mX LEGALLY BLONDE COMPETITION TERMS AND CONDITIONS
1. The promoter is The Herald & Weekly Times Pty Ltd (ABN 49 004 113 937) of 40 City Road, Southbank, Victoria, 3006.
2. Instructions on how to enter this competition form part of the conditions of entry. Entry into the competition is deemed acceptance of these terms and conditions.
3. Entry is only open to residents of Victoria aged 18 years and over at the time of entry. Employees of the Promoter and their immediate families, directors, management, related companies, and their agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

To enter you must do either of the following:
• email your photos with your full name and contact number to us at
mxsnaps@news.com.au with the word ‘legally blonde mX comp’ in the subject line; or
• hashtag(#)yourInstagramphotosofyou,yourfriends,yourworkcolleaguesorevenyour pooch #mxsnaps and #legallyblondeoz and email your photos with your full name and contact number to us at mxsnaps@news.com.au with the word ‘legally blonde mX comp’ in the subject line5. The competition commences at 15:00 on Tuesday, 14 May 2013 and finishes at midnight on Wednesday, 22 May 2012.
6. The time of entry will in each case be the time the email is received in the inbox of the mX’s email account at
mxsnaps@news.com.au.
7. The following conditions apply to all photographs submitted in this competition:
• To be eligible for entry, photographs must be visible to all Instagram users on an entrant’s
Instagram profile. Photographs that are only visible on a private Instagram profile will not
be eligible for entry.
• Photographs must be the original work of the entrants. By submitting a photograph, each
entrant warrants that the photograph is an original artistic work of the entrant, and he or
she has not licensed or assigned any rights in that photograph to any third parties.
• Entrants must not include any other person in their photograph without that person’s
consent or, if that person is under 18 years of age, that person’s parent‘s or guardian’s, express consent. Entrants warrant that if any other person is included, they have obtained the express consent of the relevant person.
• Entrants must not include in their photograph any content that contravenes any law, infringes the rights of any person or is obscene, offensive or otherwise inappropriate or defamatory.
• Entrants must not include in their photograph any item in which copyright or trade mark rights subsists, unless they are entitled to do so. By including any item in their photograph entrant’s warrant that they are entitled to do so.
• The entrants grant the Promoter a perpetual, irrevocable non-exclusive, royalty free, worldwide licence (including the right to sub licence to any third party, including the Marriner Group) to publish the photographs (including the name of the entrant) in print (including in the mX newspaper) and/or on the Internet including on Facebook and other social media sites and to store them on an electronic database to use them at any time in the future for promotional purposes at no cost to the Promoter.
• Photographs submitted with entries are non-exclusive to the competition and subject to the rights of the Promoter under these terms and conditions the copyright holder retains all rights under intellectual property law save that entrants waive any moral rights in their entry for the purposes of its submission to and publication by the Promoter (or The Marriner group).
• Each entrant indemnifies the Promoter against claims and costs by third parties arising from a breach of any of the conditions in this paragraph.
8. The most creative entry submitted in accordance with these terms and conditions will win:
• VIP tickets to Legally Blonde The Musical and a pre-show party for you and 3 friends.
• Including photo with cast
The 8 runner up prizes in accordance with these terms and conditions will win:
• A double pass to see Legally Blonde The Musical VIP package total: ($250 per person) $1000
Runner up package total: ($99 per ticket) $1,584 Total prize pool valued at $2,584
9. Entrants will be judged at midday on 23 May 2013 at the offices of the Promoter (at 40 City Road, Southbank, Victoria, 3006) by representatives of the Promoter and the Marriner Group. The Judges’ decision is final and binding. No correspondence will be entered into. Judging will be by suitably qualified judges able to assess the quality and creativity of the entries and each entry will be judged on its merits. Chance plays no part in determining the winners.
10. The winners will be notified by phone and by email on 23 May 2013. The winners’ names and the photographs that formed part of their winning competition entries will be published in mX on Thursday, 29 May 2013.
11. Any additional charges are the responsibility of the winners. The Promoter accepts no responsibility for any variation in the prize value.
12. The Promoter, its agents, affiliates or representatives will not be liable for any lost, late or misdirected entries.
13. If the prize or any part of the prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter will endeavour but is not obliged to provide a substitute prize of equivalent value.
14. The prize winners must, at the Promoter's request, participate in any marketing and promotional activity in relation to winning the prize, free of charge, and consent to the Promoter's using their name and image in such promotional material.
15. In the event that a winner does not take the prize, then the prize will be forfeited by the winner and cash will not be awarded in lieu of the prize. Prizes must be taken as offered and cannot be varied. Any unused portion of the prize is not-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken as cash.
16. Competition entrants acknowledge that this promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram or Facebook.
17. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these terms and conditions of entry, or who has, in the opinion of the Promoter, engaged in conduct in entering the promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
18. If for any reason, this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available and to cancel, terminate, modify or suspend the competition subject to any written directions given under State Legislation.
19. Nothing in these terms and conditions excludes or varies any warranty or liability of the Promoter under the Competition and Consumer Act (Cth) or equivalent State or Territory legislation that cannot by law be excluded, restricted or varied. However, the Promoter excludes all rights, remedies, conditions and warranties in respect of goods or services from your entry into this competition or your enjoyment of the prize whether based in statute, common law or otherwise to the extent permitted by law. To the extent permitted by law, the winning entrant must exclude, release and forever discharge the Promoter, Instagram or Facebook and all other persons involved in the conduct, promotion and organisation of this competition and their respective employees, officers, agents and contractors from all liability for claims, loss, damage, cost or expenses (whether arising under statute, from negligence, personal injury, death, property damage, infringement of third party rights or otherwise) arising directly or indirectly (including, but not limited to direct, indirect, special or consequential loss or damage, loss of opportunity, revenue or profit) or in connection with the participation in the relevant prize or attendance at any venue or otherwise howsoever arising. The winning entrant must, on request of the Promoter, execute any and all documentation (if any) necessary to give effect to this clause.
20. The Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

When entering the competition, competition entrants provide their personal information to the Promoter, not Instagram or Facebook. mX collects your personal information to assist us in providing our products or services to you, to process your competition entries, and to improve our products and services. We or any of our Australian related companies may be in touch by any means (including email or SMS) at any time to let you know about goods, services, or promotions which may be of interest to you. We may also share your information with other persons or entities who assist us in providing our services, running competitions or with other companies who provide prizes for competitions or reader offers.
