Terms & ConditionsThis document sets out the terms of participation in Coty Australia’s Magnetic Nail Color competition (the "Competition").
Eligibility
1. The promoter of the Competition is Coty Australia Pty Ltd (the "Promoter") (ABN 960 586 549 ) of Level 31, 1 Market Street, Sydney, NSW, 2000.
2. The Competition is open to all Australian residents who are 13 years of age or over. An entrant must be an individual and not a company or organisation. Employees of the Promoter and their immediate families and any organisation or individual associated with the provision of the prize(s) are not eligible to enter.
3. Each entry must be made in accordance with these Terms and Conditions. By entering the Competition, you agree to be bound by these Terms and Conditions. The Promoter may in its discretion refuse to award any prize to any entrant who fails to comply with these Terms and Conditions. All relevant instructions on the Promoter's website form part of these Terms and Conditions.
4. Entry into the Competition is free.

5. The Competition opens at 12:01am Sunday 2 September 2012 and closes at 11:59pm (AEST) on Sunday 30 September 2012 ("Competition Period"). Any entry or vote received after the Competition Period will be deemed invalid. No responsibility is accepted for late, lost, delayed or incorrect entries.
6. At the conclusion of the Competition Period, the entries will be judged by The Promoter. Judging will be based on the following criteria: Portrayal of the Sally Hansen Brand; quality of the response; and, creativity/originality.
7. All times referred to in these Terms and Conditions are in AEST.
How to Enter
8. To enter the Competition you must:
a. Like us on Facebook (
www.facebook.com/sallyhansenaus) (and therefore become our “Fan”).
b. Complete and submit the official entry form on the Magnetic Nail Color competition page accessed from
www.facebook.com/sallyhansenaus (the “Competition Page”), including your full name, postal address, email address and mobile phone number.
c. Agree to these Terms and Conditions on the Competition Page (
www.facebook.com/sallyhansenaus).
How to win
9. There will be 10 winning entries. The 10 most creative and original responses to the ‘25 words or less’ question entered in during the Competition Period, as decided by the Promoter at the conclusion of the Competition, will be the winning entries. Refer to Term and Condition (6) in this document.
10. Each of the ten (10) winners will receive the full range of Magnetic Nail Color shades (8 shades in total), plus a Salon Manicure Base Coat and a Salon Manicure Top Coat. Total prize valued at $169.50.
11. You may only enter once.
12. No element of chance is used to determine the winning entries for the Competition.
13. If your entry is judged and chosen as a winning entry:
a. The Promoter will then contact you, either by phone or email, to verify your identity.
b. If the Promoter is not able to contact you within 72 hours, you will forfeit the prize and it will be awarded to the entrant with the next best photo as judged by the Promoter.
c. The Promoter may request that you provide photo identification prior to the Promoter sending your prize.
General
14. The total maximum prize pool of the Competition is AU $1,695.00.
15. The Promoter takes no responsibility for any variation in prize value.
16. No component of the prizes can be transferred or redeemed for cash. In the event that any of the prizes become unavailable due to circumstances beyond the Promoter's control, the Promoter reserves the right to provide a similar product to the same or greater value as the original prize, subject to any applicable laws or written directions made under applicable legislation.
17. By entering the Competition, you warrant that you will submit ONLY your own original response and that your entry is not derived or copied from the intellectual property of a third party. Your entry cannot be previously published in any forum worldwide. All entries become the property of the Promoter and cannot be returned. Entries that are found to have been derived or copied from the intellectual property of a third party will be considered invalid and, if awarded a prize, that prize must be returned to the Promoter. Entrants may be required to sign a statutory declaration regarding the originality of the entry. Without limiting the generality, the Promoter reserves the right to take legal action against anyone found to have breached this term. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion.
18. The Promoter’s legal rights to recover damages or other compensation are reserved.
19. You agree that the Promoter may use your entry and any personal details provided to the Promoter for any promotional, marketing and publicity purposes of the Promoter in any media without notice and without any fee being paid to you.
20. Decisions of the Promoter are final and will be binding on each person who enters the Competition and no correspondence will be entered into.
21. If there is any event that prevents or hinders the Promoter's conduct of the Competition or the Promoter's ability to deliver the prize to the prize winners, the Promoter may, in its discretion, cancel the Competition and may recommence it at another time under the same or various conditions.
22. The Promoter is not responsible for any incorrect or inaccurate information, or for any of the equipment or programming associated with or utilised in the Competition, or for any technical error that may occur in the course of the administration of the Competition (including in the voting). The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.
23. To the full extent permitted by the law, the Promoter will not be liable for any injury, damages, expenses, or losses whatsoever (whether direct or inconsequential) in relation to the competition or with respect to any matter relating there to or arising there from.
24. By entering the Competition, you acknowledge that:
a. You provide both the Promoter and Facebook with a complete release from any liability arising in connection with the Promoter.
b. The Competition is in no way sponsored, endorsed or administered by, or associated with Facebook.
c. Any information you provide to the Promoter in relation to this Competition you are providing to the Promoter, and not to Facebook.
25. The Promoter respects your personal information (PI). All PI collected by the Promoter will be dealt with under the Coty Australia privacy policy which can be viewed here
http://www.coty.com/privacy-policy or sent to any person on request. PI is collected to enable the Promoter to administer and promote this Competition and the winners. The Promoter may also use PI collected for future promotional, marketing and publicity purposes. Any person is entitled to contact the Promoter and request access to any PI the Promoter holds about them, at any time. If an entrant does not truthfully provide all the requested PI on the competition entry form they may not be eligible to enter this Competition or win any prize.
