Chrysler New York Experience Competition
Competition Terms and Conditions
Information on how to enter and prizes forms part of these conditions of entry. Participating in this competition is deemed acceptance of these conditions of entry. Any entry not complying with these conditions of entry is invalid.
Entry is open to residents of Australia who hold a current passport (with at least 6 months remaining), have a personal Facebook account, and are over the age of 18 years old. Employees, management and directors (and their immediate families) of the Promoter and its agencies, retailers and suppliers associated with the competition are ineligible to enter.
The competition commences at 9.00am (AEST) on 04/07/12 and closes at 9.00pm (AEST) on 14/08/12 (Competition Period).
During the Competition Period, entrants must:
visit the Chrysler Australia Facebook page (http://www.facebook.com/chrysleraustralia) and click on the “Win a Chrysler New York Experience” application; and
follow the links to fully complete and submit the online entry form, including by providing their full name, address, email address and phone number, and any additional information as required by the Promoter. Consumers are responsible for their own costs associated with accessing the Internet.
After an entrant has submitted their entry they will have the opportunity to share their entry with friends on Facebook. Entrants who share their entry via Facebook (within the Competition Period) will receive one bonus entry into the prize draw. Entrants must only share with friends, family, colleagues and other individuals whom they have a direct relationship with, and who consented to having this type of information shared with them.
All entries must be received by the Promoter during the Competition Period. Entries are deemed to be received at the time they are received by the Promoter’s database and not at the time of submission by the entrant. Subject to paragraph 5, entries are limited to 1 entry per person. The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, tampering, deletion, theft, communications failure or otherwise. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Entrants who enter using multiple email addresses, Facebook accounts or aliases may be disqualified.
The prize is a trip for the winner and one companion (who must be aged 18 years or over) to New York which consists of return economy airfares (including airfare taxes) for the winner and their companion from the winner’s nearest Australian capital city to New York, 5 nights accommodation (twin share) at the Courtyard Marriott Upper East Side Hotel (or similar accommodation at a minimum four star hotel) for the winner and their companion, private airport transfers, gourmet dinner with cocktails at Kimberley Hotel up to the value of USD$400, private limousine transfer to Kimberley Hotel and $1,000 spending money for the winner only. Flights and accommodation are subject to booking and availability. Travel must be booked and completed by 20/06/13. The prize cannot be taken during specified event/peak/public holiday periods or any other exclusion periods as specified by the Promoter and/or the prize supplier/s. All other costs associated with the prize, including but not limited to any additional transfer costs, additional meals, additional taxes, insurance and other ancillary costs are the responsibility of the winner and his/her companion, as incurred. The winner may be required to present their credit card at time of accommodation check in. The winner and their companion must depart and return at the same time. The prize is subject to any additional terms and conditions specified by the prize supplier/s. The winner and their travelling companion are responsible for ensuring that they have all necessary documents to travel to New York, including a current passport and any visas or visa waivers that may be required.
All travel is subject to availability at all times and maybe dependent on select seat class with airlines or specific room category availability with accommodation partner. Travel is valid until 20 June 2013. Block out period includes 20 June 2012 until 10 August 2012 and from 10 December 2012 until 20 January 2013 along with special event periods. Bookings must be made a minimum of 45 days before requested departure date. All bookings and documentation regarding the prize must be made via Free-2-Travel Holidays Pty Ltd or their agents. Redeeming the prize is conditional on acceptance of the terms and conditions of travel as detailed by Free-2-Travel Holidays Pty Ltd and the airline carriers in accordance with normal travel practices. Winner and companion must be in possession of a valid passport with a minimum of 6 months validity on it prior to departure. Winner is responsible for any amendments fees issued by airlines or suppliers once booking is confirmed and ticketed. It is the winner's responsibility to organise transport to/from the airport departure/return point. Prizewinner and travel companion must have valid travel insurance for their period of travel.
In the event that the value of the dinner offered as part of the prize is less than the amount specified by the Promoter, the balance will be forfeited and no cash will be supplied in lieu. Any costs incurred over the specified amount for the dinner are not the responsibility of the Promoter and must be borne by the winner and their companion, as incurred
The total prize pool is valued at up to $14,200 (inc GST) depending on the winner’s point of departure.
The draw will be conducted at 12pm (AEST) on 21/08/12 at Prime Focus, Suite 403, 62 Beach Street, Port Melbourne, Victoria 3207. The first valid entry randomly drawn from all valid entries received will win the prize.
The winner will be notified by telephone and in writing within 2 days of the draw and the winner’s name and state/territory will be published in The Australian newspaper on 28/08/12. By entering this competition, each entrant requests that his or her full address not be published.
The prizes is not transferable or exchangeable and (except where cash is specified) cannot be redeemed for cash. If for any reason the winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be supplied in lieu of that element of the prize. The Promoter accepts no responsibility for any variation in prize value. If the prize or any element of the prize is unavailable for any reason, the Promoter may substitute for that prize or element of that prize another item of equal or higher value as determined by the Promoter, subject to the approval of the gaming authorities in each state and territory if required.
The Promoter may require winners to provide proof of identity, proof of age and proof of residency at the nominated prize delivery address. Identification considered suitable for verification is at the Promoter’s discretion.
If a winning entry is deemed not to comply with these conditions of entry, the entry will be discarded and a new winner of that prize will be determined by drawing a further valid entry in accordance with paragraph 11.
The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent or effect of annoying, abusing, threatening or harassing any other person. The Promoter may in its absolute discretion cancel the prize or otherwise cease to provide any benefit of the prize to a winner (and their companion, if applicable) if the winner (or their companion, if applicable), in the opinion of the Promoter, is under the influence of alcohol or any other drug, behaves aggressively or offensively, or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate or the agencies or companies associated with this competition, is contrary to law or is otherwise inappropriate.
The Promoter is not liable for any tax implications arising from prize winnings. Independent financial advice should be sought. Where this competition involves, for GST purposes, supplies being made for non-monetary consideration, entrants will follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
It is a condition of accepting the prize that the winner (and their companion) signs a legal release in a form to be determined by the Promoter.
If the prize has not been accepted or claimed within 3 months of the draw, the winner’s entry will be deemed invalid and the Promoter will conduct such further draws on 22/11/12 at the same location as the original draw as are necessary to distribute the prize, subject to any requirements of any gaming authority. Any winner(s) in this draw will be notified in writing and by phone and will have their name and state/territory of residence published in The Australian on 26/11/12.
The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage or delay in transit to prizes.
The Promoter’s decision is final and no correspondence will be entered into.
This competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants are providing their information to the Promoter and not to Facebook. Each entrant completely releases Facebook from any and all liability.
The winner (and their companion) must, at the Promoter’s request participate in all promotional activity (such as publicity and photography) surrounding the prize, free of charge and they consent to the Promoter using their name and image in promotional material.
If for any reason the competition is not capable of running as planned (whether caused by infection by computer virus, communications network failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness or integrity of the competition), the Promoter reserves the right in its sole discretion, (subject to any written direction given by a relevant regulatory authority), to cancel, terminate, modify or suspend the competition or invalidate any affected entries.
All information collected by the Promoter will become the property of the Promoter. Personal information supplied will be collected and utilised for awarding the prize and the Promoter may also use this information for improving goods and services and to contact entrants with future and special offers.
