GAME OF SKILL
1. Information on how to enter the Olympus Father’s Day Competition and prizes form part of these Terms and Conditions. As a condition of participation, Participants accept these Terms and Conditions and any rules, policies or procedures that may be adopted by the Promoter from time to time. To the extent of any inconsistency, these Terms and Conditions prevail..
2. Entry to the Olympus Father’s Day Competition (the “Competition”) is only
open to Australian residents over 18 years of age. Employees of the Promoter (and their immediate families), are ineligible to participate. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

Only one entry per person is permitted. Illegible entries will be deemed invalid.
4. To participate in the Competition, participants must,
in 50 words or less, “Tell us about your favourite Father’s Day moment.” in the appropriate entry field in the Competition app housed on the Olympus Imaging Australia Facebook Page (Olympus AU) at
www.facebook.com/Olympus.AU. Participants must provide personal details including; full name, date of birth, sex, country of residence, email address and contact telephone number.
5. This is a game of skill and chance plays no part in determining the winner. Each entry will be individually judged based on literary and creative merit and originality. The judges’ decision in relation to all aspects of the Promotion is final and binding on each participant who enters, and no correspondence will be entered into.
6. Each entrant warrants to the Promoter that each entry submitted is an original artistic work of the entrant and does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition.
7. The Promoter is entitled to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including using the entries for future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. The Promoter is entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry.
8. Entries must not be offensive, defamatory or racist. Any entry that the judges deem inappropriate will be invalid.
9. The Competition commences 4.00pm (AEDT) 17th
September 2012 and
ends at 11:59pm (AEDT) on 2nd September 2012. No responsibility is accepted for lost, delayed or misdirected entries or any hardware or software errors that might impede entry .
10. The Promotion will be judged by a panel appointed by the Promoter for
prize number 1, being an Olympus TG-1 Tough Digital Compact Camera. For prize number 2, the “People’s Choice” prize of an Olympus XZ-1 Digital Compact Camera, the prize will be awarded by public vote. Judging for the major prize will begin at the Promoter’s premises on September 3rd 2012. Voting for the People’s Choice prize will be open at midnight on the 3rd of September 2012, and close at 11.59pm on Thursday the 6th of September. Members of the public will be able to vote once only on each entry during the voting period. Voting will be conducted via the “Vote Now” button on each entry. The prize winners will be notified by September 7th, 2012 by email using contact details provided in their entry. Winners will subsequently be announced on the Olympus.AU Facebook Page at 5pm on September 7th, 2012.

2. The participant submitting the best entry as determined by the public vote will receive one (1) Olympus XZ-1 Digital Compact Camera valued at RRP $499.11.
Total prize pool is valued at RRP $998. Prizes do not include any ancillary costs associated with redeeming the prizes. These are the responsibility of the winners.
12. Prize values mentioned are in Australian dollars and are the recommended retail value as provided by the suppliers and are correct at the time of printing. The Promoter is neither responsible nor liable for any change in the value of a prize occurring between the publishing date and the date the prize is claimed.
13. In the event that the prize, or part of the prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize at its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification subject to State Regulation.
14. The Promoter is neither responsible nor liable for any late, lost or misdirected mail (including but not limited to prizes).
15. The Promoter is not responsible, nor liable for any prize damaged in transit in the delivery of the prize.
16. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the internet service provider used.
17. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
18. The use of any vote exchanging websites, groups or forums is strictly prohibited, as is the use of any false or duplicate Facebook accounts. Any entry suspected of obtaining votes via any means other than single votes via legitimate Facebook users will be disqualified.
19. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
20. Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) is not responsible for and excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following:
1. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
2. any theft, unauthorised access or third party interference;
3. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
4. any variation in prize value to that stated in these Terms and Conditions;
5. any tax liability incurred by a winner or entrant; and
6. use of a prize.
21. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the Promotion, as appropriate.
22. All entries submitted become the property of the Promoter. Entries will not be returned to any entrant. As a condition of entering into this Promotion, each entrant licences the Promoter to use their entry in any media for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes. Each entrant warrants to the Promoter that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry that may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
23. Information provided by the participant when entering the Olympus PEN Mother’s Day Competition is placed in a database and used only for communications relating to the Olympus PEN Mother’s Day Promotion. No separate database is made of entrants in this Promotion. We do not sell, pass on or swap contact details to third parties.
