SAMSUNG SCAN & WIN PROMOTION
TERMS AND CONDITIONS
1. The offer and instructions on how to claim form part of these Terms and Conditions.
Participation in this Samsung Scan & Win promotion (“Promotion”) is deemed
acceptance of these Terms and Conditions. This Promotion is not valid in conjunction
with any other offer.
2. The Promotion commences at 8:00 am AEST on 23 August 2012 and closes at 6:30
pm AEST on 25 August 2012 (“Promotional Period”).

3. During the Promotional Period, claimants are offered the opportunity to claim a Prize
(defined below) at  the Samsung Experience Store, located at 450 George Street,

Sydney, NSW 2000  (the  "Samsung Experience Store").  Prizes may be claimed
during store trading hours, which are 8:00 am AEST to 9:00 pm AEST on 23 August
2012 and 8:00 am AEST to 6:30 pm AEST on 24 and 25 August 2012.
4. To be eligible to claim a Prize (defined below), claimants must:
a) be the recipient of a Scan & Win flyer in relation to the Promotion, containing
a black and white 'augmented reality marker', which will be distributed at
various locations throughout Sydney between 20 August 2012 and 25 August
2012 (a "Promotion Flyer");

b) be  an Australian resident and  not an  employee of the  Promoter, of  any
participating  agency associated with this Promotion, or an immediate family
member of the same (where “immediate family member” means: spouse,
ex-spouse, de-facto spouse, child or step-child (whether natural or by
adoption), parent,  step-parent, grandparent, step-grandparent, uncle, aunt,
niece, nephew, brother, sister, step-brother, step-sister or first cousin); and
c) not have already claimed a Prize during the Promotional Period (only one (1)
entry permitted per claimant),
(hereafter referred to as “Eligible Claimants”).
5. To claim, Eligible Claimants must follow the steps below:
a) during the Promotional Period, visit the Samsung Experience Store with their
Promotion Flyer;
b) scan their Promotion Flyer at the designated screen, located  within the
Samsung Experience Store front window on the George Street side entrance;
c) after scanning the Promotion Flyer, await the message on the display screen,
which will inform the claimant of what randomly allocated Prize he or she has
won, at which point a photograph will also be taken of the claimant and the
Prize message;[5932286: 9893245_1]
d) proceed  inside the Samsung Experience Store, where a Samsung
representative will hand the claimant the photo, along with a voucher,
indicating the Prize to be awarded;
e) present their photo and Prize voucher to the relevant Samsung representative
in order to redeem the Prize
(all Prizes with the exception of the Samsung
Series 8 64” Plasma TV (Samsung TV) will be awarded to the Eligible
Claimant at the time of redemption.  Eligible Claimants who have been
awarded the Samsung TV will be required to provide their full name, address,
contact number and email address at the time of redemption and will receive
their Prize within twenty-eight (28) days’ of the date of redemption); and
f) follow any other reasonable directions provided by Samsung representatives
in relation to the claim process.
6. Claimants who scan their Promotion Flyer at the designated screen will have their
photograph taken (as set out in clause 5.Error! Reference source not found.c)).
Claimants acknowledge and consent to such photographs being posted online,
including directly to the Promoter's Facebook Page, and to the photographs
otherwise being used by the Promoter, including in the manner set out in this clause.
Claimants consent to the Promoter taking their photograph in order to administer the
distribution of Prizes as part of the Promotion. Claimants consent to the Promoter
using their name, likeness, image and/or voice in the event they are a claimant
(including photograph, film and/or recording of the same) in any media for an
unlimited period without remuneration for the purpose of promoting this Promotion
(including any outcome), and promoting any products manufactured, distributed
and/or supplied by the Promoter. Potential claimants who do not agree to this
condition must not participate in the Promotion. Claimants should direct any request
to opt out, access, update or correct information to the Promoter at the contact
details set out below, in clause Error! Reference source not found.18.   
7. In order to receive a Prize, each Eligible Claimant must complete the steps outlined
in clause 5, above, on the same day. It is the responsibility of each Eligible Claimant
to complete these steps. If, for any reason, an Eligible Claimant does not redeem and
accept the Prize or any part of the Prize by the time stipulated by the Promoter, then
the Prize or that part of the Prize will be forfeited.
8. All eligible claims submitted by Eligible Claimants at the Samsung Experience Store
will each receive a randomly allocated prize, valued at between AUS $1.00 RRP and
AUS $1,899.00 RRP ("Prize")

