Terms and Conditions
The following Terms and Conditions apply to the 2012 Trafalgar Photo Competition on the Trafalgar Facebook page,
www.facebook.com/TrafalgarTravel. By entering our competition you accept these Terms and Conditions. If you do not wish to abide by these Terms and Conditions then please do not enter the competition.
With no previous warning, Terms and Conditions might be modified or updated at any time. Any of these alterations to the Terms and Conditions will be highlighted on the Website. It is your responsibility as a competition entrant to certify that you fully read and evaluate these Terms and Conditions frequently to familiarise yourself with any amendments that take place over the course of the competition. We advise strongly that you save a copy of the following Terms and Conditions for your personal future reference.
1. Entry and entrants
1.1. This competition allows all residents over the age of 18 to enter the competition. Employees of Trafalgar and members of their direct families (this also includes any live-in or long term partner), as well as all of the companies within the Travel Corporation group are ineligible to enter the competition. Any entries by these people will be invalid.
1.2 Trafalgar reserves the right to ask for proof of entrants’ or winner’s age and/or evidence to verify the identity at any time during or after the competition, and may use any appropriate means that are available to conduct checks of any of the details consequently provided.
1.3 The competition closes on Friday 7 December, 2012. Any entries received after this date will be discounted. The date and time will be set to Perth, Australia.
1.4 To successfully enter the competition, adequate and eligible entrants must complete the task as indicated in the competition information on the competition Facebook page. Unsuitable entries will be invalid.
1.5 Entrants are required to follow the instructions on the Facebook page. Entrants may be asked to supply their name, and/or email address and/or a contact telephone number and/or any other details as required on the entry form, such as the meaning within the content supplied as an entry (the country the photo was taken in, for example).
1.6 Entries must not come from third parties. Bulk entries cannot be accepted.
1.7 Any entries which are not in accordance with these competition Terms and Conditions, or that are not received by Trafalgar by the closing date (7 December, 2012) will be void.
1.8 In the event of any error, mistake, misinterpretation or disagreement (technological, human or otherwise) regarding the correctness or acceptability of any entries, the decision of Trafalgar shall be final, and no correspondence will be entered into.
1.9 Trafalgar will not be liable to compensate expenses incurred in making an entry where applicable. No refund will be made for the cost of any entry where applicable.
2. The Prizes
2.1 First Prize winner will receive a 12-day (or less) Trafalgar trip for two people based on twin share. The winner may choose any 12-day (or less) Trafalgar trip operating anywhere in the world. There is no cash or other alternative to the prize stated and the prize is not transferable and no part or parts of the prize may be substituted for other benefits, items or additions. The prize will be valid for 12 months from issue of notification. The selected entrant for the First prize (the ‘winner’) and his or her guest shall be responsible for all flights, insurance (including without limitation, travel and medical insurance) for the duration of the trip, transportation to and from the winner’s place of residence to the closest international airport, gratuities, all meals, applicable taxes, pre and/or post tour accommodations if applicable, optional excursions, spending money, entrance fees, flight cost, air taxes and overweight baggage fees if required, incidentals and any and all other expenses not specified in the above description of the First prize. Winner and guest must follow all instructions of Trafalgar staff or participation in the First Prize may be forfeited, in whole or in part. Winner and guest must travel together and depart from the same location. Winner and guest are responsible for ensuring that all travel papers (including but not limited to passport and travel visas) required for travel to the Destination are in good order, and are valid prior to, and for the entire duration of, the prize period. Trafalgar will not be held responsible if the prize winner is refused entry into the destination by Government or boarder security authorities and no alternative prize will be awarded. Prize redemption and trip booking must be made directly with Trafalgar, quoting the Promo # provided.
