âBust Out the Beanzâ
1) Information on how to enter this Competition forms part of the terms and conditions of entry. Entry into the Competition is deemed acceptance of these Terms and Conditions.
2) The promoter of the Competition is H. J. Heinz Co Company Australia Ltd (ACN 004 200 319) (the Promoter). The party supplying the Prize for the Competition is Network Ten Pty Limited (ACN 052 515 250) (Network Ten).
3) The entrant is the person who submits the photograph (Entrant) as a part of the âBust out the Beanzâ competition which is the subject of these terms and conditions (the Competition).
4) The Competition will be advertised on the âBeanz Meanz Heinzâ Facebook page from 16 August 2012 and during the âBefore The Gameâ television show produced by Before the Game Pty Ltd (ACN: 149 140 205) (Before The Game) (The Program) broadcast by Network Ten between 16 August 2012 and 20 September 2012.

Entry is open to all permanent residents of Australia who are aged 18 years or over. Employees and the immediate families of Heinz, Network Ten, Before the Game and any agencies associated with this Competition are ineligible to enter the Competition.
6) The Competition entry period commences on Thursday 16th August 2012 @ 17:40 AEST and
concludes on Sunday 23d September 2012 @ 23:59 AEST (Entry Period).

Entry into the Competition is by online entry only. To submit a complete and valid online entry, Entrants must provide personal details including but not limited to their full name, email address, residential address and a contact number. Any contact details entered incorrectly shall invalidate the entry. Online entry is free; however, your internet connection rates apply.

This Competition is a game of skill; chance plays no part in determining the Winner. Each valid entry will be individually judged by Heinz or representatives of Heinz based on the Judging Criteria as set out in clauses 21 and 26 below.

Entrants may enter once per day during the Entry Period, however, each entry must comprise a different photograph.10) The Entrants acknowledges and agrees that their entry must be in accordance with Facebook's Statement of Rights and Responsibilities and can be removed at any time by the Promoter or otherwise in accordance with Facebook's Statement of Rights and Responsibilities.
11) When entering this Promotion, the Entrants agree to release Facebook from all liability and claims arising out of or in connection with the Competition or these Terms and Conditions.
12) The Competition is in no way sponsored, endorsed, administered by, or associated with Facebook. Any questions, comments, or complaints regarding the Competition should be directed to the Promoter. When entering this Competition, the Entrants yare providing your information to the Promoter and not to Facebook.
13) The Competition consists of two phases.
Entry - Phase 1
14) To enter the Competition, Entrants will be required to:

Upload a photograph featuring themselves, family and/or friends âBusting Out the Beanzâ whilst supporting their favourite AFL team; and
Fully complete an online entry form.
15) Photographic entries must incorporate the Entrant and may include any design elements that the Entrant deems to be entertaining, creative, and original. The photograph must be submitted in a jpg, png or gif file format.
16) Entries that are, or include obscene, offensive, defamatory, inappropriate, unsuitable, or infringing content as determined by the Promoter at its sole discretion will be deemed invalid and will not be eligible to win.

Entries must be original photographs and not wholly graphically created. They must also be the original work of the Entrant and must not infringe the rights of any third party.
18) The Promoter reserves the right to verify the validity of entries. Entries not fully complying with these conditions of entry will be deemed invalid and unacceptable, and will not be eligible to win.
19) In the case where there are multiple people featured in a photograph, the Entrant who has submitted the photograph acknowledges that he/she has received permission from all people in the photograph to use their likeness for the purpose of this Competition. The Entrant must provide the abovementioned permission to the Promoter, on the Promoterâs request.
20) All entries become the property of the Promoter. Some of the photographs entered into this Competition may be selected to be shown on the Program and/or the Programâs website and/or Heinzâs website (
http://www.heinz.com.au/Privacy.aspx) and/or âBeanz Meanz Heinzâ Facebook page (
https://www.facebook.com/heinzbeanzaustralia). Entrants agree to the disclosure of their personal details (name and suburb) and the use of their photographs in the manner discussed above. The Entrant fully releases Heinz, Before the Game and Network Ten from and against any claims, demands and liability whatsoever in connection with such disclosure or use of the photographs by the above entities.
21) Each entry will be judged by a Judging Panel based on originality, creativity, entertainment value and the ability to combine the love of Heinz Beanz and the AFL football. Each entry will be allocated a score from out of 10. Three (3) entries with the highest score will be allocated the first, second and third place (the Finalists) and will proceed to Phase 2 of the Competition.
22) The judging will take place at the Promoterâs premises located at 2 Southbank Boulevard, Southbank, Victoria on 24 September 2012 at 10 a.m. The Judgesâ decision is final and no correspondence will be entered into.
23) Each Finalist will be contacted by the Promoter on or before 25 September 2012. The names of the three (3) Finalists will be also published on theâ Beanz Meanzâ website and âBeanz Meanz Heinzâ Facebook page.
Phase 2

The three (3) Finalists will then compete for the Prize as defined in clause 28 below by way of each of them being represented by an AFL Player (Participating AFL Player(s)) on the AFL Grand Final Show of the Program which will be recorded on Friday, 28th September 2012 between 8:30pm and 11.00pm (AEST) in Melbourne. The Finalists will not be present at the taping of the Program.25)
The Finalist with the highest score will be represented by the Participating AFL Player whose team finished the highest on the 2012 AFL Ladder out of the 3 Participating AFL Players. The Finalist with the second-highest score will be represented by the Participating AFL Player whose team finished the second-highest on the 2012 AFL Ladder out of the 3 Participating AFL Players. The Finalist with the third-highest score will be represented by the by the Participating AFL Player whose team finished last on the 2012 AFL Ladder out of the 3 participating AFL Players.
26) Each Participating AFL Player will take part in a quiz and answer quiz questions on behalf of the Finalist they represent. The winner of the quiz will be the Participating AFL Player who answers the highest number of questions correctly, as determined by the Judge(s). The Finalist represented by the winning Participating AFL Player will be considered the winner of Phase 2 of this Competition (the Winner).27) The Winner of Phase 2 will be notified via phone and email not later than Monday 1st of October 2012. The name of the Winner will also be published on theâ Beanz Meanzâ website and Beanz Meanz Heinz Facebook page.

