated when submitting the online luckyaami entry form. Entrants who invite friends or relatives to enter the Promotion in this manner will gain one (1) additional entry into the Promotion for each friend/relative they invite in the required manner up to a maximum of five (5) additional entries. The operation of the referral mechanic referred to above is subject to the Spam Act 2003 (Cth). Each Entrant warrants that any and each friend or relative that they nominate is known to them personally and that such persons have consented to receiving commercial electronic messages; or
alternatively, Entrants entering the Promotion pursuant to Condition 6 B) may share the Promotion with their friends on Facebook by selecting the "Book seats for friends" option in the Travel Facebook App and tagging those friends. Entrants who invite friends or relatives to enter the Promotion in this manner will gain one (1) additional entry into the Promotion for each friend/relative they share the Promotion with. There is no limit to the number of entries an Entrant can obtain by referring in this manner. This referral mechanism is subject to Facebook's Privacy Policy. Each Entrant warrants that each person they tag is known to them personally and that they have permission to tag such person.
An Entrant may refer a particular friend or relative only once during the Promotional Period and Entrants who have already entered the Promotion cannot be referred as friends or relatives by a subsequent Entrant. Each Entrant's relative or friend nominated must be an Australian resident and be aged 18 years or older.
The use of any automated entry software or any mechanical, electronic or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.
AAMI reserves the right to verify the validity of any and all entries and reserves the right to disqualify any Entrant for: (a) tampering with the entry process; (b) submitting an entry which is not in accordance with these Conditions of Entry; or (c) if the Entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. AAMI's legal rights to recover damages or other compensation from such an offender are reserved.
The first eligible entry randomly drawn from all entries received will win a $25,000 Mr & Mrs Smith (Asia Pacific) Pty Ltd ACN 134 136 128 (Mr & Mrs Smith) travel voucher (Travel Prize). The Travel Prize will be in the form of one (1) $25,000 voucher, will be issued in the winner's name and will be sent via secured post to the address nominated by the winner. The Travel Prize is subject to prevailing terms and conditions of use, including expiration dates (if any), and is not replaceable if lost.
Total maximum Travel Prize value is up to $25,000. The Travel Prize is not transferable or exchangeable and cannot be taken as cash (unless otherwise indicated). AAMI accepts no responsibility for any tax implications that may arise from the Travel Prize winnings. Independent financial advice should be sought. AAMI accepts no responsibility for any variation in Travel Prize value. The Travel Prize value is the recommended retail price including GST.
AAMI may conduct a further draw at the same time and place as the original draw as is necessary on directions given 18/06/2012 in order to award the Travel Prize if unclaimed by that date, subject to any written under applicable State or Territory legislation. In the event of any winner in the unclaimed prize draw, the winner will be notified by telephone and in writing to their nominated email address and not via Facebook. The name and locality of the winner will also be published in The Australian on 20/06/2012.
AAMI encourages consumers to enjoy alcohol in moderation. Legal aged consumers are advised to consider the 'low risk drinking' guideline recommended in the National Health & Medical Research Council Australian Alcohol Guidelines which states: for healthy men and women, drinking no more than two (2) standard drinks on any day reduces your risk of harm from alcohol-related disease or injury over a lifetime. Drinking no more than four (4) standard drinks on a single occasion reduces the risk of alcohol-related injury arising from that occasion.

AAMI and the Entrant acknowledge that:
the Entrant is providing their personal information to AAMI for the purposes of the Promotion and that their personal information is not being used in any way by Facebook nor being supplied by or to Facebook; and
the Promotion is not in any way sponsored, endorsed or administered by, or associated with Facebook.
Entrants can only enter in their own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the Promotion and all entries of an Entrant who is deemed by AAMI to have provided incorrect, misleading or fraudulent information may, at the discretion of AAMI, be deemed invalid. AAMI reserves the right to request the Entrant produce (within the requested time) appropriate photo identification or other documentation (to AAMI's satisfaction, at its sole discretion) in order to confirm the Entrant's identity, age, residential address, eligibility to enter and claim the Travel Prize, and any information submitted by the Entrant in entering the Promotion, before issuing the Travel Prize. If the documentation required by AAMI is not received by AAMI (or its nominated agent) or an Entrant or entry has not been verified or validated to AAMI's satisfaction then all the entries of that Entrant will be ineligible and deemed invalid.