2.2 Second and Third (Runner Up) prize winners will each receive a US$500 Trafalgar voucher. The voucher will be valid for 12 months. There is no cash or other alternative to the prize stated and the prize is not transferable and no part or parts of the prize may be substituted for other benefits, items or additions. The prize cannot be used on existing bookings or in conjunction with any other discounts or special offers. The prize must go towards the land only portion of the trip. Prize redemption and trip booking must be made directly with Trafalgar, quoting the Promo # provided. The currency conversion rate is based on the standing rates on April 24 2012. Rates have been rounded up to the dollar value and are as follows:

If your country’s currency is not listed above, Trafalgar will convert the prize money on the day of notification of the prize.
2.3 Three (3) Spot prize winners will each receive a Pentax Optio WG-2 Adventure Proof Digital Camera.
2.4 One First prize and two Runner Up prizes will be awarded on 11th December 2012. The first will be chosen on 27 June 2012, the second on 29 August 2012 and the third on 31 October 2012.
2.5 The First prize winner will be contacted on the email that the entrant used to enter the competition. The winner will have a two (2) week time period in which they have to claim his or her prize. Failure to reply or respond within this stated fixed time as specified and/or failure to provide an address for delivery of the prize (if deliverable) may result in forfeiture of the prize. If successful contact is not made in the first place, or the chosen winner does not respond or reply within two (2) weeks, Trafalgar reserves the right to offer the prize to the next eligible entrant and thereafter, until a contactable winner is established and confirmed. The prize will be sent within 28 days to the address provided by the winner once contacted by Trafalgar following the announcement of the winner.
2.6 Trafalgar may decline to supply the prize, in the event of non-entitlement under these Terms and Conditions or an entrant's breach of these terms, including fraud or dishonesty.
2.7 Trafalgar reserves the right in its exclusive judgement to deny delivery of the prize until such proof of eligibility and/or identity has been confirmed or to disqualify the entrant from the competition if they have not complied to the Terms and Conditions.
2.8 Trafalgar endeavours to deliver the prize to the runner up and spot prize winners within twenty eight (28) days from the date of the winner(s) confirming their acknowledgement of their winning, i.e. the date that Trafalgar manages to contact the winner(s) and received confirmation of eligibility, unless otherwise specified in the individual competition's Terms and Conditions. Delivery restrictions or limitations may apply.
2.9 No cash equivalent (where applicable), replacement or alternative prize will be given to the winner, and the prize is non-transferable and non-exchangeable. However, in the event of circumstances beyond its control Trafalgar reserves the right to change or amend the prize and/or to offer a substitute of comparable worth or cost.
3. Judging
Judging will apply to determine the winners of each prize. Each photograph will be individually judged based on originality, creativity and artistic merit. Judges will be the Online Marketing Manager, Online Marketing Specialist and other members of the Trafalgar marketing team. Trafalgar’s decision in relation to all aspects of this Competition is final and binding on all who enter and no correspondence will be entered into. A list of winning entrants is also available by sending a request and self-addressed, stamped envelope to Trafalgar Travel, Level 1, 74 Wittenoom Street East Perth, WA, 6004, Australia.
4. Data Protection
4.1 Trafalgar (or any third party nominated by Trafalgar) may implement its exclusive discretion to use the winner’s (and if applicable their companion’s) name and image, and their comments relating to the prize and competition experience, as well as the winning content submitted including any photos, writing or images for future promotional, editorial, campaign, marketing, sales and publicity purposes in any media worldwide without notice or without any fee being paid.
4.2 Information and personal data which is provided by entrants when they enter will be contained and handled by Trafalgar and The Travel Corporation and their suppliers and contractors in order to successfully manage the competition. Entrants’ personal data may also be passed to relevant regulatory bodies, the police or other authorities in the course of the investigation of any complaints or suspected unlawful activity. Collective, non-personal data may also be used for the purpose of market research or in facilitating reviews, developments and improvements to relevant services.
4.3 Any personal data will only otherwise be used in accordance with Trafalgar’s Privacy Policy and the Promoter’s (where different). Trafalgar’s Privacy Policy can be viewed at the following links for your region: United States, Canada, United Kingdom, Australia, New Zealand, South Africa, Europe, and the Rest of the World. Trafalgar will only use an entrant’s data for prize notification and/or for the delivery of the Trafalgar online eNewsletter if that entrant has selected to receive it by opting-in on the entry form.
