1. Entry into this competition is deemed acceptance of these terms and conditions.
2. Entry is free and is open to
residents of Australia who are 15 years or over, and who are Facebook members. Entrants must be flybuys members or join flybuys within 10 days of competition ending. Entrants must be the primary flybuys cardholder. Prizes will be awarded to guardians of any winner less than 18 years of age. Employees and contractors of Promoter and its related companies are not eligible to enter.
3. Competition commences at 0.01am AEST on 23/04/2012 and
closes at 11.59pm on 27/04/2012. Daily prizes for each day will be awarded on the next day, and the grand prize will be awarded on 30/04/2012.
4. This is a game of skill and chance plays no part in determining the competition winner. The 4 daily prize winners and the one grand prize winner will be chosen by Promoter. The competition will run each day for five days.
5. To enter, participants must:
(a) Like the Coles Facebook page
(b) Enter the competition through the Facebook application by submitting a suggested name for the daily selection of flybuys my5 products. An individual can enter multiple times per day, but only their last submission will be accepted.
(c) The four winners for the day will be the four names for the daily selection of flybuys my5 products as chosen by the Promoter for that day. The grand prize winner will be the overall best name for the daily selection of flybuys my5 products over the five days.
6. Individuals may win more than one prize over the competition period, but can win no more than 2 times.
7. The grand prize will be one million flybuys points. The daily prize will be 50,000 flybuys points. There will be one grand prize and four daily prizes to be won each day. Total prize pool is valued at up to $15,000. 8. Winners will be notified by email. To claim the prize, the winner must contact the Promoter via email and confirm their entry. Winners can email
ColesFacebookCustomerFeedback@coles.com.au. If the winner does not contact the Promoter within 7 days of winning, the next placed entrant will be awarded the prize. The winner must have a registered flybuys card. If the winner does not have a registered flybuys card, they will have ten working days to register.
9. The judge’s decision is final and the Promoter reserves the right to verify the validity of entries and entrant, and to either allow or disallow any entrant for any reason it sees fit in its absolute discretion. Entries generated by script, macro, bot, or other automated means are not eligible to enter the competition.
10. The Promoter accepts no responsibility for any late or misdirected entries due to technical disruptions, network congestion or for any other reason.
11. Prize cannot be redeemed for cash and must be claimed using your flybuys card. Flybuys points will be credited to the winner’s flybuys account and redemption is subject to flybuys standard terms and conditions which are available at
www.flybuys.com.au.
12. Value of prizes is shown as a guide only and was correct at time of printing. The Promoter accepts no responsibility for any variation in the prize value.
13. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition entirely, or recommence it on similar conditions at a later date.
14. Entrants acknowledge that their Facebook profile photograph may be featured on the Application and/or any associated Facebook page for public viewing. Facebook membership and the use of Facebook generally are subject to the Facebook prevailing terms and conditions of use available at
www.facebook.com. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants are providing their information to the Promoter and not to Facebook. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the promotion, except for any liability which cannot be excluded by law.
15. The Promoter may remove any Content that does not comply with these Terms and Conditions and that the Promoter deems in its absolute discretion is not in the spirit of the competition. The Promoter reserves the right to disqualify any entrant who submits or uploads any material that does not comply with these Terms and Conditions.
16. The Promoter shall not be liable for any loss or damage whatsoever which is suffered or sustained (including but not limited to indirect or consequential loss, or for any personal injury) in connection with any entry into the Promotion or acceptance and use of any prize/s except for any liability, which cannot be excluded by law.
17. Entrants warrant and agree that:
a) they will not submit, produce, share or distribute any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 18 or otherwise unsuitable for publication;
b) they will obtain prior consent from any person in respect of that person or their property that appears in their Content;
c) they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein;
18. Winner’s names will be published on the Coles Facebook and Twitter page. If you are not willing for these uses or disclosures to occur you cannot participate in the Promotion. Promoter’s privacy policy can be viewed at
