Terms and Conditions
1. Information on how to enter & prizes form part of these terms & conditions. Any
entry not complying with these terms and conditions is invalid.
2.
Entry is open to residents of Australia over 18 years of age who are fans of the
UNCLE TOBYS Facebook Fan Page (“Eligible Entrant”). Employees of the
Promoter, the Promoter’s associated companies, the Promoter’s agencies
associated with this competition and their immediate families are ineligible to
enter.
3. The competition commences at 11:59am Australian Eastern Standard Time
(“AEDST”) on Tuesday 27
th
November 2012 &
closes at 11:59am AEST on
Monday 17
th
December 2012 (“Competition Period”).
4. To submit an entry, go to
http://www.facebook.com/officialuncletobys, find the
“Nominate a Friend?” tab, follow the prompts to complete your entry details and
tell us in no more than 25 words
“Why you’d like to give your friend a $50
gift card from UNCLE TOBYS this Christmas”, then submit your entry. The
friend you nominate must:
(a) be able to have their nomination confirmed by the Promoter via
the Promoter posting to the wall of their Facebook account; and
(b) confirm their nomination when prompted to do so by the Promoter
for the entry to be valid.
5. Entry is limited to one per Eligible Entrant.
6. The Promoter reserves the right to verify the validity of all entries and reserves
the right to disqualify any entrant for tampering with the entry process, including
but not limited to making multiple entries that exceed the entry limit, or for
otherwise submitting an entry that is not in accordance with these terms and
conditions.7.
The prize is a $50 Coles Myer Group gift card valid for 12 months awarded to a
nominee chosen as a winner and a $50 Coles Myer Group gift card to those
Eligible Entrants who have nominated a winner. There are a total of 40 prizes
to be awarded – 20 to nominees and 20 to their Eligible Entrants. For terms

8. This competition is a game of skill and chance plays no part in determining the
identity of the prize winners. All valid entries received during the Competition
Period will be judged on their merit and the 20 entries judged to be the most
inspiring and most creative will each win a prize.
9. Judging will be completed at 61-63 Great Buckingham Street, Redfern NSW
2016 by close of business on Tuesday 18
th
December 2012. All winners will be
notified by email and their names will appear on THE UNCLE TOBYS
Facebook Fan Page.

Total prize pool is valued at $2,000 RRP.11. Prizes are not transferable & cannot be taken as cash.
12. Prize value is correct at time of printing but no responsibility is accepted for any
variation in the value of the prize.
13. The Promoter is not liable for any loss or damage whatsoever which is
suffered, including but not limited to indirect or consequential loss, or for
personal injury suffered or sustained during the course of accepting or using
the prize, except for any liability which cannot be excluded by law.
14. Each entry becomes the property of the Promoter. All details will be held in
accordance with the Nestlé Privacy Policy which can be accessed by visiting
www.nestle.com.au or calling 1800 005 510.
15. Promoter’s decision is final and no correspondence will be entered into.16. The Promoter retains the absolute discretion to require a winner to provide
proof of age and identity in a form determined by the Promoter before awarding
the prize.
17. The winner should look to the manufacturer of products and provider of
services awarded as prizes for all warranties. However, these terms and
conditions do not exclude or limit the application of any statutory provision
(including a provision of the Competition and Consumer Act 2010) where to do
so would contravene that statute or cause any part of these terms and
conditions to be void.
18. In the event that any prize item is unavailable despite the Promoter’s
reasonable endeavours to procure within Australia, the Promoter reserves the
right to substitute a different prize item of equal or greater value.
19. The prize will be delivered to each winner within 28 days following the winner’s
confirmation to the Promoter via email notifying the delivery details for their
prize.
20. Entrants release Facebook from all liability in relation to the Competition.
Entrants acknowledge that this Competition is in no way sponsored, endorsed
or administered by, or associated with Facebook and that any information
provided by entrants is provided to the Promoter and not to Facebook.
21. By entering the competition, each entrant acknowledges that their name and
entry statement may be used for printing, broadcast, publicity and promotional
purposes, including but not limited to the UNCLE TOBYS Facebook Fan Page
(
www.facebook.com/officialuncletobys) or the Promoter’s other website/s
without compensation. It is a condition of accepting any prize that a prize
winner acknowledges that the Promoter may use the entry for commercial
purposes and agrees not to object to any such use on the basis of any moral
right.
22. If for any reason this Competition is not capable of running as planned, whether
caused by infection by computer virus, mobile phone failure, line drop out,
bugs, tampering, unauthorised intervention, fraud, technical failures or any
other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the Competition, the Promoter
reserves the right in its sole discretion, (subject to any written direction given by
a relevant Regulatory Authority), to cancel, terminate, modify or suspend the
Competition. The Promoter may in its sole discretion disqualify any individual
who tampers with the entry process.
23. Entries are deemed to be received at the time of receipt into the Promoter’s
database. The Promoter is not responsible for receipt of incorrect, inaccurate or
incomplete information caused by an entrant or occurring during transmission.
The Promoter is not responsible for any problems or technical malfunction of
any telephone, telephone or computer network, or lines, servers, or telephone
or internet providers, traffic congestion on any phone or computer network, or
any combination thereof, including any injury or damage to participants or any
other person’s handset or computer related to or resulting from participation or
sending or receiving of any communication or of any materials in this
Competition.
