TERMS AND CONDITIONS
1. Information on how to enter and all prize details form part of these Terms and Conditions. Participation in this competition is deemed acceptance of these Terms and Conditions.
2. Entry in this competition is open to all Australian residents ("Eligible Entrant"), with the exception of officers, employees and agents (and their immediate families) of the Promoter.
3. The competition commences at 12.01am (EST – Daylight Saving) on 22 February 2013 and closes at 11.59pm (EST – Daylight Saving) 24th May 2013 ("Competition Period").
4. To submit a valid entry into the draw you ("Competition Entrant") must enter through our online entry form located on the competition website
www.vippetfoods.com.au/fussycatpromo, by uploading an original photograph taken by the Competition Entrant (and not from any copyrighted source) in high resolution JPEG or GIF or PNG or TIFF format with a maximum file size of 3MB ("the Photograph") with text on image.
5. The Photograph must be accompanied by the Competition Entrant's details including name, residential address, telephone number, email address and a brief description of the image. It must also include a caption to be deemed an entry.
6. The Photograph must not contain brand names or trademarks and should the image show people who may be recognisable, the use of such image must be acknowledged by that person as a condition of entry, in the case of persons under 18 years of age usage clearance must be obtained from their parent or legal guardian.
7. An Eligible Entrant may submit as many entries as they wish (which are to be separately submitted) during the Competition Period but must have proof of purchase via docket. 8. The Promoter reserves the right, at any time, to verify the validity of entries with each Competition Entrant (including but not limited to checking their identity and age) and to disqualify any Competition Entrant and to immediately remove entries from the Competition Website for tampering with the entry process or for submitting an entry that is not in accordance with the competition's Terms and Conditions.
9. The Promoter reserves the right to exclude digital files that are not sufficiently high quality, with illegible and incomplete entries to be deemed invalid.< br/> 10. The Promoter at their sole discretion can choose to keep or remove entries from the Competition Website on completion of the competition in accordance with the Competition's terms and conditions.
11. Entries will be judged by representatives of the Promoter ("the judges") and the judges' decision is final and binding on all Competition Entrants and no correspondence will be entered into.
12. Selection of the competition winners by the judges will take place on 26 May 2013.
13. The judges at their sole discretion will choose 5 competition winners. The competition winners are to receive Apple ipads 2 ("the prize"). The prize is valued in the sum of AU$500 (including GST), valued as at January 7th 2013 and the prize or portions thereof (if there is more than one (1) competition winner) are not transferable or exchangeable, cannot be sold and may not be taken as cash. 100 sample packs of 500g Fussy Cat Grainfree Dry Food will be awarded to individuals who 'like' the VIP facebook page during the competition period. These winners are selected at random by the representatives of the Promoter from those individuals meeting the criteria. 14. If a competition winner is under 18 years of age, the prize or portions thereof will be awarded to the competition winner's parent or guardian.
15. In the event that for any reason whatsoever a competition winner does not take the prize or portion thereof, then that prize or portion thereof will be forfeited by that competition winner.
16. Where the prize or portion thereof is forfeited or otherwise remains unclaimed, the Promoter is not obliged to conduct any further draws.
17. Each competition winner will be notified by phone using the contact details provided in their online entry form. The prize or portion thereof will then be delivered to each competition winner's residential address using the contact details provided in their online entry form.
18. By entering the competition, each Competition Entrant warrants to the Promoter and any of its' related entities that the Photograph is the original design or artistic work of the Competition Entrant and has not been wholly or partially copied from any other design or artistic work, and does not infringe on the intellectual property rights of any third party. The Competition Entrant agrees to wholly indemnify the Promoter and any of its' related entities against all claims and demands by third parties (and all costs and expenses arising thereto) from a breach of this warranty.
19. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) and any of its' related entities excludes all liability for any loss or damage (including loss of opportunity) arising in any way out of the competition, including, but not limited to, any technical difficulties or malfunction (whether or not under the Promoter's control); any theft or unauthorised access or interference by third parties; and any prize claim or portion thereof that is late, lost, altered, damaged or misdirected due to any reason beyond the reasonable control of the Promoter.
20. The intellectual property in the Photograph remains the property of the owner however all images are submitted in the acknowledgement and understanding that the Promoter or any of its' related entities may use them for an unlimited period for promotional purposes (whether or not the Competition Entrant is a competition winner) including (but not limited to) promoting any products manufactured, distributed and/or supplied by the Promoter or any of its' related entities and for any other advertising and/or marketing strategies without hindrance, royalty free and without compensation or payment.
21. The Promoter or any of its' related entities reserves the right to announce or publish any competition winner's name and/or Photograph for promotional purposes including (but not limited to) promoting any products manufactured, distributed and/or supplied by the Promoter or any of its' related entities and for any other advertising and/or marketing strategies without hindrance, royalty free and without compensation or payment. It is condition of entry into this competition that competition winners' will consent to the Promoter doing so.
22. The Promoter collects personal information in order to conduct the competition and may, for this purpose, disclose such information to third parties, where necessary. Entry into this competition is conditional on providing this information and by entering the competition, each Competition Entrant consents to the Promoter disclosing this information. The Promoter or any of its' related entities may, for an unlimited period, continue to use this information for promotional and profiling purposes, unless otherwise advised by a Competition Entrant.
