LIFESTYLE FOOD CAKE MONTH COMPETITION
TERMS AND CONDITIONS
ENTRY INTO THE COMPETITION
1. Entry into this competition (the “Competition”) is open to all permanent residents of Australia aged 18 years or over. The Promoter is XYZnetworks Pty Limited (ABN: 71 066 812 119) of Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 (the “Promoter”). Information on how to enter forms part of the terms of entry. Entry into the Competition is deemed acceptance of these terms and conditions.
2. The Competition is a game of chance, and skill plays no part in determining the winner.
3. Any person who (or a person from a household which) within any time between 1 July 2011 and 30 June 2012 (inclusive) has won a prize with a value which is equal or greater $5,000 from a competition run by the Promoter is not eligible to enter this Competition.
4. The officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter, the parties associated with this Competition (including Salmat IDR Pty Limited), FOXTEL, AUSTAR or Optus TV and their related bodies corporate are not eligible to enter.
5. The competition will be advertised on the Lifestyle FOOD Channel, online at www.lifestyle.com.au/food, www.lifestyle.com.au and http://www.facebook.com/LifeStyleFOODChannel and via the LifeStyle Channel, LifeStyle FOOD, LifeStyle YOU and LifeStyle HOME July eDMs.

6. The Competition begins at 00:01 (AEST) on Sunday 1 July 2012 and closes at 23:59 (AEST) on Sunday 12 August 2012 (the “Competition Period”).

7. There are two components this Competition:

Stage 1: entrants can upload an original photograph of a cake they have made (“Photo”).
Stage 2: viewers will be encouraged to vote for their favourite Photos.

Each entrant can elect to enter into either or both Stages of the Competition. Refer to the „Prizes‟ section on details of Prizes awarded in each Stage.

ENTRY METHOD

8. Stage 1: To enter the Competition and be eligible to win a Stage 1 Prize, entrants must enter using the below method:
(a) go to the official LifeStyle FOOD Facebook page at http://www.facebook.com/LifeStyleFOODChannel;
(b) become a fan of the LifeStyle FOOD Facebook page using their personal Facebook account;
(c) go to the „Cake Month‟ competition application tab within the Facebook page;
(d) upload an original Photo (see conditions below); and
(e) complete the entry form with all the details required, including (but not limited to) full name, email address and phone number. Mandatory details will be indicated on the entry form.
To be an eligible entry, each Photo must:
(a) be of a cake that is produced by the entrant independently; and
(b) the photograph must be an original work taken by the entrant personally.
Stage 1 entry limit: Entrants may upload as many Photos as they like, provided that each Photo is unique and is of a different cake the entrant has made. Each valid Photo uploaded in Stage 1 constitutes one entry into Stage 1 of the Competition.
9. Stage 2: To enter the Competition and be eligible to win a Stage 2 Prize, entrants must enter using the below method:
(a) go to the official LifeStyle FOOD Facebook page at http://www.facebook.com/LifeStyleFOODChannel;
(b) become a fan of the LifeStyle FOOD Facebook page using their personal Facebook account;
(c) go to the „Cake Month‟ application tab within the Facebook page;
(d) go to the gallery and vote for their favourite Photo that has been uploaded; and
(e) complete the entry form with all the details required, including (but not limited to) full name, email address and phone number. Mandatory details will be indicated on the entry form.
Stage 2 entry limit: Entrants can only vote once per photo, per day. Registered Stage 1 entrants cannot vote for themselves through their own Facebook ID or through any other Facebook ID or Page under the control of the entrant. Each vote constitutes one entry into the Stage 2 prize pool.
10. Any entry that is made on behalf of an entrant by a third party will be invalid. The use of any automated software or any other mechanical or electronic means that permits the participant automatically to enter repeatedly is prohibited (“Repeat Entry Device”). If the Promoter reasonably believes that an entrant is using any Repeat Entry Device or is entering the Competition using multiple Facebook accounts, the Promoter may disqualify that entrant without notice.
11. The Promoter reserves the right to verify the validity of entries and to immediately disqualify any entry which, in the opinion of the Promoter, includes inappropriate and objectionable content, profanity, and potentially insulting, inflammatory or defamatory statements. These entries will be disqualified from the Promotion and removed from the Facebook page. The Promoter reserves the right to refuse to publish or remove from the Facebook page, any entries that the Promoter reasonably believes infringes any third party‟s intellectual property rights or otherwise breaches these Terms & Conditions.
