CONDITIONS OF ENTRY

PARTICIPATION
1.This IT GUY promotion (“Promotion”) is conducted by Estee Lauder Pty Ltd, ABN 63 008 444 719, of 165-175 Mitchell Road, Erskineville, NSW 2043 (“Promoter”).
2.The Promotion is a game of skill in which chance plays no part.
3.Entry to the Promotion constitutes acceptance of these conditions.
4.The Promotion is only open to Eligible Entrants. An "Eligible Entrant" is an individual who: i.is a male resident of Australia aged between 18 and 60 years of age (inclusive) at the time of her entry;
ii.is not an employee of the Promoter or any of its related corporations or any of their agencies associated with the Promotion; and
iii.is not a spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of an excluded employee.

5.Promotion entry opens at 9am on 10/09/12 and ends at 5pm on 28/09/12 ("Entry Period"). All times and dates are times and dates in Sydney which may be AEST or AEDT depending on the date.

6.The Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook.
7.By entering the Promotion, each entrant releases Facebook, Inc from any and all liability to the entrant arising in any way from the conduct of the Promotion.
8.All information provided by an entrant is provided to the Promoter and not to Facebook.

ENTRY TO THE PROMOTION
9.An Eligible Entrant may enter, or be entered, only once. If an Eligible Entrant is entered more than once, all entries and nominations after the first will be disregarded.
10.To submit an entry, an entrant or their nominator (“Nominator”) must, during the Entry Period, use a compatible browser to visit www.facebook.com/cliniqueaustralia (the “Promotion Website”) and follow the directions there.
11.An entrant who is submitting their own entry must: a.upload a photo of themself, and no one else (“Uploaded Photo”),
b.describe in 25 words, or less, why they should be the Clinique 2013 IT Guy (“Statement”);
c.provide the information requested, including: their first name and last name, age, address, email address and telephone number;
d.confirm that they agrees to the terms of the release provided; and
e.agree to these Conditions, and the representations, warranties and indemnities made in the “Entry Requirements”.

12.An Nominator who is submitting an entry on behalf of an Eligible Entrant must: a.upload a photo of the nominated Eligible Entrant, and no one else (“Uploaded Photo”),
b.describe in 25 words, or less, why their nominated Eligible Entrant should be the Clinique 2013 IT Guy (“Statement”);
c.provide the information requested, including for both the Nominator and their nominated Eligible Entrant, first name and last name, age, address, email address and telephone number;
d.confirm that they agree to the terms of the release provided; and
e.agree to these Conditions, and the representations, warranties and indemnities made in the “Entry Requirements”.

13.An Uploaded Photo must: i.be original;
ii.not previously have been shown to the public or a substantial number of members of the public;
iii.not, in whole or in part, have been submitted as an entry in any other competition; and
iv.be uploaded in a format that complies with the requirements stated at the Promotion Website.

14.The Uploaded Photo and/or Statement in an entry, the entrant’s first name and the Australian State or Territory in which the entrant resides, may be displayed on (i) http://www.youtube.com/user/CliniqueItGirls, and/or (ii) www.facebook.com/cliniqueaustralia and/or (iii) www.clinique.com.au after the entry has been received and during the Entry Period. The Promoter may also post the Uploaded Photo and/or Statement contained in an entry on one, or more, websites, including any of the above websites, for public viewing for up to 1 year after the Entry Period.
15.The Promoter may decline to judge an entrant’s Uploaded Photo and/or Statement if, in the Promoter's opinion, the Uploaded Photo and/or Statement contains any material which may: i.cause offence to any person or group of persons;
ii.infringe the rights (including intellectual property rights, performer's rights or rights of reputation) of any person, whether as a result of being communicated to the public or otherwise; or
iii.promote or depict illegal or negligent activity.

16.All entrants must ensure that their entries are received by the Promoter during the Entry Period. The Promoter takes no responsibility for late or misdirected entries or for any delays or failures in any delivery service or equipment.
17.All entries to the Promotion may be subject to verification and confirmation by the Promoter. An entrant MUST deliver to the Promoter (by a means determined by the Promoter) copies of any documents the Promoter may request establishing eligibility to enter or win, including evidence of age, residence or identity. The Promoter may make one or more requests for such documents. Once the identity of documents available is established, an entrant must deliver requested copies within 7 days of being asked to do so. At the Promoter's request, an entrant MUST also, within 7 days of being asked, allow the Promoter to inspect and copy the original of any such document.
18.The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant: (i) fails to establish their entitlement to enter the Promotion to the Promoter's satisfaction; or (ii) fails to produce items as required by condition 17 or produces items that, in the Promoter's reasonable opinion, are illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way; or (iii) in the Promoter's reasonable opinion, tampers with the entry process or benefits from such tampering; or (iv) in the Promoter's reasonable opinion, submits an entry which is not in accordance with these conditions.

WINNERS GENERALLY
19.The Promotion is a game of skill in which chance plays no part in determining the winners.
20.As detailed below, prizes will be awarded to: i.all Eligible Entrants OR if an Eligible Entrant was nominated by someone else, to their Nominator.
ii.the Eligible Entrants or Nominators who submitted the first 100 entries;
iii.3 Finalists; and
iv.1 Major Prize Winner.

