TERMS AND CONDITIONS


1. Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.

2. The competition is a game of skill in which chance will play no part in determining the winner.

3. Entry is open to:
i) All residents of Australia

4. Employees and their immediate families of The Premium Movie Partnership, FOXTEL, OPTUS, Paramount Pictures and their associated agencies and companies are not eligible to enter.

5. Entrants must be:

i) Entry is open to all ages. However entrants under the age of 18 must obtain the prior permission of a parent or legal guardian over the age of 18 to enter.

6. The competition commences on 30.08.12 at 12.00noon AEST and concludes on 22.09.12 at 11.59pm AEST.

7. To enter, participants must during the Promotion Period:
For online entry:
a) log on to the website [www.showtime.com.au] ; and
b) click on the Madagascar 3: Europe’s Most Wanted competition link; and
c) answer in 25 words or less “Which Madagascar character is your favourite and why?”; and
d) complete all of the required data fields on the entry form.

8. An entrant’s Entry Material must not be:
a) late;
b) delayed;
c) incomplete;
d) incomprehensible;
e) unlawful;
f) obscene;
g) defamatory;
h) libellous;
i) threatening;
j) pornographic;
k) harassing;
l) hateful;
m) racially or ethnically offensive;
n) capable of encouraging conduct that would be considered a criminal offence;
o) capable of violating any law; and/or
p) capable of giving rise to civil liability.

9. Any Entry Material that breaches clause 8 will not be published, and the entrant will be disqualified from the Promotion. The Promoter will decide whether any Entry Material breaches clause 8 in its sole discretion. The Promoter’s decision is final and no correspondence will be entered into.

10. Entry to the Promotion is limited to 1 entry per Entrant per person over the entire Promotion Period.

11. Only 1 prize will be awarded per person over the entire Promotion Period.

12. Entrants warrant to the Promoter that their entry is original and does not infringe any third party intellectual property rights, including copyright and moral rights.

13. Entrants retain all ownership rights in their Entry Material. However, by submitting Entry Material to the Promotion, Entrants hereby grant the Promoter and Supplier an irrevocable, non-exclusive, world-wide, royalty free, sub-licensable and transferable license to use, reproduce, distribute, prepare derivative works of and display the Entry Material for the purposes of conducting and promoting this Promotion and advertising and marketing the Promoter and/or the Supplier on all media now known or later devised, in perpetuity.

14. By entering the Promotion, Entrants irrevocably waive any and all moral rights they have in the Entry Material they submit, and consent to the Promoter and Supplier doing or failing to do any act in relation to the Entry Material that may, except for this clause, infringe an Entrant’s moral rights in the Entry Material including, without limitation:
(i) exercising any of the rights in the Entry Material without identifying the entrant; and
(ii) using the Entry Material in any way that the Promoter sees fit, even if it results in derogatory treatment of the Entry Material (as defined in the Copyright Act 1968 (Cth).

15. The Promoter will, in its absolute discretion, select the entries to be published on the Website. The Promoter reserves the right to disqualify from the Promotion and refuse to publish, any Entry Material that the Promoter reasonably believes infringes any third party’s intellectual property rights.

16. The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.

17. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill or store receipt for purchase requirement) in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

18. Entries must be received by 11.59pm AEST on 22.09.12. The time of entry will in each case be the time the entry is received by the Promoter’s database. The Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason.

19. The cost of accessing the promotional website will be dependant on the entrant’s individual Internet Service Provider.

20. Any entry that is made on behalf of an Entrant by a third party, or otherwise by proxy, will be invalid.

21. Entrants must make their entries manually using an internet browser. The Promoter may reject an entry if it reasonably forms the opinion that the entry has been made using automated entry means or by use of a computer entry service.

22. Prizes and values are as follows:

23. Prizes cannot be transferred, refunded or exchanged and cannot be redeemed for cash.
FOR HOLIDAY PRIZES:

24. The winner (and their companions) are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes (excluding departure and any other flight associated taxes included within the prize), energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.

25. The winner and travelling companions must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure (Sydney, Melbourne, Brisbane, Adelaide or Perth). (If the winner is from Tasmania, ACT or NT connecting flights from these cities to the nearest flight departure capital city will be included in the prize package for the winner and travelling companions only – if applicable).

26. If the winner/s is under the age of 18 at the prize judging date, an adult must accompany the minor in the participation of the prize.

27. All aspects of each Prize must be taken together as a package. The prize must be taken by 20th December 2013 and is subject to hotel and flight availability. The prize is not available during peak times such as public holidays and school holidays and blackout dates (if applicable) and cannot be changed once the booking has been made.

28. Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline.

29. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. Once accommodation vouchers are issued they are non-changeable.

30. It is the traveller’s personal responsibility to ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller/s. (if applicable)

31. The Premium Movie Partnership and Paramount Pictures make no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade. (if applicable)

32. In consideration for the Promoter awarding the prize to the winner, the winner hereby assigns to the Promoter all right, title and interest in and to all copyright in any material created pursuant to the winner’s participation in any aspect of the prize (Works). The winner acknowledges that the Promoter is free to use the Works and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use.

33. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.

34. Prize values are in Australian Dollars based upon the recommended retail prices at the time of printing (inclusive of GST). The promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

35. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.

36. Each valid entrant who has entered the competition over the duration of the Promotion Period will be entered into the pool of entries. The prize judging will take place at SHOWTIME, Level 1, Building 215, Bent Street, The Entertainment Quarter, 122 Lang Road, Moore Park, NSW 2021 on 24.08.12 at 11.00am AEST. The Winner will be the entrant who, in the sole opinion of the judges, has submitted the entry which best meets the judging criteria.

37. The Winner will be notified within 2 days of the prize judging. The Winner will be notified of their prize in writing. The Promoter reserves to right to announce the winners details on air, publish the winner on the www.showtime.com.au website and Facebook page.

38. All reasonable attempts will be made to contact the Winner. If the prize remains unclaimed by a winner or unallocated or forfeited for any reason, by 11.00am AEST on 22.10.12, the prize will be re-allocated to the entrant that has submitted the entry which best meets the judging criteria excluding the entrant that has failed to claim the prize. This unclaimed prize judging will take place at SHOWTIME, Level 1, Building 215, Bent Street, The Entertainment Quarter, 122 Lang Road, Moore Park, NSW 2021 at 11.00am AEST on 23.10.12. The Winner of the unclaimed prize judging will be notified in writing within 2 day of this judging.

39. Prizes will be awarded to person named in the entry.

40. Should an entrant’s contact details change during the Promotion Period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.

41. The promoter’s decision is final and the promoter will not enter into correspondence regarding the Competition result.

42. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.

43. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.

44. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions.

45. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

46. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

47. The Promoter and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.

48. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition.

49. STANDARD OPT-IN: All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion but no further use of this information will be made without prior consent. All opt-in entries will be entered into a database and The Promoter may use the entrant’s names, addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant. By opting-in, entrants confirm that they allow their details to be used for this purpose. If entrants no longer consent to their details being used for future marketing purposes, the entrant should contact The Promoter on their details set out below. Any request to update, modify or delete the entrant’s details should be directed to The Promoter.

50. The Promoter is collecting the entrant's personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winner). The entrant's personal information may be disclosed to a third party for this purpose. If you are not willing for this to occur you cannot participate in the Promotion.
