The promotion is conducted by Terri Scheer Insurance Pty Ltd ABN 76 070 874 798, Level 18, 36 Wickham Tce, Brisbane QLD 4000 (Terri Scheer).
Information on how to enter the Terri Scheer Win $10,000 Promotion (Promotion) and prizes form part of these Conditions of Entry. Entry into the Promotion is deemed acceptance of these Conditions of Entry. Entry is via Internet only.
Entry is only open to individuals aged 18 years or older who are residents of Australia (Eligible Entrants).
Directors and employees of Terri Scheer, Terri Scheer’s related entities, printers, suppliers, providers or agencies associated with this Promotion, and immediate family members of such persons are ineligible to enter the Promotion.
Promotion commences at 12:01 am (AEDT) on 29/10/2012 and closes at 11:59 pm (AEDT) on 30/11/2012 (Promotional Period). The draw will take place at 1:00pm (AEDT) on 04/12/2012 at Contact Management Associates (VIC) Pty Ltd, 92-94 Tope St, South Melbourne VIC 3205 (the Draw). The winner will be notified by telephone (if a telephone number is provided as part of their entry form) and by email on or before 07/12/2012. The winner's name and locality will be published in The Australian on 12/12/2012. Terri Scheer's decision is final and no correspondence will be entered into.
To enter the Promotion, Eligible Entrants must, during the Promotional Period, log on to
https://www.insurancepromotions.com.au/terrischeer/win10k (Promotional Website) to fully and correctly complete and successfully submit the online entry form, including providing their full name, postcode and current and valid email address to become an entrant (Entrant).
Entrants may invite friends or relatives to enter the Promotion. To invite friends or relatives, Entrants must submit their friends' or relatives' names and email addresses (and any other required information) in the manner required and where indicated when submitting the online entry form. Entrants who invite friends or relatives to enter the Promotion will gain one (1) additional entry into the Promotion for each friend/relative they invite in the required manner up to a maximum of five (5) additional entries. The operation of the referral mechanic referred to above is subject to the Spam Act 2003. An Entrant may refer a particular friend or relative only once during the Promotional Period and Entrants who have already entered the Promotion cannot be referred as friends or relatives by a subsequent Entrant. Each Entrant's relative or friend nominated must be an Australian resident and be aged 18 years or older. Each Entrant warrants that any and each friend or relative that they nominate is known to them personally and that such persons have consented to receiving commercial electronic messages.
Entrants are limited to up to a maximum of six (6) entries into the Promotion: a maximum of one (1) entry via the mechanic described in Condition 6 and a maximum of five (5) additional entries via the online referral mechanic described in Condition 7.Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. Terri Scheer accepts no responsibility for late, lost or misdirected entries.
The use of any automated entry software or any mechanical, electronic or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.
Entries will be deemed accepted at the time of receipt by Terri Scheer and not at the time of transmission. Contact details entered incorrectly on the Promotional Website by an Eligible Entrant will deem an entry invalid. Costs associated with accessing the Promotional Website remain an Eligible Entrant's responsibility and may vary depending on the internet service provider used.
Terri Scheer reserves the right to verify the validity of any and all entries and reserves the right to disqualify any Entrant: (a) for tampering with the entry process; (b) for submitting an entry which is not in accordance with these Conditions of Entry; or (c) if the Entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. Terri Scheer's legal rights to recover damages or other compensation from such an offender are reserved.
The Entrant of the first valid and eligible entry drawn from all entries received will win AUD$10,000 in the form of two (2) pre-paid Visa Cash Debit Cards (Prize). The Prize will be issued in the winner’s name and will be sent via secured post to the address nominated by the winner by 31/12/2012. The Prize is subject to prevailing terms and conditions of use, including expirations dates (if any), and is not replaceable if lost, stolen or damaged.
The Prize will only be awarded following any winner validation and verification that Terri Scheer requires in its sole discretion. Terri Scheer reserves the right to request a person whose name is drawn to produce (within the requested time) appropriate photo identification or other documentation (to Terri Scheer's satisfaction and at its sole discretion) to confirm the winner’s identity, age, residential address and email address, eligibility to enter and claim the Prize and any information submitted by the winner in entering the Promotion, before issuing the Prize.
Terri Scheer may draw five (5) additional reserve entries in the Draw and record them (in order) in case an invalid entry or ineligible Entrant is drawn, the first winner or any subsequent winner does not accept the Prize, or if the first winner or any subsequent winner does not confirm their eligibility to be awarded the Prize as requested under Condition 14.