The Travel Prize will only be awarded following any winner validation and verification that AAMI requires in its sole discretion.
Costs associated with accessing the Promotional Website or the Travel Facebook App remain an Entrant's responsibility and may vary depending on the Internet service provider used. Contact details entered incorrectly on the Promotional Website or the Travel Facebook App by an Entrant will deem an entry invalid.
Internet entries will be deemed accepted at the time of receipt by AAMI and not at the time of transmission. Entries received will be considered final by AAMI. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. AAMI accepts no responsibility for late, lost or misdirected entries.
Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Promotional Website or the Travel Facebook App or the information on the Promotional Website or the Travel Facebook App, or to otherwise undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and, should such an attempt be made, whether successful or not, AAMI reserves the right to seek damages to the fullest extent permitted by law. If AAMI suffers loss or incurs any costs in connection with any breach of these Conditions of Entry or any other legal obligation by an Entrant, the Entrant agrees to indemnify AAMI for those losses, damages and costs.
If the Travel Prize or element of the Travel Prize becomes unavailable, for any reason beyond AAMI's reasonable control, then a comparable prize or prize element of equal or greater value will be awarded in lieu, subject to any written directions made under applicable State or Territory legislation.
It is a condition of entering this Promotion that the Entrant fully releases Facebook from any liability or loss (including indirect or inconsequential loss) associated with the Promotion.
AAMI and its associated agencies and companies are not liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with taking the Travel Prize or using the Travel Prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). AAMI and its agents associated with this Promotion take no responsibility for the Travel Prize being damaged or lost in transit (if relevant).
AAMI and its associated agencies and companies are not responsible for any problems, delays or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a network or a mobile network or any combination thereof, or any other technical failures including any damage to the Entrant's or any other person's mobile handset, computer or peripherals related to, or resulting from, participation in this Promotion or the downloading of any materials related to this Promotion.
AAMI will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this Promotion if the deficiency is occasioned by any cause outside the reasonable control of AAMI including but without limitation technical malfunctions or failures.
If this Promotion is not capable of running as planned for any reason, including but not limited to war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, AAMI reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion and/or, if necessary, to provide an alternative prize to the same value as an original Travel Prize, subject to any written directions made under applicable State or Territory legislation.
As a condition of entering this Promotion, an Entrant consents to, in the event they are the winner, AAMI using the Entrant's name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the Promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by AAMI. The Entrant agrees that, in the event they are the winner, the Entrant will participate in all reasonable promoted activities in relation to the Promotion as requested by AAMI and its agents.
An entry and any copyright subsisting in an entry irrevocably becomes, at time of entry, the property of AAMI. AAMI collects personal information about an Entrant to include the Entrant in the Promotion and, where appropriate, award prizes. If the personal information requested is not provided, the Entrant cannot participate in the Promotion and is deemed ineligible. An Entrant also agrees that AAMI may, in the event the Entrant is the winner, publish or cause to be published the Entrant winner's name and locality in any media, as required under the relevant State or Territory lottery legislation. An Entrant can gain access to, update or correct any personal information held by AAMI by contacting AAMI's Privacy Officer by calling 13 22 44. All personal information will be stored at the office of AAMI. A copy of AAMI's Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting AAMI.
If an Entrant participates in the Promotion and also chooses to "opt-in" on the Promotional Website or the Travel Facebook App, the Entrant acknowledges that a further primary purpose for collection of the Entrant's personal information by AAMI is to enable AAMI to use the information to assist AAMI in improving goods and services and to contact the Entrant in the future with information on special offers or provide the Entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. AAMI may share information with its Australian related companies or promotional partners who may contact the Entrant with special offers in this way. By entering the Promotion and opting-in, an Entrant acknowledges and agrees that AAMI may use the Entrant's personal information in the manner set out in this condition.