The Winner will receive:

(the Prize)
The total value of the Prizes is AU $13,288. 29) If for any reason any element of the prize becomes unavailable for any reason, which is out of the Promoters control then a similar prize to equal value, will be awarded at the Promoterâs absolute discretion.
30) The representative of Network Ten will contact the winner to organise the delivery of the Prize no later than 15 of October 2012.
Termination
31) If for any reason this competition does not run for its duration due to circumstances beyond the reasonable control of the Promoter, the Promoter, subject to any direction given under the relevant State legislation, may cancel, terminate, modify or suspend the Competition.
Privacy
32) All personal information submitted by Entrant for the purpose of this Promotion shall be dealt with in accordance with the Privacy Policy of the Promoter. The Privacy Policies can be viewed at
http://www.heinz.com.au/Privacy.aspx. Access to the Entrantâs personal information can be gained by writing to Public Affairs, H.J. Heinz Co. Australia Ltd, 2 Southbank Boulevard, Southbank, Victoria 3006.
33) By entering into the Competition, each Entrant understands and agrees that in the event that they are the Finalist, the Promoter may, at its sole discretion and without any further notice to the winning entrant, use the Entrantâs name, image and likeness (including photograph, filming and/or recording of the same) in any media for a reasonable time following this Competition, without remuneration, for the purpose of promoting this Competition (including the outcome) and promoting any products manufactured, distributed and/or supplied by the Promoter or its related companies.
34) By entering into the Competition, each Entrant understands and agrees that in the event that they are the Winner and/or Finalist, the Promoter may require them to participate in news and/or media activities surrounding the Competition such as photographic shoots and interviews. The Finalists hereby agree to the participation in such activities for a reasonable period following the Competition, and without any remuneration.
Details of liability
35) The Promoter, Before the Game Pty Limited, Roving Enterprises Pty Ltd (Roving) and Network Ten (or any affiliates, directors, officers, employees and agents of those companies) shall not be liable for any direct, indirect or consequential loss, damage or injury suffered or sustained (even if caused by negligence) by an Entrant (or a third party), as a result of participating in this Competition, the Competition not running as scheduled, or accepting and/or using the Prize, except for any liability that cannot be excluded by law.
36) Except for the costs clearly set out in these Terms and Conditions, any costs associated with this Competition (including access to the Promoterâs website) are the Entrantâs responsibility and the Promoter will not be liable for any such costs.
37) The Promoter is not responsible for any lost data, interrupted communications, any entries not received by the Promoter, unavailable network servers or other connections, failed computer transmissions, undelivered mail or other errors of any kind, whether human, electronic or mechanical. It is each Entrantâs responsibility to inform the Promoter if their personal details change prior to the Competitionâs closing date.
38) The Prize must be taken as offered. The Promoter makes no representations or warranties as to the quality, suitability or merchantability of any goods or services offered as Prize(s). The Promoter accepts no responsibility for the loss or damage to the Prize which may have occurred during the delivery of the Prize to the winner.
39) The Winner will have until 09:00 (AEST) on 19 October 2012 to claim their Prize. If the Prize remains unclaimed and Channel 10 representative is unable to get in contact with the winner, then subject to any direction given under relevant state legislation, the Prize will be allocated to the Finalist represented by the Participating AFL Player with the second highest score in the quiz. The new winner will be notified by telephone.
40) By entering into this Competition, and therefore accepting these Terms and Conditions, the Finalists and the Winner release the Promoter, Before the Game, Roving and Network Ten, their affiliates, directors, officers, employees and agents, from any and all causes of action, losses, liability, damage, expense (including legal expenses) cost or charge suffered, sustained or in any way incurred by the Finalists and/or the Winner as a result of any loss or damage, or any injury or death arising out of, or related to their participation in the Competition or in any way connected with the Promoter, Before the Game, Roving and/or Network Ten or the Prize.
41) As a condition of accepting the Prize, at the sole discretion of the Promoter, the Finalists and/or the Winner may be required to sign a legal release and indemnity form releasing it, Before the Game, Roving and Network Ten from any liability incurred by the Finalists and/or the Winner as a result of their participation in the Competition.
42) Prize values are the recommended retail value as provided by the supplier and are correct at time of printing. The Promoter accepts no responsibility for any variation in prize values.
43) The Winner is advised that tax implications may arise from their Prize winnings, and they should seek independent financial advice prior to the acceptance of the Prize.
44) Nothing in these Terms and Conditions limits, excludes or modifies the statutory consumer guarantees as applicable to this Competition pursuant to the provisions of the Competition and Consumer Act 2010 (Cth). Except for any liability that cannot be excluded by law, the Promoter, its affiliates, its directors, officers, employees and agents accept no liability (including in negligence), for any personal injury, any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Competition.
