Full terms and conditions:

1. Information on how to enter and prizes form part of these conditions. By participating, entrants agree to be bound by these conditions. Entries must comply with these conditions to be valid.
2. Entry is open to Australian residents only who are 18 years and over. Employees (and their immediate families) of the Promoter, its agencies associated with this promotion are ineligible to enter.
3. The promotion commences at 17:30 AEDST on 17 November 2012 and closes at 23.59 AEDST on 26 November 2012 (“Promotional Period”).
4. To enter, Participants must do either of the following during the Promotional Period:
a. 1-90 Call: Dial 1902 556 999 and register their full name, address and a daytime telephone number according to the automated instructions. Maximum 1-90 entry cost per message is 55 cents including GST. Call costs from mobiles and public phones may attract a higher rate. Service Provider: Salmat Digital PTY LTD.
OR
b. SMS: Text their full name and address to 1902 556 999. Maximum SMS entry cost per message is 55 cents including GST. The SMS entry mechanic is only open to consumers with a SMS compatible mobile phone connected to a service provider which permits premium text messaging to the promotional SMS number. It is recommended that entrants check with their individual service provider in this regard. Service Provider: Salmat Digital PTY LTD. Helpline: 1300 131 276. SMS entries submitted via the Internet, or by any automated entry software or any other mechanical or electronic means that permits the participant to automatically enter repeatedly are not valid and will not be accepted. By entering the competition via SMS an entrant consents to the Promoter using the their personal details for the purposes of sending one (1) mobile terminated (MT) reply message which includes a confirmation of their entry in the competition. An SMS entry will only be counted as being received when it has been received by the Promoter’s software system, not when it was sent from the handset.
5. Multiple competition entries are permitted, subject to the following: (a) only one entry permitted per SMS message or 190 call; and (b) each entry must be submitted separately and in accordance with the entry requirements.
6. The draw will take place at 10:00 AEDST on 27 November 2012 at Salmat Digital Pty Ltd, Level 2 – 116 Miller Street North Sydney 2060. Winner/s will be notified by telephone within two days of the draw and in writing (email or mail) within 21 days of the draw using the contact details provided in their entry. Winner's/s' name/s (and their suburb and postcode if they reside in SA) will be published in The Australian newspaper on Thursday 6 December 2012
7. The promoter is neither responsible nor liable for late, lost, misdirected, incomplete or inaudible entries.
8. The winner of the promotion will be determined by the first valid entry randomly drawn by the Promoter. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s/ winners identity, age, place of residence, receipt (for proof of purchase) and/or if necessary relevant phone bills to determine identification) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
9. The first (1) valid entry drawn by the Promoter, from all entries received will be deemed the major prize winner and will win a trip for the winner and three (3) guests who are Australian residents and aged 18 years or over to XXXX Island located on the Great Barrier Reef, Australia. The trip includes return economy class airfares for four (4) adults from the winner’s nearest Australian capital city to Rockhampton Airport, including airline and airport taxes, transfers from Rockhampton Airport to and from XXXX Island and three (3) nights 3 star (or equivalent) accommodation.
Winner and guests must travel together. Accommodation may consist of a mix of single, double and/or dormitory-style rooms and semi-permanent tents with a mix of ensuite and communal bathrooms, and will be allocated at the discretion of the Promoter.
Selected food and beverages will be provided at the Promoter's discretion, including unlimited water.
Activities available on the Island are subject to weather and management discretion, and may include (but are not limited to) snorkelling, rod fishing, kayaking, canoeing and beach games.
Participation in any activities will require the completion of a Participation Agreement and Release and is taken at the risk of the individual. The Promoter may amend or substitute available activities in its absolute discretion.
Total prize value is up to $10,000 (depending on point of departure).