12. Incomprehensible and incomplete entries will be deemed invalid.
13. Entries must be received by 23:59 (AEST) on Sunday 12 August 2012. No responsibility will be accepted by the Promoter for late, lost or misdirected entries and all entries are deemed to be received at the time of receipt of the entry into the Promoter‟s database and NOT time of transmission by the entrant. The Promoter
accepts no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason.
PRIZES
Stage 1 Prizes
14. The number of votes received for each entry in Stage 1 of the Competition, will determine what rank (“Rank”) the Stage 1 entrants will receive at the end of the Competition Period. The ranking level will be displayed within the „Cake Month‟ gallery at all times, as below:
Golden Whisk Rank: Stage 1 entrants who receive the total number of votes which fall in the top 20% of all Stage 1 entrants Silver Spatula Rank: Stage 1 entrants who receive the total number of votes which fall in the next 60% of all Stage 1 entrants Bronze Spoon Rank: Stage 1 entrants who receive the total number of votes which fall in the next 20% of all Stage 1 entrants
15. There are two (2) prizes available for the winners in the Golden Whisk Rank (the “Golden Whisk Prize”). The Golden Whisk Prize is one (1) KM023 Chef Major Titanium Kitchen Machine Mega Pack, valued at $1,499 RRP. The total Golden Whisk Prize pool is valued at $2,998 RRP.
16. There are four (4) prizes available for the entrants in the Silver Spatula Rank (the “Silver Spatula Prize”). The Silver Spatula Prize is One (1) FP980 Multi Pro Excel Food Processor, valued at $699 RRP. The total Silver Spatula Prize pool is valued at $2,796 RRP.
17. There are ten (10) prizes available for the entrants in the Bronze Spoon Rank (the “Bronze Spoon Prize”). The Bronze Spoon Prize is One (1) HB724 Triblade Hand Blender, valued at $129 RRP. The total Bronze Spoon Prize pool is valued at $1,290 RRP.
Stage 2 Prizes
18. There is one (1) prize available for the entrants in Stage 2 of the Competition (the “Voters Prize”). The Voters Prize is one (1) KM023 Chef Major Titanium Kitchen Machine Mega Pack, valued at $1,499 RRP. The total Voters Prize pool is valued at $1,499 RRP.
Together, Golden Whisk Prize, Silver Spatula Prize, Bronze Spoon Prize and Voters Prize are referred to as “the Prize/s”.
19. The total prize pool for the Competition is valued at $8,583 RRP. Prize values are in Australian Dollars and are based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter is neither responsible nor liable for any change in the value of the Prize occurring between publishing date and date the Prize is claimed.
20. Only one prize per household will be awarded for the Competition (excluding SA residents who are entitled to win more than one Prize).
21. The Prize is not transferable. The Prize cannot be exchanged for any other prize/s or cash.
22. It is a condition of accepting the Prize that the Prize winner must comply with all the conditions associated with use of the Prize and the Prize supplier‟s requirements.
23. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the Prize for a prize of equal or greater value, subject to State Regulation.
24. Unless expressly stated in these Terms and Conditions all ancillary expenses incurred in partaking in any of the Prizes are the responsibilities of the Prize winners.
25. All entrants understand that there may be tax or other implications following the award of the Prize and should seek independent advice. All entrants acknowledge that the Promoter may require the Prize winner to (and the Prize winner will) reasonably execute such further documents to limit the Promoter‟s liability in relation to the Prize.
26. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.
27. The Promoter takes no responsibility for any Prizes that are damaged, delayed or lost in transit. The Promoter makes no warranties or representations about the fitness for purpose or suitability of any Prize and will not accept responsibility for the quality or fitness for any purpose of any Prize, or the failure of any Prize to be of merchantable quality.
CONSENTS, WARRANTIES AND LICENCES
28. As a condition of entering this Competition, entrants consent to having their Photo(s) their your name and state uploaded to the Facebook page and in the Competition application.
29. Each photograph entry must be an original work and must not infringe the copyright or any other rights of any third party. Each entrant warrants that:
a) each Photo and the cake photographed are their own original works and is not copied in any manner from any other works;
b) he/she owns all rights and interest in the Photo(s) submitted and have obtained all express consent from:
i. any persons appearing in the photos (or where a person appearing in a photo is under the age of 18, consent must be obtained from the minor‟s parent or legal guardian); and
ii. the owner of any private property (including any items, objects, or real property) photographed
to enter the photo(s) for this Competition in accordance with these Terms & Conditions;
c) he/she has the full power and capacity to grant the rights and consents set out in these Terms and Conditions; and
d) he/she will fully indemnify the Promoter against any loss or damages suffered by the Promoter in the event any of the warranties set out in this clause are false.