The Prize values are correct as at the time of printing and the Promoter accepts no
responsibility for any variation in Prize value. The total Prize pool is valued at
approximately RRP  $70,000.  Prizes are not transferable or exchangeable and are
not redeemable for cash. Standard Promoter warranty conditions will apply to each
Prize.
9. The Promoter reserves the right, at any time, to verify the validity of claims and
claimants and to disqualify any claimant who submits a claim that is incorrect, not in
accordance with these Terms and Conditions or who tampers with the claim process.
Failure by the Promoter to enforce any of its rights at any stage does not constitute a
waiver of those rights.
10. The Promoter’s decision is final and no correspondence will be entered into.
11. If any Prize is unavailable, the Promoter, in its absolute discretion, reserves the right
to substitute the Prize with a prize of equivalent or superior specification and value,
subject to any written directions from a regulatory authority.
12. Any costs associated with  claiming or  using  a Prize are  the Eligible Claimant’s
responsibility.
13. Eligible Claimants  who have been awarded the Samsung TV are responsible for
ensuring their correct contact address details are provided and any updated details
are notified to the Promoter. The Promoter accepts no responsibility should an
Eligible Claimant fail to receive their Prize because of a failure to notify the Promoter
of a change to these details.
14. If this Promotion is interfered with in any way or is not capable of being conducted as
reasonably anticipated due to any reason beyond the reasonable control of the
Promoter, including but not limited to, technical difficulties, unauthorised intervention
or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent
permitted by law to: (a) disqualify any claimant; or (b) subject to any written directions
from a regulatory authority, modify, suspend, terminate or cancel the Promotion, as
appropriate.
15. Subject to clause  16, the Promoter (including its officers, employees and agents)
excludes all liability (including negligence), for any personal injury; or any loss or [5932286: 9893245_1]
damage (including loss of opportunity); whether direct, indirect, special or
consequential, arising in any way out of the Promotion, including, but not limited to,
where arising out of the following: (a) any technical difficulties or equipment
malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised
access or third party interference; (c) any claim, original purchase documentation or
Prize  that is late, lost, altered, damaged or misdirected (whether or not after their
receipt by the Promoter) due to any reason beyond the reasonable control of the
Promoter; (d) any tax liability incurred by a claimant; or (e) use of any Prize.
16. Nothing in these Terms and Conditions is intended to exclude, restrict or modify any
consumer rights under the Competition and Consumer Act 2010 (Cth) (“CCA”) or any
other legislation which may not be excluded, restricted or modified by agreement. If
the CCA or any other legislation implies a condition, warranty or term into the Terms
and Conditions or provides statutory guarantees in connection with these Terms and
Conditions, in respect of goods and services supplied (if any), the Promoter's liability
for breach of such a condition, warranty, other term or guarantee is limited to (at the
Promoter's election) to the extent it is able to do so: (1) in the case of supply of
goods, the Promoter doing any one or more of the following: (a) replacing the goods
or supplying equivalent goods; (b) repairing the goods; (c) paying the cost of
replacing the goods or of acquiring equivalent goods; and/or (d) paying the cost of
having the goods repaired; or (2) in the case of supply of services, the Promoter
doing either or both of the following; (a) supply the services again; and/or (b) paying
the cost of having the services supplied again.
17. The Promoter may collect personal information in order to conduct the Promotion and
may, disclose such personal information to third parties, including, but not limited to,
agents, contractors, service providers, suppliers and  if required, to Australian
regulatory authorities. Validity of a claim is conditional on providing this information.
The Promoter may, for an indefinite period, unless otherwise advised, use the
personal  information for promotional, marketing, publicity, research and profiling
purposes, including sending electronic messages or telephoning the claimant. The
Promoter may provide personal information to third parties for promotional and
marketing purposes. Claimants should direct any request to access, update correct
information or to opt out of promotional and marketing material to the Promoter. All

I waited in the line for about 20 mins this morning and it only moved through about a dozen people, the whole process is so SLOW I left. I honestly wouldn't event bother with this one.