All other ancillary costs, including but not limited to taxes (excluding GST), fuel, meals and beverages (unless specified), transfers (unless specified) and transfers/ additional domestic flights to and from the winner's place of residence to their nearest Australian capital city airport, activities (unless specified), insurance, incidentals and any and all other expenses are the responsibility of the winner. It is a condition of accepting the Prize that the winner and their guests arrange at their own expense valid travel insurance with the highest available coverage for their period of travel. The Prize is a single event trip for the winner and their guests and cannot be separated into separate trips or components.
10. Winner/s and their guests must be Australian residents and aged 18 years and over when redeeming the prize.
11. Winner/s will be allocated a travel window during the period 1 April 2013 to 30 April 2012 ("Travel Window"), in which they will be required to nominate a weekend on which they and their guests would like to take their trip to XXXX Island. Prize is subject to availability at the time of booking and blackout periods may apply including prize must not be taken on Easter holiday weekend. Prize must be redeemed in full and taken as a package by 30 April 2013.
12. Within 7 days of being notified that they are a winner, winner/s will receive an email confirming their Travel Window, and the period in which they will be able to access
the Promoter's online booking system to nominate a weekend ("Booking Period"). Winner/s will also be advised of other information and documents they will need to provide to the Promoter during the Booking Period to complete their booking. A further email will give winner/s a URL and code to access the online booking system during the Booking Period. Winner/s must during the Booking Period nominate a weekend and provide all other information and documents requested by the Promoter (including in respect of their guests). Weekends will be allocated on a "first come, first serve" basis and are subject to availability, including airline economy class seat availability. If a winner's nominated weekend is not available, they must nominate an alternative available weekend within the Travel Window. Second chance prize winner/s will not have the opportunity to nominate a weekend, and the weekend on which they and their guests must take their trip to XXXX Island will be allocated by the Promoter in its sole discretion.
13. If necessary, a second chance draw will be held on Monday 4 March 2013 at the same time and place as the first draw in order to distribute any unclaimed prizes. Second chance winners will be notified by telephone within two days of the draw and in writing (email or mail) within 21 days of the draw. Winner's/s' names (and their address if they reside in SA) will be published in The Australian newspaper on 7 March 2013.
14. Accommodation and flight arrangements, including suppliers, will be determined by the Promoter in its sole discretion. The Promoter may refuse any requested changes, and will not accept any request made within 24 days of departure. If any requested change is accepted by the Promoter, change fees may be applicable.
15. Before any prize is awarded, the winner and each of their guests will be required to: sign a Participation Agreement and Release in favour of the Promoter and event organiser; and provide evidence of valid travel insurance with the highest available coverage for their period of travel.
16. Winner/s and their guests may also be required to provide a credit card imprint or cash deposit at check-in to the accommodation on XXXX Island that will be used to charge for incidentals (such as optional activities) and/or as a bond in case of damage to the property.
17. The winner (and their companion) are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
18. Transport to and from Departure point including but not limited to additional Domestic airfares if required, any additional meals, any extra sightseeing or activities, any additional accommodation, personal spending money, and all other ancillary costs, as well as obtaining any of these, are the responsibility of the winner and their travel companions. Prize also excludes medical expenses, items of a personal nature, beverages, optional tours not outlined, laundry, telephone calls, additional nights, room upgrades or other ancillary costs associated with redeeming the prize other than those specified. These costs and expenses are the responsibility of the winner. Any extension to the duration of the prize is at the winner’s sole expense and subject to availability at the time of booking. For the removal of doubt, taxes for international travel and port charges are included in the prize provided by the Promoter.
19. Unless expressly stated in these terms and conditions all other expenses (including travel to and from the departure point) become the responsibility of the winner.
20. The prize (or any part thereof) cannot be sold, is not transferable or exchangeable and cannot be taken for cash. No responsibility is accepted for any variation in the value of the prize.
21. Meals or tips, transfer fees (other than specified), excess baggage and any other personal expenses not specified in the prize package must be paid for by the winner.