30. Entrants will retain ownership of copyright in their photograph; however, as a condition of entry, each entrant:
a) agrees that their name, image, biography and entries (including, but not limited to, any written answers, photographs/images and videos) may be reproduced, published, communicated, broadcast or shown to the public by the Promoter in any media for its promotional purposes, without compensation to the entrants; for this purpose, each entrant grants to the Promoter a non-exclusive, perpetual, worldwide, transferable and royalty-free licence in any such written answers, photographs /images and videos; and
b) consents to any act or omission by the Promoter which may infringe any of the entrant‟s moral rights (within the meaning of the Copyright Act 1968 (Cth)), including: i) failing to attribute (or correctly attribute) the entrant‟s authorship of the entry; or ii) making any modification, variation or amendment of any nature to the entry, whether or not it results in a material distortion or derogatory treatment of the entry.
AWARD OF THE PRIZE AND WINNER NOTIFICATION
31. At the end of the Competition Period, the entrants in each of the Stage 1 Ranks will be entered into a draw with other entrants within the same Rank.
32. All Prize draws (as outlined below) will take place at Salmat IDR, Level 2, 116 Miller Street, North Sydney, NSW 2060 at 15:00 (AEST) on Monday 20 August 2012.
Stage 1 Two (2) valid entrants will be drawn from the Golden Whisk Rank entry pool Four (4) valid entrants will be drawn from the Silver Spatula Rank entry pool Ten (10) valid entrants will be drawn from the Bronze Spoon Rank entry pool
Stage 2 One (1) valid entrant will be drawn from the Stage 2 entry pool
All Prize winners will be notified in writing within 2 days, and winners of Prizes valued over $250 will be published in the Public Notices section of The Australian newspaper on the Monday 27 August 2012.
33. The Promoter shall conduct such further redraws as may be deemed necessary at Salmat IDR, Level 2, 116 Miller Street, North Sydney, NSW 2060 at 15:00 (AEST) on Tuesday 20 November 2012 to distribute any Prizes unclaimed by that date, subject to State Regulation. The redrawn winner of any unclaimed Prize will be notified in writing within 2 days, and winners of Prizes valued over $250 will be published in the Public Notices section of The Australian newspaper on the Tuesday 27 November 2012.
34. Should an entrant‟s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any
information provided in an entry should be directed to Promoter.
35. Prizes will be awarded to the person named in the entry. However, in a dispute, will be awarded to the account holder of the entry mechanism used to submit their entry (i.e. internet account holder).
36. If a Prize winner cannot be contacted or does not claim the Prize by the stipulated date in clause 33, then the Prize will be forfeited and a substitute prize will not be offered in lieu of the Prize, subject to State Regulation.
37. If any particular draw is scheduled on a public holiday, the draw will be conducted on the next business day.
38. In the event that the number of valid entrants does not meet the number of prizes to be allocated, the remaining prizes will be drawn and allocated amongst all valid entrants at the time of draw until all prizes have been awarded.
GENERAL
39. Entrants release Facebook and its associated companies from all liability arising in respect of the Competition and acknowledge that:
(a) the Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook;
(b) any information provided by the entrant in connection with the Competition is provided to the Promoter and not to Facebook; and
(c) any questions, comments or complaints regarding the Competition will be directed to the Promoter, not to Facebook.
40. Any costs of using and accessing Facebook via a mobile phone, tablet or other devices will be dependent on the entrant‟s individual mobile and internet service provider. The Promoter is not responsible for any costs associated with any mobile, telephony, internet, or Facebook access and usage. The Promoter is not responsible for any other costs associated or incurred as a result of the entrant‟s entry into the Competition.
41. Entry and continued participation in the Competition is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at http://www.facebook.com/terms.php.
42. This Competition adheres to the terms and conditions set out in the Facebook promotion guidelines which can be found at: http://www.facebook.com/promotions_guidelines.php.
43. Entrants enter the Competition at their sole risk. The Promoter, Facebook and Salmat IDR shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the entrant or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
44. The Promoter reserves the right to, in its sole discretion, cancel the award of prize/s to, and/or to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition. The Promoter‟s legal rights to recover damages or other compensation from such an offender are reserved.
