Terms and Conditions - carsales.com.au People’s Choice Awards1. General
Entry into the carsales.com.au People’s Choice Awards (The Promotion) constitutes acceptance of these Terms and Conditions.
Information on how to enter forms part of these conditions.
The Promoter is carsales.com Ltd, Level 4, 449 Punt Road, Richmond, Victoria 3121.
ABN 91 074 444 018 (The Promoter).
For the purposes of the Terms and Conditions, carsales.com Ltd includes all related and subsidiary companies, past, present and future officers, agents, representatives, employees and assigns.
2. Entry Requirements
Entry to The Promotion is open to residents within Australia. Entrants under 18 years of age need to have the consent of their parent or guardian to enter The Promotion. Employees of The Promoter and their immediate families are not eligible to enter the Promotion.
Entry to The Promotion is free.
The Promotion commences at 4:00am AEDST on Thursday 1st November 2012
and closes at 4:00am AEDST on Thursday 15th November 2012 (The Promotion Period). To enter The Promotion, participants must visit
www.carsales.com.au/peopleschoice and complete the entry form.
Entrants are required to complete all fields and agree to these Terms and Conditions for the entry to be valid.
The Promotion will be judged based on chance. There will be one (1) winner selected at the end of The Promotion Period. All valid entries received will be placed into a random electronic prize draw in accordance with the Draw Details and the selected entrants will each be awarded a Prize.
Vote tampering in any form is strictly forbidden. If The Promoter determines (in its sole and absolute discretion) that an entrant/s or voter/s actions are in contravention of these Terms of Entry, that entrant (or the entrant that the voter has submitted votes for) may be disqualified from The Promotion and some or all the votes that the entrant (or the voter) has submitted may be deleted. Some examples of behaviour that may result in disqualification include but is not limited to;
Registering or using multiple accounts to make more than what's deemed reasonable by The Promoter;
Using automated electronic systems to facilitate voting; and
Encouraging or coercing entrants not to vote.
3. Prizes
The prize for the winner of The Promotion is $5,000 cash that will be payable to the winner via cheque. The prize has a total retail value of $5,000. The prize may not be transferred or substituted, except at the Promoter’s discretion. The Promoter reserves the right to substitute a prize of equal or greater value due to prize unavailability. Any tax on the prize is the responsibility of the winner. Independent financial advice should be sought by any person participating in The Promotion.
The prize will be delivered to the winner’s address as agreed upon.
The Promoter shall not be liable for any costs associated wit h the prize after delivery.
The Promoter shall not be liable for any loss or damage whatsoever that is suffered by any entrant or winner (including but not limited to indirect or consequential loss), or for any personal injury suffered or sustained as a result of taking any prize, except for the liability that cannot be excluded by law.
4. Draw
The judging will take place at The Promoter’s head office, Level 4, 449 Punt Road, Richmond, Victoria 3121, on Friday 16th November 2012 at 10:00am AEDST by a representative selected by The Promoter.
The winner will be notified via telephone and email within two (2) business days of the judgement occurring.
The winner of The Promotion will be published on
www.carsales.com.au and in The Australian Newspaper in the week commencing Monday 19th November 2012.
Should the Promoter not be able to make contact with the chosen winner within fourteen (14) days after the winner’s entry is drawn, the winner will be deemed to have forfeited the prize.
Should item 4d come into effect, a representative of The Promoter will select the next best entry to be the winner of the competition. This judging will take place at The Promoter ’s office, Level 4, 449 Punt Road, Richmond, Victoria 3121, on Friday 30th November 2012 at 10:00am AEDST. The winner of this judging will be notified via telephone and email within two (2) business days of the judging. The winner of this judging will be published on
www.carsales.com.au and in The Australian Newspaper in the week commencing Monday 3rd December 2012.
The judge’s decision is final and no correspondence will be entered into.
5. Entries
All entries must be original and become the property of The Promoter upon submission.
When entering the Promotion, each entrant can agree to be entered into the Promoter’s database. By doing so, the entrant gives consent for their name, email address and telephone number to be used for promotional and marketing purposes.
The winner’s name and photographs may be used for any future promotional, marketing and publicity purposes in any media worldwide.
6. Warranties
Each entrant warrants that the contents of their entry is original and does not infringe the intellectual property rights of any third person.
Each entrant warrants that the use or publishing of any entry will not cause The Promoter to be in breach of any third party’s intellectual property rights.
The Promoter does not take any responsibility for any costs associated with entering and/or accessing The Promotion including and not limited to internet service provider costs.
If for any reason The Promotion is not capable of running as planned due to any reason, including unauthorised intervention, fraud, or any other causes beyond the control of The Promoter, which corrupt or affect the administration security, fairness, integrity or proper conduct of The Promotion, The Promoter reserves the right (subject to any applicable law) in its sole discretion to cancel The Promotion or to disqualify any individual who has tampered with the entry process.
In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest or strikes, The Promoter may, in its absolute discretion, cancel The Promotion and/or recommence it from the start on the same conditions subject to state legislation.
If The Promoter becomes aware that a prize winner is in breach of any warranty contained in these Terms and Conditions or made subsequently to, The Promoter may deem that prize winner ineligible.
Except for any liability that cannot be excluded by law, The Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of The Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by The Promoters) due to any reason beyond the reasonable control of The Promoters; (d) any variation in prize value to that stated in these Terms and Conditions of entry; (e) any tax liability incurred by the winner or entrant; and/or (f) redemption of the prize.
