ENTRY INTO THE COMPETITION
1. Entry into the Channel [V] “PEPSI NEXT THE PRESETS” competition (the “Competition”) is open to
all residents of Australia aged 15 years or over. The Promoter is FOXTEL Management Pty Ltd (ABN:
65 068 671 938) of 5 Thomas Holt Drive, North Ryde NSW 2113, Australia (the “Promoter”). 
Information on how to enter forms part of the terms of entry.  Entry into the Competition is deemed
acceptance of these terms and conditions. It is a condition of entry that all entrants under the age of
18 must have their parent or legal guardian’s express permission to enter this Competition in
accordance with these Terms and Conditions. Entry into the Competition is deemed acceptance of
these terms and conditions.
2. The officers, management and employees (or immediate family of an officer, manager or employee)
of the Promoter, the agencies associated with this Competition, FOXTEL, TELSTRA, Optus TV and
their related bodies corporate are not eligible to enter.
3. Competition begins at  10:00am (AEDT) on  Tuesday 13 November 2012 and closes at  11:59pm
(AEDT) on Sunday 25 November 2012 (the “Competition Period”).
4. To enter the Competition and be eligible to win, entrants must:
(a) be aged 15 years or over;
(b) go to the Channel [V] website at www.vmusic.com.au;
(c) complete the online entry form; and
(d) in 25 words or less answer the following question, “Why do you want to see The Presets
at the NEXT Gig?” the “Competition Question”).
Entrants also have the opportunity to support their entry by showing their commitment to being a
Pepsi NEXT fan by submitting via Twitter at the hashtag #chvnextgig a photo of him/her self
holding a Pepsi NEXT softdrink. This is not a mandatory component of the Competition. Only ONE
photograph can be submitted along with each entry. The written answer to the Competition Question
in each separate entry must be unique and original and does not contain any material which has
previously been published or communicated, but the photograph submitted may be the same as one
previously submitted by that entrant, or, at the entrant’s discretion, be a new and unique photo. 
5. All entries must include the entrant’s name, address, postcode, daytime phone number (including
area code), mobile phone number (if applicable), email address and date of birth. All entries must be
original and must not incorporate material which has been previously published. Incomplete entries or
those which, in the opinion of the Promoter, includes (but is not limited to) any objectionable content,
profanity or is potentially insulting, inflammatory or defamatory will be ineligible to win the Prize. It is
each entrant’s responsibility to inform the Promoter if his/her residential address, email address or
phone number changes during the Competition Period.
6. Only one entry per membership per day is permitted during the Competition Period, however, the
answer to the Competition Question in each entry by the same entrant must be unique and original. In
the sole discretion of the Promoter, if the Promoter reasonably believes that an entrant has infringed
the intellectual property rights of any third party, that entrant will be disqualified without notice. The
use of any automated software or any other mechanical or electronic means that permits the
participant automatically to enter repeatedly is prohibited (“Repeat Entry Device”). If the Promoter
reasonably believes that an entrant is using any Repeat Entry Device, the Promoter may disqualify
that entrant without notice.ONLINE SKILL
PRIZE
7. There are one hundred and fifty (150) x Prizes in total, consisting of one (1) x Major Prize and one
hundred and  forty-nine (149) x Minor Prizes. The Major Prize and the Minor  Prizes are together
referred to as the “Prizes”:
a) The Major Prize consists of:
I. Two (2) x  tickets to  the  Pepsi NEXT  event to see  an exclusive performance by  The
Presets  held on  Wednesday 28 November 2012 held at  The  Tivoli, Brisbane QLD
schedule to start approximately 5:30pm (the “Event”);
II. Return economy airfare to  Brisbane for the Major Prize winner and a guest from the
winner’s nearest capital city, valued at a maximum of $1000; and
III. One (1) nights twin-share accommodation in Brisbane for Wednesday 28 November 2012;
valued at a maximum of $300;
(the “Major Prize”)
IV. Each Minor Prize consists of  one (1) x double pass to  Pepsi NEXT event to see  an
exclusive performance by The Presets held on Wednesday 28 November 2012 held at
The  Tivoli, Brisbane QLD  schedule to start approximately 5:30pm;  The Minor Prize
winners must be able to make their own way to the Event venue (the “Minor Prizes”).
8. The total maximum Prize pool value is up to $1300. The Prize values are the recommended retail
values as provided by the suppliers and are correct at the time of printing. The Promoter is neither
responsible nor liable for any change in the value of the Prize occurring between publishing date and
date the Prize is claimed. All Prize values are in Australian dollars.
9. The Prizes are not transferable or redeemable for cash. The Prizes or any element of the Prizes
cannot be exchanged for any other prize/s. The contents of the Prizes will be at the Promoter’s sole
discretion. The Prizes are subject to availability and the terms and conditions of the entities supplying
the Prizes and the venues where the Events are held.
10. All ancillary costs and expenses incurred in taking and using the Prizes (including but not limited to,
transport to and from the Event, spending money, food and accommodation) are the sole
responsibility of the Prize winners and their guests, unless otherwise expressly stated as included in
the Prize.
