TERMS AND CONDITIONS

1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to residents of NSW, VIC and WA. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

3. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to all terms and conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to this Promotion.

4. The “IMAX - Fast and Furious” online promotion commences on Wednesday 22/05/2013 and closes 11:59pm AEST on Friday 14/06/2013 (“Promotional Period”).

5. One (1) winner and (4) runners up will be selected from combined entries from both Hoyts Insider and Hoyts Rewards clubs and will be notified by 5pm on Monday 17th June, 2013, via phone and in writing; via email. If the winner does not respond to contact made by Monday 24th June 2013, by 5pm the prize will be forfeited and redrawn to the next available winner. No replacement prize will be given. Failure to present proof of IMAX ticket purchase will result in a re-draw. Hoyts Rewards Members should log in when buying online or present themselves as a rewards member at box office.

6. To enter, entrants must be a member of either the Hoyts Insider or Hoyts Rewards and visit www.hoyts.com.au during the promotional period to purchase a ticket to any film in Hoyts IMAX only, and complete their online entry by answering in 25 words or less: “What is the best film you’ve seen in Hoyts IMAX and what made it so awesome?" Non-members can sign up to either the Hoyts Insider or Hoyts Rewards during the promotional period and complete the same entry process as outlined above.

7. IMAX tickets can be purchased in-cinema box office or online, for Hoyts IMAX locations only. Original proof of ticket purchase must be retained and presented if you are selected as the winner (ie. online receipt number or ticket stub). Proof must be original and must be surrendered by the winner(s).

8. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

9. Incomplete or indecipherable entries will be deemed invalid.

10. One entry per member and per ticket purchased at www.hoyts.com.au  to any film in Hoyts IMAX are permitted subject to the following: (a) only one (1) entry permitted per member; (b) entry must be submitted by answering the promotional question in 25 words or less; and (c) entry must be submitted in accordance with entry requirements. 

11. This is a game of skill.  Chance plays no part in determining the winner.  Each entry will be individually judged based on literary and creative merit.  All entries must be the original independent creation of the entrant and free of any claims that they infringe any third party rights.  Entries must not have been published previously and/or have been used to win prizes in other competitions. The best valid entries from both Hoyts Insider and Hoyts Rewards Members will be judged by Hoyts Corporation as the best/most creative entries and only one will win the major prize. Judges’ decision is final and no correspondence will be entered into.

12. The judges reserve the right to disqualify any entrant submitting an entry which, in the opinion of the judges, includes objectionable content, including but not limited to profanity, nudity, potentially insulting, scandalous, inflammatory or defamatory images or language.  The judge’s decision will be final and no correspondence will be entered into.

14. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
20. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

15. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

16. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.

17. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and as required, to regulatory authorities. Entry is conditional on providing this information. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
