Information on how to enter and prizes form part of these Terms and Conditions. Participation in this Promotion is deemed acceptance of these Terms and Conditions.
Entry to the Promotion is open to residents of Australia aged 18 years and over who fulfill the entry requirements.
Directors, management, employees, officers and contractors (and their immediate families) of the Promoter or of participating retailers, foodservice outlets, agencies or companies associated with this Promotion are ineligible. "Immediate families" means spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the director, manager, employee, officer or contractor. 6.The Promotion commences at 09:00AEST on 03/12/2012 and closes at 17:00AEDT on 28/02/2013 (the "Promotional Period").
Multiple entries permitted, subject to the following: (a) only one entry permitted per specified purchase requirement; and (b) each entry must be submitted separately and in accordance with entry requirements.Entrants must retain their original purchase receipt(s) as proof of purchase for all entries. The Promoter reserves the right to request the proof of purchase at any time. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of all of an entrant's entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to entry.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Incomplete, indecipherable or illegible entries will be deemed invalid. Any incorrect details submitted may render the corresponding entry invalid.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
The draw will take place at Aura Interactive Pty Ltd, C15/372 Wattle Street, Ultimo NSW, 2007 on 01/03/2013 at 12:00 AEDT. The first three (3) valid entries drawn will win a Major Prize being Pinarello Dogma 2013 model frame set including Campagnolo super record group set, Fulcrum racing 3 wheels, Vredestrain tyres and tubes, Most carbon wrap bars and stem and Most saddle. RRP$AU12,000.00 inclusive of GST (the Major Prize).
The next one hundred (100) valid entries drawn will each win a Riders Kit consisting of a Netti Breeze Cycling Jersey Black RRPAU$49.90, a pair of Altura Cadence lycra cycling shorts RRP$31.99 and one Walzcap moisture wicking polyester cycling cap RRP$27.95 ("Runners-Up Pack"). Each Runners-Up Pack valued at RRP$109.84 inclusive of GST.

Prizes will be delivered to winners within 28 days of prize draw.
Major Prize winners will be notified by telephone and mail within 2 days of the prize draw and winners' names (and address for any SA winners) will be published in The Australian newspaper on 08/03/2013. Runner-Up prize winners will be notified by mail within 2 days of the prize draw.
A second draw for any unclaimed Prize will take place on 03/06/2013 at the same time and place as the original draw, subject to any directions from a regulatory authority. Major Prize Winners will be notified by telephone and mail with 2 days of the second chance draw and their names (and address for any SA winner) will be published in The Australian newspaper on 07/06/2013. Runner-Up prize winners will be notified by mail within 2 days of any second chance draw.
Subject to the unclaimed prize draw clause above, if for any reason a winner does not collect their Prize within a reasonable time stipulated by the Promoter, then the Prize will be forfeited.
The Prize, or any unused portion of a Prize, are not transferable or exchangeable and cannot be taken as cash.
The Promoter's decision is final and no correspondence will be entered into.
Prizes will be sent, at the Promoter's cost, to the address in Australia supplied by the entrant on their entry.
If any Prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
The Promoter assumes no responsibility for any failure to receive a claim or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then the Promoter may modify, cancel, terminate or suspend the Promotion unless to do so would be prohibited by law and subject to the regulations of the gaming authorities.
The Promoter may, at its absolute discretion, disqualify all entries from any person, and prohibit that person's further participation in this Promotion, if the entrant: (i) fails to establish their entitlement to enter the Promotion to the Promoter's satisfaction; or (ii) tampers with or benefits from any tampering with the entry process or the operation of the Promotion; (iii) submits an entry which in the Promoter's opinion is not in accordance with these Terms and Conditions; or (iv) acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees or any implied condition or warranty the exclusion of which from these Terms and Conditions would contravene any statute or cause any part of these Terms and Conditions to be void ("Non-Excludable Condition"). Except for liability in relation to a Non-Excludable Guarantees, the Promoter excludes from these Terms and Conditions all conditions, warranties and terms implied by statute, general law or custom. Except for liability in relation to a Non Excludable Condition, the Promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, without limitation, the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) any tax implications; and/or (f) a Prize or use of a Prize.
Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage in transit to Prizes.
Any costs associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.
The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
If this Promotion is interfered with in any way (including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures) or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, unless to do so would be prohibited by law, to (a) cancel, terminate, modify or suspend the Promotion, and/ or (b) invalidate any affected entry(s), subject to the approval of the gaming authorities in each state and territory, where required.
The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, (including but not limited to) any injury or damage to participants or any other person's computer related to or resulting from participation in or downloading any materials in this Promotion.