11. The Prizes is only valid for the Event and at the venue/time stipulated. If a Prize winner is unavailable
to attend or travel for any reason, the Promoter may, at its sole discretion, award the Prize to the next
best entry. The Promoter will not offer a substitute prize under any circumstances. The Promoter
takes no responsibility for any cancellations, postponements or any other changes to the Event and
will not offer a substitute prize under any circumstances.
12. Only one Prize per person will be awarded.
JUDGING AND AWARD OF PRIZE
13. The Competition will be judged on the basis of originality and creativity at Channel [V], Level 1, 5
Thomas Holt Drive, North Ryde, NSW 2113 on Monday 26 November 2012 at 10:00am (AEDT).
Chance plays no part in the selection of the Prize winners. The Prize winners will be notified via email
or phone on Monday 26 November 2012 and their names published on the Channel [V] website from
Monday 26 November 2012. The Prize must be claimed by no later than Tuesday 27 November
2012 at 10:00am (AEDT). 
14. If a Prize winner cannot be contacted or does not claim the Prize by the stipulated date, then the
Prize will be forfeited and a substitute prize will not be offered in lieu of the Prize.ONLINE SKILL
AGE
15. In the event that a Major Prize winner is less than 18 years of age, the Major Prize winner must be
accompanied by his/her parent or a legal guardian over the age of 25. The parent or legal guardian
must accompany the Major Prize winner at all times throughout the conduct of the Major Prize. The
parent or legal guardian will be considered as the travelling companion of the Major Prize winner (ie
the Major Prize winner will only be able to bring their parent or legal guardian as their guest).
16. If a Minor Prize winner is under the age of 18, he/she winner must obtain their parents’ consent to
attend the event if he or she will not be accompanied by an adult over 18. The event will be alcohol
free.
TRAVEL
17. In the event that a Major Prize winner is a resident of Brisbane, QLD where the Major Prize will take
place (which shall be determined in the absolute discretion of the Promoter) the flight component of
the Major Prize will be forfeited in full and no substitute prize will be offered under any circumstances.
18. The Major Prize winners and their guests must travel at the same time and must depart from the
same city.  It is the  responsibility of the  Major Prize winners and their guests to ensure that their
personal documentation (including but not limited to passports, Visas etc) is valid. Any expenditure
incurred as a result of not meeting such requirements are the sole responsibility of the Major Prize
winners and guest.   
19. The Promoter takes no responsibility for any cancellations,  delays,  postponements or any other
changes to the flights or other transport arrangements that are part of the Major Prizes and will not
offer a substitute prize under any circumstances.
CONSENT TO FILMING AT THE EVENT AND SIGNING RELEASES
5. Each entrant acknowledges that filming, photography and audio recording will take place at the
Event. As a condition of entry, each entrant/Prize winner consents to having his or her image and/or
voice to be recorded, photographed or filmed during the his/her participation in the Prize and the
Event and consents to all such recordings and/or photographs to be edited, reproduced, broadcast,
published or otherwise communicated by the Promoter (and/or other entities associated with this
Competition, including but not limited to Pepsi) for all purposes without limitation and in any media
whatsoever throughout the world without payment to the entrant/ Prize winner.
6. It is a condition of accepting a Prize that all Prize winners and their guests may be required to sign a
legal release (in a form determined by the Promoter in its absolute discretion) prior to the Event. For
any Prize winners or guests who are under the age of 18, as a condition of attending accepting the
Prize and attending the Event, they are required to provide the Promoter a legal release (in a form
determined by the Promoter), signed by the Prize winner and the guest’s parent or legal guardian and
provide this to the Promoter prior to, or on the day of the Event.
7. If an entrant is under the age of 18, the consents and rights granted by that entrant for the benefit of
the Promoter in these Terms and Conditions will be taken to be have been given by that entrant’s
parent or legal guardian on behalf of that entrant. The entrant’s parent and guardian represents and
warrants to the Promoter that he/she has the full authority and capacity to grant the rights referred to
in these Terms and Conditions.
GENERALONLINE SKILL
8. Each photograph by the entrant must be an original work and must not infringe the copyright or any
other rights of any third party. Each entrant warrants that:
(a) each entry (including all photographs) is their own original work and not copied in any
manner from any other works; 
(b) he/she owns all rights and interest in the photograph(s) submitted and have obtained all
necessary releases and consents from any other persons appearing in the photo and from
the owner of any property photographed to enter the photograph for this Competition in
accordance with these Terms & Conditions;
(c) he/she has the full power and capacity to grant the rights and consents set out in these
Terms and Conditions; and
(d) he/she will fully indemnify the Promoter against any loss or damages suffered by the
Promoter in the event any of the warranties set out in this clause are false.
