2012 ABL & Delta Air Lines âMLB All-Star Gameâ Promotion Terms and Conditions of Entry
Promotion Terms & Conditions:
1.Information on how to enter, how to claim and details of prizes form part of these Terms and Conditions. Participation in this promotion constitutes acceptance of these Terms and Conditions.
2.Entry to the promotion is open to Australia residents who fulfil the entry requirements. Directors, management, employees, officers and contractors (and their immediate families) of the Promoter, of the MLB Entities or of the agencies or companies associated with this Promotion are ineligible. "Immediate families" means spouse, ex-spouse, de-facto spouse, parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, natural or adopted child, and sibling or step-sibling (whether natural or adopted by a parent), whether or not they live in the same household as the director, manager, employee, officer or contractor. The âMLB Entitiesâ shall mean the Office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P. (âMLBAMâ), Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc., the Major League Baseball Clubs, The MLB Network, LLC, Tickets.com, Inc., SportsOnEarth, LLC and each of their respective subsidiaries or affiliated entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Major League Baseball Clubs or the Office of the Commissioner of Baseball, and the directors, officers, employees and agents of the above entities. Non Australian resident are not eligible to enter.
3.Any persons under the age of 18 must obtain parent/guardian permission before entering this promotion.
4.The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion.
5.Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
6.The promotion commences in Victoria at 09.00:01am (AEST time) on 20/06/2012. Submissions close at 11.59:59am (AEST time) on 02/07/2012.
7.To enter, the entrant must complete the online entry form at
www.theabl.com.au, with their name, address and phone number, and in 25 words or less explain why they are Australiaâs biggest baseball fan.
8.Entrants can only enter this competition once per specified "25 words or less" statement. The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over telephone communications, networks, lines or the Internet and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.
9.Entries not fully complying with these conditions of entry may be deemed invalid at the Promoter's discretion. This is a game of skill; chance plays no part in determining the winners. Each valid entry will be individually judged (by representatives of the Promoter) based on, among other things, literary and creative merit. The judges' decisions are final and no correspondence will be entered into.
10.All entries become the property of the Promoter and will not be returned to the entrant. Each â25 words or lessâ statement must be the entrantâs original work. By entering this competition entrants: 1.Consent to the promoter making copies of or publishing the whole or any part of their entry (including the â25 words or lessâ statement) and otherwise exploiting the entry and any rights in the relation to the entry, to publicise this competition or for any other purposes; and
2.Undertake to the Promoter that their entry is not, and its use by the Promoter will not be, in breach of any third party intellectual property rights.
11.Eligible submissions will be judged in accordance to these Terms and Conditions.
Selection of winner:
1.The âWinnerâ of the âPrizeâ will be selected and announced 02/07/2012 at 12:00:00pm (AEST) at 46 Market Street Sydney NSW 2000, from the email entries of the â25 words or less statementâ. The âPrize Winnerâ will be determined by the best valid entry, as determined by the judges.
2.The âPrize Winnerâ will be announced no later than 11:59:00pm (AEST) on 04/07/2012 and notified in writing, by email and phone. The Prize Winner will be published in âThe Australianâ newspaper on the 06/07/2012
3.14. The Prize Winner will receive a trip for two to the Major League Baseball All-Star Game. This trip includes two (2) round trip ticket via Delta Air Lines from Sydney, New South Wales, Australia to Kansas City, Missouri, United States of America; four nights accommodation; two (2) tickets to each the MLB FAN Fest, Futures Game, State Farm Home Run Derby, and the MLB All-Star Game. Total maximum prize value AU$4500.00.
4.The winner and one guest will travel on Saturday 7 July 2012 from Sydney, New South Wales, Australia to Kansas City, Missouri, United States of America and return Wednesday 11 July 2012 from Kansas City, USA to Sydney, Australia.
5.Any additional costs associated with travel to Sydney & international travel documentation such as passports and visas, travel name changes, travel date changes, hotel incidentals, meals, ground transport including travel to the winners Capital city, taxis, parking or routing changes will be the sole responsibility of Prize Winner.
6.In the event that any Events or Games associated with the 2012 MLB All-Star Game Experience are cancelled, abandoned, suspended or rescheduled, the Prize Winner shall be subject to any and all policies of Major League Baseball with regards to any such Game. In the event the Prize Winner is unable to attend the MLB All-Star Game that has been rescheduled due to the predetermined travel schedule or other such conditions, the Promoter and the MLB Entities shall not be liable for any costs incurred through any changes requested by the Prize Winner in order to attend such a game. Winnerâs guests must be of legal age of majority in their jurisdictions of residence (and at least eighteen (18) years of age), unless accompanied by a parent or legal guardian. Major League Baseball game, event and exhibition dates and times are determined in the sole discretion of the Office of the Commissioner of Baseball and may be subject to change. Winner and his/her guest(s) agree to comply with all applicable ballpark regulations in connection with the Prize. Promoter and the applicable MLB Entities reserve the right to remove or to deny entry to Winner and/or his/her guest(s) who engage(s) in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the game, event or exhibition. Promoter and the MLB Entities will not be responsible for weather conditions, Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation or postponement of any Major League Baseball game, event or exhibition. Major League Baseball game, event and exhibition tickets awarded as part of the prize may not be resold or offered for resale. Any such resale may result in disqualification and forfeiture of prize, and may invalidate the license granted by the game ticket(s).