45. The Promoter, Salmat IDR, Facebook and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
46. To the full extent permitted by the law, the Promoter, Salmat IDR, Facebook and their associated agencies will not be liable for any loss, damage, claim, cost, expense or personal injury suffered or sustained (including, but not limited to, that caused by any person‟s negligence) by any Entrant in connection with the Competition or the Prizes, including:
a) any indirect, economic or consequential loss or loss of profits;
b) any loss arising from the negligence of a relevant party; and
c) any liability for personal injury or death.
47. If for any reason this Competition is not capable of running as planned, including (but not limited to) due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter or Salmat IDR or Facebook, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to State Regulation.
48. No responsibility will be taken by the Promoter, LifeStyle FOOD Channel, FOXTEL, AUSTAR or Optus TV, Facebook the Promoter‟s agents for the Competition for any changes in dates, times or cancellations or other arrangements that may prevent the Prize winners from winning the Prizes.
49. The Promoter reserves the right, in its absolute discretion, to disqualify:
a) any entry which, in the opinion of the Promoter, includes any objectionable content, profanity or is potentially insulting, inflammatory or defamatory; or
b) any individual who tampers with the entry process, submits an entry that is not in accordance with these Terms and Conditions or who has in the opinion of the Promoter, engaged in unlawful or improper conduct that is designed to jeopardise the fair and proper conduct of the Competition or is generally damaging to the goodwill or reputation of the Promoter.
50. Subject to relevant state authority approval, the Promoter reserves the right, in its absolute discretion, at any time before the awarding of the Prizes to cancel or vary the Competition or to vary or cancel the award of the Prizes including, without limitation, circumstances where in the Promoter‟s opinion (which it shall form in its absolute discretion):
a) a Prize winner does not satisfy the Competition entry requirements; or
b) the Promoter cannot conduct the Competition or award the Prize/s for any reason beyond its control.
51. Subject to relevant state authority approval, in the event that the Promoter cancels or varies the Competition or varies or withdraws the Prizes it shall not:
c) be liable to any person for any costs, loss or damage (including costs, loss or damage caused by any negligence) arising out of, or in connection with, such cancellation, variation or withdrawal; or
d) be required to conduct the Competition at any other time.
52. All entrants agree to provide the Promoter or the Promoter‟s authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as a Prize winner or if reasonably requested by the Promoter or the Promoter‟s authorised agent. Proof of age, identification, residency and entry considered suitable for verification is at the sole discretion of the Promoter. In the event that the Prize winner cannot provide suitable proof, the Prize winner will forfeit the Prize in whole and no substitute will be offered.
53. A decision of the Promoter in relation to any aspect of the Competition is binding and conclusive and no correspondence will be entered into.
54. The Promoter is collecting the entrant's personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winners). The entrant's personal information may be disclosed to Salmat IDR for this purpose. If you are not willing for this to occur you cannot participate in the Competition.
55. All opt-in entries will be entered into a database and the Promoter may use the entrant‟s names, addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant. By opting-in, entrants confirm that they allow their details to be used for this purpose. If entrants no longer consent to their details being used for future marketing purposes, the entrant should contact the Promoter on their details set out in these Terms and Conditions.
56. The Promoter collects entrants‟ personal information (as that term is defined in the Privacy Act 1988 (Cth)) for the purpose of conducting and promoting this Competition (including, but not limited to, determining and notifying winners). Entrants are advised that their personal information may be disclosed to State and Territory lottery departments and their names as the winner may be published as required under the relevant lottery legislation. Entrants are also advised that from time to time, the Promoter may disclose your personal information to third parties (including, but not limited to, third party prize providers) for the purpose of administering prizes or for other purposes contemplated in these Terms and Conditions. For purposes of public statements and advertisements the Promoter will only publish the winner‟s surname, initial and state. A request to access, update or correct any information should be directed to the Promoter.
57. By entering the Competition, all entrants agree that their name, image, biography and entries (including, but not limited to, any written answers, photographs/images and audio-visual recordings) may be reproduced, published, communicated, broadcast or shown to the public by the Promoter in any media for its promotional purposes, without compensation to the entrants, subject to the Promoter‟s privacy policy which is available at www.lifestyle.com.au; for this purpose, each entrant grants to the
Promoter a non-exclusive, perpetual, irrevocable, worldwide, transferable and royalty-free licence in any such written answers, photographs /images and audio-visual recordings. Each entrant consents to any act or omission by the Promoter which may infringe any of the entrant‟s moral rights (within the meaning of the Copyright Act 1968 (Cth)), including: i) failing to attribute (or correctly attribute) the entrant‟s authorship of the entry; or ii) making any modification, variation or amendment of any nature to the entry, whether or not it results in a material distortion or derogatory treatment of the entry.