If the Prize cannot be awarded to the Entrant of the first valid and eligible entry drawn by 04/03/2012, Terri Scheer will notify the new winner by telephone and by email using the valid and eligible reserve entries (in turn) until the Prize is awarded, subject to any written directions under the applicable State or Territory legislation. If after this process the Prize has still not been awarded, Terri Scheer will hold an unclaimed prize draw in accordance with Condition 17.
Terri Sheer may conduct a further draw at the same time and place as the original draw as is necessary on 05/04/2013 in order to distribute the Prize unclaimed by that date, subject to the written directions given under applicable State or Territory legislation. The unclaimed Prize winner will be notified by telephone and by email and the name and locality of the winner will be published in The Australian on 11/04/2013.
Total maximum Prize value is AUD $10,000 (including GST). The Prize is not transferable or exchangeable. Terri Scheer accepts no responsibility for any tax implications that may arise from the Prize winnings. Independent financial advice should be sought. Terri Scheer accepts no responsibility for any variation in Prize value.
The winner consents to the personal information which Terri Scheer gathers about them being disclosed for the purposes of issuing the Prize.
It is a condition of accepting the Prize that the winner may be required to sign a legal release/s or release/s in a form determined by Terri Scheer in its absolute discretion.
Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Promotional Website or the information on the Promotional Website, or to otherwise undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and, should such an attempt be made, whether successful or not, Terri Scheer reserves the right to seek damages to the fullest extent permitted by law. If Terri Scheer suffers loss or incurs any costs in connection with any breach of these Conditions of Entry or any other legal obligation by an Entrant, the Entrant agrees to indemnify Terri Scheer for those losses, damages and costs.
Terri Scheer and its associated agencies and companies are not liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with taking the Prize or using the Prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). Terri Scheer and its agents associated with this Promotion take no responsibility for the Prize (or part of the Prize) being damaged or lost in transit.
Terri Scheer and its associated agencies and companies are not responsible for any problems, delays or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a network or a mobile network or any combination thereof, or any other technical failures including any damage to the Entrant's or any other person's mobile handset, computer or peripherals related to, or resulting from, participation in this Promotion or the downloading of any materials related to this Promotion.
Terri Scheer will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this Promotion if the deficiency is occasioned by any cause outside the reasonable control of Terri Scheer including but without limitation technical malfunctions or failures.
If this Promotion is not capable of running as planned for any reason, including but not limited to war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, Terri Scheer reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion or amend the Conditions of Entry and/or, if necessary, to provide an alternative prize, subject to any written directions made under applicable State or Territory legislation.
As a condition of entering this Promotion, an Entrant consents to, in the event they are the winner, Terri Scheer using the Entrant's name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the Promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by Terri Scheer. The Entrant agrees that, in the event they are the winner, the Entrant will participate in all reasonable promoted activities in relation to the Promotion as requested by Terri Scheer and its agents.
An entry and any copyright subsisting in an entry irrevocably becomes, at time of entry, the property of Terri Scheer. Terri Scheer collects personal information about an Entrant to include the Entrant in the Promotion and, where appropriate, award prizes. If the personal information requested is not provided, the Entrant cannot participate in the Promotion and is deemed ineligible. An Entrant also agrees that Terri Scheer may, in the event the Entrant is the winner, publish or cause to be published the Entrant winner's name and locality in any media, as required under the relevant State or Territory lottery legislation. An Entrant can gain access to, update or correct any personal information held by Terri Scheer by contacting Terri Scheer's Privacy Officer by sending a letter to The Privacy Office, GPO Box 1619, Adelaide SA 5001 A copy of Terri Scheer’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting Terri Scheer.
If an Entrant participates in the Promotion and also chooses to “opt-in” on the Promotional Website, the Entrant agrees that a further primary purpose for collection of the Entrant's personal information by Terri Scheer is to enable Terri Scheer to use the information to assist Terri Scheer in improving goods and services and to contact the Entrant in the future with information on special offers or provide the Entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. Terri Scheer may share information with its Australian related companies or promotional partners who may contact the Entrant with special offers in this way. By entering the promotion and opting-in, an Entrant acknowledges and agrees that Terri Scheer may use the Entrant's personal information in the manner set out in this condition.
