THE EDIT Issue 3: Things We Love Competition (the Competition)
TERMS AND CONDITIONS

1. All information published by the Promoter concerning entry into the Competition and Competition prizes forms part of these terms and conditions of entry. Entry into the draw is deemed acceptance of these terms and conditions of entry. Entry is via an online entry form at www.betts.com.au/thingswelove.

2. The promoter of the Competition is Betts Group Pty Ltd (ABN 41 008 675 929) of 32 Millrose Drive, Malaga, Western Australia (the Promoter).

3. It is a condition of the Competition that the participant is an Australian resident and that if under 18 years of age they have permission from their legal parent or guardian to enter the Competition. The major prize is to be accepted by the participant’s legal guardian who is over 18 years of age. Employees and relatives (as defined by the Corporations Act 2001 (the Act) of employees of:

3.1. the Promoter;
3.2. service providers associated with the Competition; and
3.3. a related party or associated entity (as defined in the Act) of the persons specified in paragraph 3.1 and 3.2 above,are not eligible to enter the Competition.

4. To successfully enter the Competition, participants are required to:
4.1. log onto www.betts.com.au/thingswelove, and provide their details including name, date of birth, address, phone number and e-mail address.

Once complete and valid, online registration will provide the participant one entry in the draw. Incomplete, incorrect and incomprehensible answers and details will, at the sole and absolute discretion of the Promoter, invalidate the participant’s entry into the Competition.

5. Each participant may only enter the Competition once. Multiple registrations will not provide multiple entries. Any participant who completes more than one online registration form per person will have all entries, apart from their original entry, deemed invalid.

6. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following:
6.1. Any technical difficulties or equipment malfunction (whether or not under the Promoter’s control).
6.2. Any theft, unauthorised access or third party interference.
6.3. Any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter.
6.4. Any variation in prize value to that stated in these Terms and Conditions.
6.5. Any tax liability incurred by a winner or entrant.
6.6. Use of a prize.

7. The Competition commences on Monday 17 September 2012 at 5.00pm AWST. All online registrations must be received by 5:00pm (AWST) on Friday 5 October 2012. All registrations are deemed to be received at the time of receipt into the Promoter’s database, and not at the time of transmission by the participant.

8. The prize draws will take place at the premises of Betts Group Pty Ltd, 32 Millrose Dr, Malaga WA 6090 at 11:30am (AWST) on Wednesday 10 October 2012. The draws will take place via an electronic drawing system and the winners will be determined by chance. All winners will be notified in writing (email) of their win and have their details published on www.betts.com.au. All Kelly Clarkson concert ticket winners will also be notified by telephone.

9. The prizes are:
9.1. 1 of 50 Double Passes to see The Intouchables in cinema, valued at $37 each.
9.2. 1 of 4 Alister Yiap ‘Roses are Red’ necklaces valued at $39 each.
9.3. 1 of 5 framed Betts shoes signed by Sarah De Bono, valued at $250 each.
9.4. 1 of 2 Cooper St mint jumpers valued at $89.95 each.
9.5. 1 of 5 Double Gold Tickets for Kelly Clarkson’s ‘Stronger’ national tour.
9.5.1. 1 x double to Sydney show Thursday 27 September, 2012 (comp closes 24 September 2012)
9.5.2. 1 x double to Melbourne show Monday 1 October, 2012 (comp closes 27 September 2012)
9.5.3. 1 x double to Adelaide show Wednesday 3 October, 2012 (comp closes 28 September 2012)
9.5.4. 1 x double to Perth show Friday 5 October, 2012 (comp closes 1 October 2012)
9.5.5. 1 x double to Brisbane show Thursday 25 October, 2012 (comp closes 5 October 2012)

10. The total prize pool is valued at AU$4,625.90.

11. Cash will not be awarded in lieu of the prizes or any element thereof.

12. The Kelly Clarkson concert tickets must be claimed by no later than 4:00pm AWST the day prior to each show. In the event that the tickets are not claimed by the winner of the respective shows, a second draw will take place at 4:15pm and the newly drawn winner will be notified by telephone at 4:30pm AWST.

13.

14. All other prizes must be claimed by 2:00pm (AWST) by Friday 11 January 2013 and if a prize remains unallocated or unclaimed, a further draw will be conducted on that day at the same time and place as the original draw (subject to any directions given under all State Regulations). In the event of a re-drawn winner, their details will be published www.betts.com.au on the afternoon of Friday 11 January 2013.

15. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed (the Publications).

16. In consideration for the Promoter awarding the prize to the winner, the winner hereby agrees:
16.1. that he or she has no right of attribution or integrity of authorship with respect to the Publications; and

17. The Promoter’s decision is final and binding and no correspondence will be entered into.

18. Prizes are not exchangeable or transferable and cannot be taken for cash.

19. The Promoter and each of their related bodies corporate, associated agencies and companies associated with the Competition will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with the Competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

20. Should a participant’s contact details change during the Competition period, it is the participant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.

21. The Promoter, companies associated with the Competition and related parties and associated entities (as defined in the Act) thereof take no responsibility for any delays caused by airlines, natural disasters, acts of God, civil unrest, strikes and will not provide compensation for any such delays.

22. The Promoter reserves the right to request winners to provide proof of identity, Australian residency, residency at the nominated residential address and/or entry validity. Proof of identification, residency and entry considered suitable for verification is at the sole and absolute discretion of the Promoter. In the event that a winner cannot provide suitable proof of identity, the winner will forfeit their prize in whole and no substitute will be offered.

23. All entries become the property of the Promoter. The Promoter collects personal information about participants to enable participants to participate in this Competition (which may include disclosure to third parties for the purpose of processing and conducting the Competition) but no further use of this information will be made without the participant’s prior consent. Each participant agrees to his or her personal information being disclosed to State and Territory Lottery Departments and being published (if he or she wins a prize) as required under the relevant lottery legislation.

24. If for any reason this Competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to any written directions from the a regulatory authority.

25. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it's determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest or strikes, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions subject to any written directions from a regulatory authority.

26. The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in the Competition by any person who tampers with or benefits from any tampering with the entry process or with the operation of the Competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.

27. The laws of the State of Western Australia, State regulatory bodies (and where applicable the Commonwealth of Australia) shall apply to the Competition.