9. Entrants will retain ownership of copyright in their photograph; however, as a condition of entry, each
entrant:
a) agrees that their name, image, biography and entries (including, but not limited to, any written
answers, photographs/images and videos) may be reproduced, published, communicated,
broadcast or shown to the public by the Promoter and/or other agencies associated with this
Competition (including but not limited to Pepsi), in any media for its promotional purposes,
without compensation to the entrants, subject to the Promoter’s privacy policy which is available
at www.vmusic.com.au; for this purpose, each entrant grants to the Promoter a non-exclusive,
perpetual, worldwide, and royalty-free licence in any such written answers, photographs /images
and videos; and
b) consents to any act or omission by the Promoter which may infringe any of the entrant’s moral
rights (within the meaning of the Copyright Act 1968 (Cth)), including: i) failing to attribute (or
correctly attribute) the entrant’s authorship of the entry; or ii) making any modification, variation or
amendment of any nature to the entry, whether or not it results in a material distortion or
derogatory treatment of the entry.   
In the sole discretion of the Promoter, if the Promoter reasonably believes that an entrant has
infringed the copyright or any other rights of any third party, that entrant will be disqualified without
notice. 
20. All entrants agree to provide the Promoter or the Promoter’s authorised agent with proof of identity,
residency, age and/or proof of entry validity if selected as the Prize winner or if reasonably requested
by the Promoter or the Promoter’s authorised agent. Proof of age, identification, residency and entry
considered suitable for verification is at the sole discretion of the Promoter. In the event that a Prize
winner cannot provide suitable proof that Prize winner will forfeit the Prize in whole and no substitute
will be offered.
21. No responsibility will be taken by the Promoter, Channel [V], FOXTEL, TELSTRA or Optus TV for any
changes in dates, times or cancellations or other arrangements that may prevent the Prize winners
from winning the Prizes.
22. The Promoter reserves the right, in its absolute discretion, to disqualify:
a) any entry which, in the opinion of the Promoter, includes any objectionable content,
profanity or is potentially insulting, inflammatory or defamatory; or
b) any individual who tampers with the entry process, submits an entry that is not in
accordance with these terms and conditions or who has in the opinion of the Promoter,
engaged in unlawful or improper conduct that is designed to jeopardise the fair and
proper conduct of the Competition or is generally damaging to the goodwill or reputation
of the Promoter.ONLINE SKILL
23. The Promoter reserves the right, in its absolute discretion, at any time before the awarding of the
Prizes to cancel or vary the Competition or to cancel or vary the Prizes in any circumstances,
including, without limitation, circumstances where in the Promoter’s opinion (which it shall form in its
absolute discretion):
a) a Prize winner does not satisfy the Competition entry requirements; or
b) the Promoter cannot conduct the Competition or award the Prize/s for any reason beyond
its control.
24. In the event that the Promoter cancels or varies the Competition or varies or withdraws the Prizes it
shall not:
a) be liable to any person for any loss or damage (including loss or damage caused by any
negligence) arising out of, or in connection with, such cancellation, variation or
withdrawal; or
b) be required to conduct the Competition at any other time.
25. No responsibility will be accepted by the Promoter for late, lost or misdirected entries and all entries
are deemed to be received at the time of receipt of the entry into the Promoter’s database and NOT
at the time of transmission by the entrant. The Promoter accepts no responsibility for outdated or
incorrect contact details or contact details by which the entrant cannot be contacted during business
hours on the relevant dates.
26. A decision of the Promoter in relation to the conduct of the Competition is binding and conclusive and
no correspondence will be entered into.
27. Entrants enter the Competition at their sole risk. With the exception of liability which cannot be
excluded by law, the Promoter and Pepsi shall not be liable for any loss or damage which is suffered
(including but not limited to indirect or consequential loss) or for personal injury suffered or sustained
as a result of taking the Prize or entering the Competition.
28. The Promoter collects entrants’ personal information (as that term is defined in the Privacy Act 1988
(Cth)) for the purpose of conducting and promoting this Competition (including, but not limited to,
determining and notifying winners). Entrants are advised that their personal information may be
disclosed to State and Territory lottery departments and their names as the winner may be published
as required under the relevant lottery legislation. Entrants are also advised that from time to time, the
Promoter may disclose your personal information to third parties (including, but not limited to, third
party prize providers) for the purpose of administering prizes or for other purposes contemplated in
these Terms and Conditions.
29. Entrants are advised that “opt-in” entries will be entered into a database. The Promoter may use the
entrant’s names, addresses and/or telephone numbers for future promotional, marketing and publicity
purposes in any media worldwide and without notice and without any fee being paid unless otherwise
advised by the entrant. By opting-in, entrants consent to and confirm that they allow their details to be
used for this purpose. If entrants no longer consent to their details being used for future marketing
purposes by the Promoter or wish to update, modify or delete their details should contact the
Promoter directly on their details set out below or follow the prompts in the communication to
‘unsubscribe’.
30. Entrants can also ‘opt in’ to have their personal information passed onto third parties associated with
this Competition (which includes but not limited to Pepsi) and to receive promotional information from
these third parties. If you do choose to ‘opt in’, you agree to allow such third parties sending you
information and communication directly and you agree that the storage and use of your personal
information will be subject to the relevant privacy policies of those third parties and the Promoter (and
its associated entities) and will not be liable for any misuse of your personal information by any of the
third parties. If you later wish to ‘opt out’ of receiving information from any of those third parties, or
wish to amend, delete or update your personal information, you will need to contact that third party
directly. ONLINE SKILL