5. Liability
5.1 Nothing in these Terms and Conditions restricts your statutory rights as a consumer. For more details on your statutory rights you should contact your local Trading Standards Office or Citizen's Advice Bureau or its counterpart in your province or other jurisdiction.
5.2 Nothing in these Terms and Conditions shall exclude or limit Trafalgar’s or the Travel Corporation’s liability for death or personal injury caused by their staff or supplier’s negligence or for fraud.
5.3 Subject to clause 5.2, Trafalgar does not accept responsibility for any fault, malfunction, damage, loss or disappointment suffered by any entrant which could arise from participating in the competition or of accepting any prize whether due to any error, omission or other cause by Trafalgar, its employees, agents or others to the fullest extent permitted by law.
5.4 Trafalgar is not responsible for any damage or loss caused to an entrant where such damage or loss is not reasonably foreseeable to the entrant and to Trafalgar when the entrant agrees to these Terms and Conditions (which occurs automatically when you enter the competition), including where the damage or loss results from Trafalgar’s breach of these Terms and Conditions.
5.5 Trafalgar cannot promise that the services relating to the competition will be free from errors or omissions nor that they will be available uninterrupted and in a fully operating condition. These services may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons reasonably beyond the control of the company. Trafalgar will not be liable to you or to any other person in the event that all or any part of the service relating to the competition is discontinued, modified or changed in any way.
5.6 You agree to reimburse Trafalgar in respect of any damages suffered by the company or any losses by the company resulting from any claim made by a third party in each case in respect of any matter arising from your use of the services relating to the competition in breach of these Terms and Conditions or from your violation of any applicable law or regulation.
6. Standard terms
6.1 In the event that any entrant does not, or is unable to, comply with and meet these Terms and Conditions, Trafalgar shall be entitled at its sole discretion to disqualify such entrant, without any further liability to such entrant. Any entrant must comply with any directions given to him or her by Trafalgar including but not limited to any and all relevant laws, rules and regulations.
6.2 These Terms and Conditions are available in English only and shall be exclusively governed by and construed in accordance with the laws of the state of California, which shall have exclusive jurisdiction in the case of any dispute between the parties.
6.3 These Terms and Conditions were last updated on 4 May 2012.
7. Entry Fee: Entry is free and no purchase is necessary.
8. Eligibility: Open to all photographers over 18 years of age worldwide. Entrants may be professionals or non-professionals.
Winners are responsible for ensuring they are able to accept the prize as set out and in accordance with these Terms and Conditions. In the event the winners are unable to do so then Trafalgar reserves the right to re-award the prize.
9. Deadline: Submissions will be accepted from 12:01am Perth, Australia on 9 June, 2012 through 23:59 7 December, 2012.
10. Original Photographs Only: Only original photographs that (a) you have taken, (b) that do not infringe any other person’s intellectual property rights, (c) that have not been altered or photoshopped (excluding minor colour corrections) and (d) that have not been previously published can be submitted.
11. Submission Details: Both colour and black and white pictures are accepted. Please submit all images via Facebook. Only JPEG files will be accepted.
12. Consent to Publication: By entering, any subsequent prize winners agree to allow the free use of their names, photographs and general locations for publicity and news purposes during this and future promotions by Trafalgar. Trafalgar will not use photographs outside of the competition received from entrants that are not rewarded with a prize, unless the entrant is personally contacted and agrees to the use of their photograph.
13. Privacy: Uses of personal data received by Trafalgar in the course of the promotion are subject to the Privacy Policy found on your region's website: United States, Canada, United Kingdom, Australia, New Zealand, South Africa, Europe, and the Rest of the World.
14. Terms and Conditions: By entering, all eligible entrants agree to abide by each and all of these terms and conditions. Trafalgar reserves the right, with or without cause, to exclude entrants and withhold prizes for violating any of these terms and conditions.