22. If the prize or portion of the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.
23. The Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
24. All prizes must be taken as offered. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be redeemed as cash. The prize is not valid in conjunction with any other offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass. The Promoter will not be liable for any voucher / ticket / pass that has been lost, stolen, forged, damaged or tampered with in any way.
25. It is a condition of accepting the prize that the winner (and any traveling companions) must comply with all the conditions of use of the prize and prize supplier’s requirements. Winner will be required to sign a liability waiver form to accept the prize.
26. In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster)the Promoter reserves the right to cancel, terminate, modify or suspend the promotion.
27. It is a condition of accepting a prize that the winner agrees to be interviewed, photographed and filmed at any time during the acceptance of the prize by the Promoter or their agents for a story or feature on this promotion to be developed and featured on the Nine Network (or any other form of media it deems suitable) without further remuneration or reference to the participant. Details may feature on Nine Network on a date to be determined by the Promoters. The inclusion of any such feature (including but not limited to creative control of the feature) will remain with the Promoter at all times.
28. Participants must ensure that all care is taken when dialling or sending messages to the promotional number. It is the complete responsibility of the participant to ensure that they dial or SMS the correct number, in the event that an error occurs the Promoter accepts no responsibility for either, costs incurred, responses received or all other consequences. This is the responsibility of the participant.
29. The Promoter accepts no responsibility for any SMS messages not received by the Promoter or delays in the delivery of the SMS message due to technical disruptions or for any other reason. An entry will only be counted as being received when it has been received by the Promoter’s software system, not when it was sent from the handset.
30. If a medical circumstance in some way restricts your ability to enter the competition through the required mechanic, you are still eligible to enter however you must briefly state your circumstances upon entry.
31. If your entry is selected as a winning entry, validation of your circumstances/ the validity of your entry will be undertaken by the Promoter. Method of validation (without limitation) will be determined by the Promoter in its complete discretion. If the winning entry is deemed to be a winner, the winner will be notified as per the terms and conditions herein. In the event that the Promoter requests the entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoter. It is a condition of accepting the prize the winner sign any such legal documentation.
32. The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
33. The Promoter reserves the right to verify, at any time during or after the closing of the promotion, the validity of all entries and to disqualify any entrant who tampers with the entry process, including techniques designed to avoid payment of call costs. SMS entries via the internet are not valid and will not be accepted. The use of any automated entry software or any other mechanical or electronic means that permits the participant to automatically enter repeatedly are not valid and will not be accepted.
34. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
35. If for any reason this competition is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond the control of the Promoter which corrupts or affect the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by the various Lottery Departments, to cancel, terminate, modify or suspend the competition.
36. All entries and other information provided in the course of this competition become the property of the Promoter and the Sponsor. The collection, use and disclosure of personal information in connection with this promotion are governed by the Promoter’s Privacy Notice available from Channel 9 and these Conditions of Entry. The Promoter may use information it collects in relation to you to provide you with information regarding further offers, promotions or goods and services provided by the Promoter and/or the Promoter’s partners and sponsors. The Promoter may also disclose information about you to its service providers to enable the Promoter to provide you with services. Your personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. You consent to the Promoter’s use and disclosure of information about you as contemplated by this condition. To remove your information from the Promoter’s records, please send an email to competitions@nine.com.au with your name, mobile phone number and your request to cancel the service. 37. To the full extent permitted by law, The Promoter will not be liable to you in respect of any claim for any loss or damage whatsoever (including, without limitation, any consequential, indirect, special, punitive or incidental damages) or for any personal
injury suffered by you as a result of or in connection with the Promoter’s provision of the Service. Certain legislation may imply warranties or conditions or impose obligations (collectively Provisions) in relation to the Promoter’s provision of services to you which cannot be excluded, restricted or modified except to a limited extent. If those Provisions apply, to the extent that the Promoter is entitled to do so, the Promoter’s limits its liability in respect of any claim under those Provisions to, at the Promoter’s option, the supply of the relevant services again or the payment of the costs of having the services supplied again.
