Terms & Conditions

 1. Instructions on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is open to Australian residents 18 years or over who own a business operating within Australia. Employees and contractors (and their immediate families) of the Promoters and employees and contractors of agencies associated with this promotion are not eligible to enter.

3. The promotion commences 9.00am AEDST on 9 November 2012 and closes 5.00pm AEDST on 19 December 2012 (“Promotional Period”). The judging will be done by a panel of judges appointed by the Promoters. The judging will take place at ACP Magazines at 66-68 Goulburn Street, Sydney, NSW 2000 and will begin on 20 December 2012. The winner will be notified by phone and in writing using the contact details given in their entry.

4. To enter, eligible business owners must visit smarterbusinessideas.com.au/competitions, follow the prompts to the competition entry page, input the requested details including their full name, full mailing address, daytime telephone number and answer to the competition question in one hundred (100) words or less ‘In what ways can effective marketing help your business?’ and submit the fully completed entry form during the Promotional Period.

5. Only one (1) entry permitted per person per business.

6. This is a game of skill, chance plays no part in determining the winner. Each entry will be individually judged based on its literary and creative merit of the answer to the question provided. The judges’ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.

7. Entrants consent to the Promoters using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoters. In particular, the winner agrees to participate and feature in a case study for Sensis Pty Ltd, which will appear in the July 2013 edition of Smarter Business Ideas magazine (or another issue notified by the Promoters). Details of the feature in Smarter Business Ideas Magazine, website or social media on a date to be determined by the Promoters (including but not limited to creative control of the feature) will remain with the Promoters at all times.

8. The Entrant warrants to the Promoters that the entry submitted is an original artistic work of the Entrant that does not infringe the rights of any third parties. If the entry or any part of the information provided to the Entrant in relation to the entry was provided by a third party, the Entrant warrants that they have obtained the relevant copyright permission to submit the entry for the purposes of this promotion. The entrant agrees to indemnify the Promoters against all claims and costs by third parties arising from a breach of the warranty set out in this condition.

9. The Promoters is entitled to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including using the entries for future Promoters’ or their agents book publications, promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. The Promoters is entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry.

10. Entries must not be offensive, defamatory or racist. Any entry which the judges deem inappropriate will be invalid. The entrant agrees to indemnify the Promoters.

11. The Promoters reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoters’ discretion. Failure by the Promoters to enforce any of its rights at any stage does not constitute a waiver of those rights.

12. Incomplete or indecipherable entries will be deemed invalid.

13. The best (1) valid entry, as determined by the judges, will be deemed the major prize winner will win:

A Sensis Marketing products and services to the maximum value of $8,000 [including GST] to be used for the winner’s nominated business; and
• $2,000 prepaid Visa card – valid for twelve (12) months from date of issue.

Total prize pool is up to $10,000 (Including GST). Prize does not include any ancillary costs associated with redeeming this prize. These are the responsibility of the winner.

14. The Sensis Marketing component of the prize cannot be put towards any Sensis products or services that the winner has contracted with Sensis Pty Ltd for before or during the Promotion Period, whether the winner has started using the products/services or not. The prize can be used on any available Sensis Marketing products or services except for Yellow Pages® Awareness Products such as book covers and spines. The prize will be applied to products and services at the current rate card prices and is subject to the standard terms and conditions of Sensis Marketing products and services (such as print book close dates, inventory restrictions and automatic renewal).

15. The Sensis Marketing component of the prize must be redeemed in full by 20 December 2013. The prize is subject to the standard terms and conditions of the service provider Sensis Pty Ltd. Any ancillary costs associated with redeeming the prize are not included. Any unused balance of the Sensis Marketing component of the prize will not be awarded as cash.

16. Prepaid Visa Card is valid for twelve (12) months from the date of issue. Redemption of the Prepaid Visa Card is subject to the terms and conditions stipulated on the Prepaid Visa Card. The Promoters will not be liable for any Prepaid Visa Card that has been lost, stolen, forged, damaged or tampered with in any way. Any ancillary costs associated with redeeming a Prepaid Visa Card are not included. Any unused balance of the Prepaid Visa Card will not be awarded as cash.

17. In acceptance of the prize, the Winner acknowledges that they may incur ongoing costs associated with the prize which are the entire responsibility of the winner.

18. Prize is subject to the standard terms and conditions of individual prize and service providers.

19. In the event that for any reason whatsoever the Winner does not take the prize at the time stipulated by the Promoters, then the prize will be forfeited by the Winner and cash will not be awarded in lieu of the prize.

20. In the event that a prize, or part of a prize, is unavailable, the Promoters reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification subject to any written directions from the various Lottery Departments.

21. The Promoters is neither responsible nor liable for any late lost or misdirected mail (including but not limited to prizes).

22. The Promoters is not responsible nor liable for any prize damaged in transit in the delivery of their prize

23. As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoters and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

24. In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster)the Promoters reserves the right to subject to reference to all relevant state and territory rules and regulations, to cancel, terminate, modify or suspend the promotion.

25. If a medical circumstance in some way restricts your ability to enter the competition through the required mechanic, you are still eligible to enter however you must briefly state your circumstances upon entry.

26. If your entry is selected as a winning entry, validation of your circumstances/ the validity of your entry will be undertaken by the Promoters. Method of validation (without limitation) will be determined by the Promoters in its complete discretion. If the winning entry is deemed to be a winner, the winner will be notified as per the terms and conditions herein. In the event that the Promoters requests the entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoters. It is a condition of accepting the prize the winner sign any such legal documentation.

27. All entries submitted become the property of the Promoters. Entries will not be returned to any entrant. As a condition of entering into this promotion, each entrant licences the Promoters to use their entry in any media for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes. Each entrant warrants to the Promoters that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party. The entrant agrees to indemnify the Promoters against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).

28. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoters, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoters reserve the right, in their sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

29. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

30. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

31. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoters’’ control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the promoters) due to any reason beyond the reasonable control of the promoters; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a business owner; or (f) use of the prize.

32. The collection, use and disclosure of personal information provided in connection with this competition is governed by ACP Magazines Ltd Privacy Notice (see contents page for location in this issue) and the Sensis Privacy Collection Statement (available at http://www.about.sensis.com.au/Privacy-Collection-Statement).

33. By entering the promotion, unless otherwise advised by the entrant, each entrant consents to the information they submit with their entry being used by the Promoters in accordance with their privacy statements, including use in any media for future promotional, marketing and publicity purposes without any further reference or payment to the entrant. Entrants also consent to Sensis using their information for marketing and promotional purposes on the terms of the privacy statement (entrants can opt-out of such marketing by calling Sensis on 1800 736 747). A request to access, update or correct any information should be directed to each of the Promoters.
