TERMS AND CONDITIONS
1. Information on how to enter and the prizes on offer form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian residents aged 18 years or over in NSW, VIC, QLD, ACT, SA, WA, NT and TAS that satisfy the entry requirements above. Entry limited to 1 (one) valid entry per person.
3. Employees (and their immediate families) of the Promoter and its related entities, franchises and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants/email or address details and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
5. The Promoter also reserves the right to verify the validity of memberships and to disqualify any member who tampers with the membership process or who joins in a manner or method not in accordance with the Terms and Conditions governing the use of Letterboxdeals.com.au. Only one account per person is permitted.
6. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
7. Promotion commences 09.00 AEST on 20.08.12 and closes 11.59pm AEDST on 14.10.12.
8. All qualifying entrants will be entered into each daily draw starting with the first daily draw after the time of entry and ending with the final daily draw. Daily prize draws will take place via electronic medium at 5pm AEST or AEDST (as applicable in NSW) every day from 20.08.12 until 18.10.12 at Letterboxdeals, Level 1, 183 Harris St, Pyrmont NSW 2009.
9. There are sixty (60) prizes of one (1) $500 Travelscene American Express/Qantas Holidays voucher to be won. Prizes will be distributed via email to the winning entrant’s email address (as supplied when entering) within 14 days of the draw date.
How to redeem vouchers: 10. Winners must present their voucher to any participating Travelscene American Express agency in Australia. Winners can phone 13TRAVEL, or visit
http://www.travelscene.net.au to access the ‘Agent Finder’ to find their closest Travelscene American Express Member.
11. Winners can use the voucher towards the purchase of any Qantas Holidays or Viva! Holidays travel package up to the value of the voucher, or above the value of the voucher – in which case the winner will need to make up the difference with an alternative form of payment. The voucher is partially redeemable in that it can be used on more than one occasion until the full value has been used. Voucher is not redeemable for cash, traveller’s cheques or credits. Unused balance on expiry of the voucher will not be refunded or credited.
12. Winners should treat their voucher like cash. Defaced, mutilated, altered, lost or stolen vouchers may, at the sole discretion of Travelscene American Express, be replaced or redeemed upon the payment of a replacement fee (as determined by Travelscene American Express).
13. The voucher: (a) is redeemable for Qantas Holidays or Viva! Holidays travel products ONLY at participating Travelscene American Express shops in Australia only (excludes bookings made online); (b) must be redeemed before the expiry date shown on the voucher; and (c) cannot be reloaded or increased after issue. Participating Travelscene American Express agencies are not obliged to accept the voucher on a sale of under $20. In any event, vouchers expire 12 months from date of issue. Cash will not be given for any unused balance. Unused balance on expiry of the voucher will not be refunded or credited. Winners are liable for all transactions on their voucher. Winners can check available voucher balance by calling 1300 55 33 80. Travelscene American Express reserve the right to change any terms contained in these Terms and Conditions of Use at any time. 14. The first name and first initial of each daily winner’s surname together with the suburb in which they live will be posted on letterboxdeals.com.au every day for the duration of the promotion with winners notified by email within 7 days of the draw date.
15. Winners will also be published in The Australian on 6th November 2012.
16. All prizes will be awarded to the named recipient (as supplied when entering) only. Prizes cannot be transferred to or redeemed by anyone other than the named recipient of the Travelscene American Express Qantas Holidays voucher.
17. The total prize pool is $30,000.
General 18. The Promoter’s decision is final and no correspondence will be entered into.
19. Any costs in excess of the value of the prize (including GST) and all ancillary costs associated with redeeming the prize are the responsibility of the winner. The Promoter shall not be liable for a prize that has been lost, stolen, forged, damaged or tampered with in any way. Redemption of the prize is subject to any relevant terms and conditions of the prize provider (including those outlined above). No responsibility accepted for late, lost or misdirected entries.
20. The prizes are not transferable or exchangeable and cannot be taken as cash.
21. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority.
22. Any costs associated with accessing Letterboxdeals.com.au is the entrant's responsibility and is dependent on the internet service provider used. Any contact details entered incorrectly shall be deemed invalid.
23. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
24. Subject to the terms and conditions of the participating prize provider(s), if for any reason a winner does not, once the prize has been booked, take the prize or an element of the prize at the time stipulated, then the prize or that element of the prize will be forfeited and will not be redeemable for cash.
25. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
26. A draw for any daily prize, if unclaimed, may take place on 18th January 2013 at the same time and place as the original draws, subject to any directions from a regulatory authority. The winner will be notified in writing and their name will be published in The Australian on 29th January 2013.
27. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; or (e) use of a prize.
29. As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
30. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
31. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