21.In order to be entitled to a prize, the winner if requested by the Promoter, agree to and sign: i.an eligibility form confirming their compliance with the Conditions and eligibility to accept the prize; and
ii.a liability release, waiver and/or indemnity in favour of the Promoter and/or any person or other entity associated with this Promotion.
 A winner who does not comply with this condition forfeits their prize.

ENTRANTS/ NOMINATORS AND PRIZES
22.Prizes will be awarded to the entrants/nominators who submitted valid entries as follows (limit one prize per entrant/nominator): i.each person who submits one of the first 100 entries received will be awarded a “First 100 Prize” comprising 1 x M Lotion, and 1 x Chubby Stick. (Accordingly, if an entrant submits their own entry and it is one of the first 100 entries received, the entrant will be awarded a First 100 Prize; If an entrant is nominated by a Nominator, the Nominator and not the entrant will be awarded the First 100 Prize.)


FINALISTS AND THEIR PRIZES
23.Subject to condition 15, the Statements and Uploaded Photos in the entries will be progressively judged as the entries are received.
24.In each entry: i.the Statement will be judged on creativity (more creative is better);
ii.the Uploaded Photo will be judged on the entrant’s style and presentation; and
iii.equal weighting will be giving to the judging of the Statement and the Uploaded Photo.

25.The entrants whose entries are judged to be the 3 best according to the judging criteria (each a “Finalist”) will each: i.be invited to: a.attend a styling shoot in Sydney with FrontRowSuit – finalists must be available on the weekend of Oct 13th & 14th to attend this in Sydney. Flights & accommodation will be covered by Clinique.
b.confirm that if chosen as a Finalist, they will be willing to trial CLINIQUE products over 2013 and to contribute monthly reviews in video format for posting on: (i) Clinique.com.au (ii) http://www.youtube.com/ , and (iii) www.facebook.com/cliniqueaustralia.

ii.be awarded: a.1 x $300 Clinique SSFM Pack
b.1 x $150 Saba Voucher
c.1 x styled shoot with FrontRowSuit – where finalist is not Sydney based, Clinique will cover the finalists flights & accommodation.



MAJOR PRIZE WINNER AND THEIR PRIZE
26.The Styled Shoot images & Video of each of the Finalists will be published on: (i) Clinique.com.au (ii) http://www.youtube.com/user/, and (iii) www.facebook.com/cliniqueaustralia from 9am on 24/10/12 until 5pm on 14/11/12. During that period, members of the public may vote at www.facebook.com/cliniqueaustralia for one, or more, Finalist It Guys
27.The Finalist who received the most votes will be the Major Prize Winner. If there is a tie, the Promoter will determine the Major Prize Winner from the tied Finalists by choosing the Styled Shoot images & Video that it considers to be the most creative.)
28.The Major Prize Winner will be published on Clinique Facebook on 16/11/12.
29.The Major Prize Winner will be awarded: i.the title “2013 It Guy”;
ii.1 x $500 Skin Clinique Gift Pack ;
iii.1 x $500 Skin Clinique Gift Pack
iv.1 x $300 Saba Gift Voucher
v.1 x The Man Plan Book
vi.the opportunity to trial CLINIQUE products over a 12 month period and to contribute monthly reviews in video format for posting on: (i) Clinique.com.au (ii) http://www.youtube.com/user/CliniqueItGirls, and (iii) www.facebook.com/cliniqueaustralia.

30.If the Major Prize Winner was entered by a Nominator, that Nominator will also be awarded a selection of CLINIQUE products of the Promoter’s choosing valued at $500.

GENERAL
31.If for any reason the conduct or operation of the Promotion is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Promotion.
32.The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant, (ii) any theft, destruction or unauthorised access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Promotion; (iv) any incorrect or incomplete information which may be communicated in the course of the administering this Promotion (whether as a result of one of the foregoing causes or otherwise).
33.CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
34.All of the Promoter’s decisions are final and no correspondence will be entered into.
35.The Promoter accepts no responsibility for any tax liability incurred as a result of an entrant participating in the Promotion. Entrants should obtain independent tax and financial advice.
36.To the full extent permitted by law, the Promoter, its associated companies and agencies and any of their personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant in connection with the Promotion or prize, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. Nothing in these conditions is intended to exclude, restrict or modify an entrant’s rights under the Competition and Consumer Act 2010.
37.Each winner consent to the Promoter using their name, likeness, image and/or voice (including any photograph, film and/or recording of them) in any media at any time or times without remuneration for the purpose of promoting this Promotion, the Promoter and/or any of the Promoter's products.
38.Entrants' personal information will be collected by or on behalf of the Promoter to enable it to administer the Promotion and publicise its winners and, if an entrant consents, may be used to market its products to the entrant. The personal information of each winner may be provided to others assisting in the conduct of the Promotion, including the Promotion administrator, prize suppliers and deliverers, and to regulatory authorities. Persons may contact the Promoter at the address in condition 1 to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an entrant does not provide accurate personal information the Promoter may determine that they are not eligible to win a prize.
