DULUX WALLS YOU’LL WANT TO TALK ABOUT COMPETITION TERMS AND CONDITIONS COMPETITION 1.The Dulux Texture Walls You’ll Want to Talk About Competition aims to encourage visionary use of colour in home design. Entry is open to Australian residents who are 18 years of age or over only. To enter, entrants must upload an image of the wall they would like to transform using Dulux Texture Medium Cover and explain in 25 words or less why they want to transform their exterior wall to https://www.facebook.com/DuluxAustralia (“Initial Submissions”). Initial Submissions must be of walls to be transformed in private non-commercial residences. 50 entries will be selected from the Initial Submissions to receive a transformation kit and to undertake the exterior project on their chosen wall. Dulux Australia Facebook friends will then have the opportunity to vote for their favourite exterior wall transformation and the winner will receive AU$5,000 prize money. The key competition dates are set out below: Important Dates The competition therefore commences at 12.01am (AEST) on 03/09/12 and closes at 11.59pm (AEST) on 18/11/12 (“Promotion Period”) when voting on Facebook closes. 2.Information on how to enter the Dulux Texture Walls You’ll Want to Talk About Competition and prizes form part of these Terms and Conditions. Participation in this competition is deemed acceptance of these Terms and Conditions. PROMOTER 3.The Promoter is Dulux Australia a division of DuluxGroup (Australia) Pty Ltd (ABN 67 000 049 427) of 1956 Dandenong Road, Clayton 3168, Victoria, Australia. ELIGIBILITY AND ENTRY 4. Entry opens to entrants to upload the image of the wall they would like to transform at 12.01am (AEST) on 03/09/12 and closes at 11.59pm (AEST) on 30/09/12 (“Entry Period”). 5. To be eligible to enter the Dulux Texture Walls You’ll Want to Talk About Competition entrants must: (i) be a resident of Australia only; (ii) be 18 years of age or over; and (iii) complete an online entry and upload image(s) of the actual wall they would like to transform in accordance with paragraphs 6 and 7 below. Entrants must have an active and valid Facebook profile at www.Facebook.com during the Promotion Period. Entrants acknowledge that all content posted on Facebook must be in accordance with Facebook terms (http://www.Facebook.com/terms.php). This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. 6.Entrants must upload a picture of the private non-commercial residence wall they would like to transform (if chosen by the Dulux judges) at the Dulux Australia Facebook page at https://www.facebook.com/DuluxAustralia: including their full name, address, a day time contact number and an email address. Entrants must also, in 25 words or less, explain why they want to transform their exterior space. The wall to be transformed must be the property of the entrant, or the entrant must have obtained permission from the property owner or the appropriate authority to paint the wall. 7.Entrants are required to provide a digital photograph of the wall they are entering. Images must be uploaded to the competition website as part of the online entry process. Images of the project must be provided in non-compressed JPEG or TIF format, up to 2MB in size, at least 300dpi and in colour. Please note that professional photography is not required as long as the images provided are a good representation of the wall. Entrants may submit a minimum of one image of the wall and a maximum of three images of the wall. Multiple entries will be accepted up to a maximum of five provided that each entry represents a separate wall. NON-ELIGIBILITY 8.Employees (and their immediate families) of the Promoter, and agencies associated with this promotion are ineligible to enter. 9.The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity and address) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 10. Incomplete and indecipherable entries and any entry which has incorrectly entered personal information or contact details shall be deemed an invalid entry. Furthermore, the Promoter at its sole discretion, may disqualify any entry deemed by the Promoter to have been completed on or in a commercial property. 11.Any entry that contains content that the Promoter, in its sole discretion, considers to be offensive or inappropriate in any way or that the Promoter considers, in its sole discretion, to infringe any intellectual property rights or other rights of any person, property, corporation or entity, will be considered ineligible. The decision to accept or reject an entry is at the Promoter’s sole discretion and no correspondence will be entered into. The Promoter, its affiliates and agents are not responsible in any way for the content or descriptions included by entrants, nor do they necessarily endorse the content or descriptions. Entries received must be the original work of the entrant. People depicted in any images submitted must be 25 years of age or older. Entries received during the Promotion Period will be individually moderated by representatives of the Promoter to ensure content posted is not illegal, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, indecent, libellous, hateful, obscene, or otherwise injurious to third parties or are otherwise objectionable. JUDGING 12.Fifty (50) entries will be selected by a panel of judges appointed by the Promoter. Judging will commence at 9.00am (AEST) on 01/10/12 at 1956 Dandenong Road, Clayton 3168, Victoria, Australia. The best and most appropriate 50 entries, in the opinion of the judges, will be selected from all entries to participate in the “transformation stage” of the promotion. The 50 entrants selected will be notified in writing on 05/10/12 and will be sent a transformation kit including a Dulux colour card brochure, brochure on “How to Dulux Texture Medium Cover; a mitt; stirrer, drop sheet, tape and a $150 visa card to purchase 10L of Dulux Texture Medium Cover which would cover between 20-30m2 (depending on the surface porosity) space (each kit is valued at $183. Total value of all kits to be distributed is $9,150). The 50 winners will be notified by email and phone and will need to claim their prize by return email stating their full postal address. 13.Between 12.01am (ADST) on 06/10/12 and 11.59pm (ADST) on 4/11/12 the 50 participants must complete and upload one image of their transformed wall at https://www.facebook.com/DuluxAustralia. 14. Voters log onto the Facebook app and will be able to vote for their favorite transformation between 12.01am (ADST) on 7/11/2012 to 11.59am (ADST) on 18/11/2012. A maximum of one vote per person per day will be permitted. 15.The entry with the highest number of votes at the close of the Promotion Period at 11.59pm (AEST) on 18/11/12 will be the winner and will be contacted by telephone and in writing on 23/11/12, and will be published online at https://www.facebook.com/DuluxAustralia In the case of a tied result, the tied entries will be judged by a panel of judges who will determine the outright winner based on the creativity and the level of transformation of the entry. 16.This is a game of skill and chance plays no part in determining the winner. 17.The judge’s decision is final and no correspondence will be entered into. PRIZE 18.The winner will receive AU$5,000 prize money paid by EFT or cheque, depending on the winner’s preference. Maximum prize value is AU$5,000. 19.The prize is not transferable or exchangeable. GENERAL CONDITIONS 20.If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the Dulux Texture Walls You’ll Want to Talk About Competition, as appropriate. 21.Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use (including application) of the products contained in the transformation kit and the Dulux Texture Medium Cover product; or (g) use of the prize. The Promoter does not warrant that 10L of the Dulux Texture Medium Cover product will be sufficient to cover the Entrant’s wall and the Promoter will not be liable for any additional product the Entrant may be required to purchase to complete their project. 22.Entrants irrevocably consents and assigns to the Promoter all intellectual property including copyright in the images submitted by them during this competition. Entrants also irrevocable consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. 23.The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties required for the provision of the Prize. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant.