7.In the event of death to the Prize Winner, the Prize will not be passed on to the Prize Winner's estate.
8.Only the Prize Winner will be entitled to the Prize.
9.The prize is personal to the Prize Winner himself/herself and is not transferable and cannot be sold under any circumstances.
10.No substitution of any prize is offered. The Prize Winner will be notified in writing by email and telephone. Notification of the Prize Winnerâs status must be kept confidential until the Finalists are publicly revealed by the Promoter or the Prize Winnerâs prize will be forfeited. The Prize Winner will be published in âThe Australianâ newspaper on the 06/07/2012. The Promoter reserves the right to carry out reasonable due diligence to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the competition will not bring the Promoter, the MLB Entities or any of the ABL brands into public disrepute, contempt, scandal or ridicule or reflect unfavourably on the promotion as determined by Promoter in its sole discretion. In the event the Promoter is not satisfied of the above following such due diligence, the Promoter reserves the right at its sole discretion to disqualify any such Prize Winner and substitute with another Prize Winner, who may have entered the competition.
11.At the Promoter's request, winners must participate in all promotional activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and they consent to the Promoter and the applicable MLB Entities using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in promotional material or in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter and/or the MLB Entities.
12.The Promoter reserves the right to request winners to provide proof of identity and residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter.
13.Participants must comply with all requirements of the Promoter including requirements specified in the Terms and Conditions. The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant: 1.Fails to establish their entitlement to enter the Promotion to the Promoter's satisfaction;
2.Tampers with or benefits from any tampering with the entry process or the operation of the Promotion;
3.Submits an entry which in the Promoter's opinion is not in accordance with these Terms and Conditions;
4.Acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person; or
5.In the opinion of Promoter, engages in conduct in entering the Promotion which is fraudulent, misleading, deceptive, or generally damaging to the goodwill or reputation of the Promotion and/or Promoter.
14.The Promoter's decision is final and no correspondence will be entered into.
15.If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter and/or MLBAM may in its sole discretion cancel, terminate, modify or suspend the Promotion, or invalidate any affected entries. (Subject to State Regulations).
16.Except for any liability that cannot be excluded by law, the Promoter and the MLB Entities (including each of their respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: 1.any technical difficulties or equipment malfunction (whether or not under the control of the Promoter and/or MLBAM);
2.any theft, unauthorised access or third party interference;
3.any entry, vote or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter or MLBAM;
4.any variation in prize value to that stated in these Terms and Conditions;
5.any tax liability incurred by a winner or entrant; or
6.use of a prize.
17.Without limiting the previous paragraph, the Promoter, the MLB Entities and each of their respective associated agencies and companies will not be liable for any damage in transit to prizes.
18.As a condition of accepting the prize, winners may be required to sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
19.Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.
20.If a prize winner is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian.
21.In the event that the winner is unable to redeem the prize or does not meet the criteria listed in the prior terms and conditions, a Re-Draw will take place. This re-draw will take place no later than 12.00pm on 04/07/2012 and will be drawn at the Australian Baseball League Head office located at 46 Market St, Sydney 2000. In line with the aforementioned Terms and Conditions, the re-drawn winner will be contacted in writing by email and telephone. The results of the re-draw will be published in The Australian Newspaper no later than 09/07/12.
22.All entries received will remain property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this Promotion. The Promoter may disclose entrants' personal information to third parties, to its contractors and agents to assist in conducting this Promotion or communicating with entrants. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages to the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. Terms and Conditions of Travel (tickets):
1.Tickets are Valid for travel on 7 July 2012
2.Taxes are not included and need to be paid for by either the passenger or the ABL.
3.Travelers will fly in either T or L class â Economy only
4.All flights provided by Delta are ex Sydney only.
5.Copies of the travelerâs passports identification pages must be submitted at time of request and to included, full name, DOB, date of issue and expiry. If any details are incorrect the ABL will be responsible for any costs related to re-issue of the tickets.
6.Ticket request must come via the ABL, and authorised from either Peter Wermuth, Ben Foster or Gaby Anger.
7.Tickets are not eligible for Skymiles nor upgradeable.
