 The Townsville Bulletin is giving our home delivery customers the cahnce to win one of 10 double passes to the McDonalds Charters Towers Country Music Festival Saturday Night Spectacular on May 5, 2012.  For your chance to win simply fill in the entry form printined in the Townsville Bulletin and either post to Home Delivery Competition C/O Townsville Bulletin, PO Box 2030, Townsville QLD 4810 or delivery to 198-244 Ogden Street Townsville.

TOWNSVILLE BULLETIN

COMPETITION TERMS AND CONDITIONS

By entering the Charter Towers Country Music Festival Home Delivery Competition you are agreeing to the following terms and conditions. The North Queensland Newspaper Company Pty Ltd reserves the right, with or without cause, to exclude entrants and withhold prizes for violating any of these terms and conditions. The North Queensland Newspaper Company Pty Ltd reserves the right to amend these terms and conditions at any time. Any amendments to the terms and conditions will be published in the Townsville Bulletin.

For the purposes of these terms and conditions, the Promoter is The North Queensland Newspaper Company Pty Ltd, 198 Ogden Street Townsville QLD 4810. ABN:64 009 655 690.

1. WHO CAN ENTER

(a) This competition is open only to:

(i) Current home subscribers of the Townsville Bulletin;

(ii) persons aged 18 years or older; and

Proof of age and residency (eg. drivers licence) must be shown upon request.

(b) Employees, contractors and authorised agents of North Queensland Newspaper Company Pty Ltd, and their immediate families are not eligible to enter.

Immediate family means any of the following: spouse, de-facto spouse, child or step-child (whether natural or adopted), parent, step-parent, brother, sister, step-brother, step-sister.

2. HOW TO ENTER

(a) Complete the entry form in the Townsville Bulletin, and either post to Home Delivery Competition C/O Townsville Bulletin, PO Box 2030, Townsville QLD 4810 or deliver to 198-244 Ogden Street, Townsville 4810.

(b) The competition commences at 5am on Saturday, April 7, 2012 and closes at 10am on Wednesday, April 18, 2012.

(c) Entries that are illegible, received after the closing time or do not fulfil all the conditions of entry will not be accepted.

(d) Only original entry forms and coupons will be accepted, no photocopies.

(e) Should an entry form be drawn with two or more names the name that appears first on the entry will be deemed the winner.

(f) There is a limit of 200 entries per individual, family or syndicate. Individuals, families or syndicates lodging multiple entries must provide newsagent receipts for newspapers with their entries.

(g) Ownership (including intellectual property rights) in all entries (whether in written, audio or visual form, or a combination of those) is assigned to the Promoter upon submission of the entry and remains the property of the Promoter (subject to any limits contained in the Promoter’s Privacy Policy).

3. HOW TO WIN

(a) The winners will be drawn at 10.30am Wednesday, April 18, 2012.

(b) The winners will be announced in the Townsville Bulletin published on Thursday, April 19, 2012 and online at www.townsvillebulletin.com.au. The winners will also be notified by telephone within 7 days after the draw.

All reasonable endeavours will be made to contact the winners. If the winners cannot be contacted within 7 days after the draw, the Promoter reserves the right to re-draw winners from the entries which were received before the closing date for the competition.

(c) The judge’s decision is final and no correspondence will be entered into.

4. PRIZE

(a) The winners of the competition will each receive the following prize:
2 x tickets to the Charters Towers Country Music Festival, Saturday Night Spectacular on May 5, 2012.

Valued at $ 80.00

(b) The above mentioned values are for people living within the standard service area of Townsville. If the winner is located outside the standard service area of Townsville and because of the winner’s location, the costs of those items mentioned in clause 4(a) (including travel or delivery), increase, the winner will bear those additional costs;

If for whatever reason transportation and/or delivery cannot be arranged by the winner the Promoter is not required to provide a substitute prize to the competition winner.

(c) The full complement of the prize must be taken as offered and is not redeemable for cash or any other services.

(d) The prize will be forfeited if the winner does not redeem or take the prize at the time and place stipulated by the Promoter.

(e) In the event that any prize item is unavailable, the Promoter may, but is not required to, provide a substitute prize item of equal or greater value at the publishing date.

(f) Any taxes (other than GST, if any) which may be payable as a consequence of a winner receiving the prize, or any element of the prize, are the sole responsibility of the winner.

(g) The winner agrees not to sell or lease the prize, because profiteering from the prize, in part or full, is a breach of supply and action will be taken if misused.

(h) The winner consents to the use of his or her name, photograph and entry for promotional purposes.

(i) The winner’s participation in the prize is subject to the usual terms and conditions of The Charter Towers Country Music Festival:

(i) medical parameters;

(ii) ineligibility if under the influence of alcohol or other substances; and

(iii) inappropriate behaviour.

If the winner does not comply with the terms and conditions of The Townsville Civic Theatre and is therefore ineligible to redeem or take the prize, the prize will be forfeited and the Promoter is under no obligation to provide a substitute prize.

5. NO LIABILITY

(a) In the case of the intervention of an outside act, agent or event which prevents or hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, the Promoter may, in its absolute discretion, cancel the competition and, if appropriate, recommence it from the start on the same conditions.

(b) The Promoter does not exclude any rights and remedies in respect of goods or services under the Trade Practices Act 1975 (Cth) or equivalent State or Territory legislation which cannot be excluded, restricted or modified. However, the Promoter excludes all rights, remedies, conditions and warranties in respect of goods or services associated with entrants’ entry into this competition or the winner’s enjoyment of the prize whether based in statute, common law or otherwise to the fullest extent permitted by law.

(c) The Promoter is not responsible for prizes damaged or lost in transit, or late, lost or misdirected mail, except where the damage or loss is caused solely as a result of the fault of the Promoter.

(d) Entrants acknowledge and agree that:

(i) the prize, or elements of the prize, is inherently dangerous; and

(ii) participation in the prize is undertaken at the winner’s own risk; and

(iii) the Promoter is released, to the fullest extent permitted by law, from all liability for any loss, damage or injury suffered by the winner while participating in the prize.

The winner and any other participants in the prize, will be required to sign liability waivers and health disclosures prior to claiming the prize.

(e) To the fullest extent permitted by law, the Promoter is not liable for, and all entrants release the Promoter from any liability arising out of or in connection with, any loss, damage, injury, action or claim (including consequential loss) suffered or incurred by entrants and the winner which arises out of or in connection with:

(i) the competition draw;

(ii) any travel won on or connected with the prize or entry into the competition;

(iii) participation in the prize or any element of the prize; or

(iv) the publication or broadcast of any material or statement by the Promoter, any employee, contractor or agent of the Promoter or any other person.

6. PRIVACY

(a) By entering this competition, you agree that your details provided to the Promoter will be used by the Promoter and its related companies in accordance with its Privacy Policy. This Privacy Policy relates to the collection and use of personal information you may supply to the Promoter through your participation in the competition.

The Promoter reserves the right, at its discretion, to modify or remove portions of its Privacy Policy at any time.

The North Queensland Newspaper Company Pty Ltd (NQN) collects your personal information to assist us in providing the goods or services you have requested, to process your competition entries, and to improve our products and services. We or any of our Australian related companies may be in touch by any means (including email or SMS) to let you know about goods, services, or promotions which may be of interest to you. We may also share your information with other persons or entities who assist us in providing our services, running competitions or with other companies who provide prizes for competitions or reader offers.

NQN is part of a global media and entertainment company. We would like to share your information with these overseas-related companies so that they can contact you with special offers.
