CONDITIONS
ELIGIBILITY
1. Entry and voting is only open to Australian residents aged 13 years or over. Participants aged between 13 and under 18 years must have parental/guardian approval to enter and/or vote and further, the parent/guardian of the participant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor participating in this promotion.
2. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter or vote. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3. Individuals must have a current Facebook account to be able to access the promotional entry and voting page from a desktop computer. However, individuals do not need a Facebook account to access the promotional entry and voting page from a web enabled mobile device.
PHASE ONE - ENTRY SUBMISSION
4. Entry into Phase One of the promotion will be open from 15/04/2013 to 11.59pm AEST on 09/06/2013 (“Entry Period”).
5. To enter, eligible individuals must visit bringsomething.com.au or (“Promotional Page”) (where they will be redirected to the Lenard‟s Chicken Facebook page at facebook.com/lenardschicken if entering via a desktop computer or the mobile promotional page if entering via a web enable mobile device) and complete the following steps during the Entry Period:
a) If they are entering via a desktop computer, click on the “Bring Something to the Table” application (“Application”) located on the application tab, allow access for the Application to their profile as requested and follow the prompts to access the entry form, or if they are entering via a web enabled mobile device and follow the prompts to access the mobile entry form;
b) fully complete the entry form, including all of the requested details;
c) upload an original photograph or an original video of a special moment that they have shared around a table (“Submission”). Subject to the restrictions outlined in clauses 6 and 32, the special moment can be anything as long as it occurs around a table (e.g. it could be a kid‟s magic trick, an impersonation, a silly noise, a funny face, a dance, a funny pet, etc). Photographs must be submitted in jpg, gif, or png format

and must not exceed 1 MB file size. Video files must not exceed 1 minute in length, 10 MB in file size and must be submitted in avi, mov or mp4 format;
d) read and consent to the Terms and Conditions and tick the appropriate tick boxes (as featured on the entry form); and
e) submit the fully completed online entry form so that it is received by 11.59pm AEST on 09/06/2013.
6. Each participant warrants to the Promoter that each Submission is an original work of the participant that does not infringe the rights of any third party. The participant also warrants that they have obtained permission from each person (or owner of each item or animal) featured in their Submission to the uses of the Submission as anticipated in these Terms and Conditions. All Submissions must be in compliance with these Terms and Conditions and in particular clause 32.
7. Multiple entries into Phase One are permitted, subject to the following: (a) each Submission must be substantially unique; and (b) each entry must be submitted separately and in accordance with entry requirements.
8. Subject to review and approval by the Promoter, entries (in particular the Submissions, together with the relevant participant‟s name) will be displayed on the Promotional Page and made subject to a public vote.
9. All entries are subject to review by the Promoter for compliance with these Terms and Conditions (prior to and after being uploaded to the Promotional Page). Entries that do not comply with these Terms and Conditions or that otherwise contain prohibited, or inappropriate content, as determined by the Promoter, will be disqualified, removed from the Promotional Page and will not be considered eligible. All final determinations as to which entries are eligible to take part in this promotion are at the Promoter‟s sole discretion and no correspondence will be entered into. The Promoter has the right to automatically remove any entries that contain inappropriate content (in the opinion of the Promoter).
Participants will be able to „share‟ their entry with their Facebook friends by following the prompts in the email sent to the participant by the Promoter, after the participant‟s entry has been received, reviewed/moderated, in order to encourage their friends to vote for them. However, „sharing‟ is not mandatory and it is up to each participant whether they wish to „share‟ their Submission.
PHASE TWO – VOTING
10. Phase Two starts on 15/04/2013 and ends at 11.59pm AEST 16/06/2013 (“Voting Period”).
11. To vote for their favourite entry submitted during Phase 1, individuals must visit the Promotional Page (where they will be redirected to the Lenard‟s Chicken Facebook page at facebook.com/lenardschicken if they are on a
desktop computer or the mobile promotional page if they are on a web enabled mobile device) and complete the following steps during the Voting Period:
a) If they are on a desktop computer, click on the promotional Application located on the application tab, allow access for the Application to their profile as requested and follow the prompts to access the voter page, or if they are entering via a web enabled mobile device and follow the prompts to access the mobile voter page;
b) follow the prompts on screen to vote for their favourite entry (from the entries featured on screen).
12. The following limits apply to voting:
only one (1) vote per person per Submission is permitted. For the sake of clarity, individuals will be able to vote multiple times, however, each individual can only vote once for each Submission; and
only one (1) vote per Facebook account per Submission is permitted.
PHASE THREE – SUBMISSIONS FINALIST SELECTION
13. Subject to clause 14, the ten (10) participants who submit valid entries that receive the most valid votes as at the conclusion of the Voting Period will each become a finalist (“Finalists”).
14. In the event that there is a tie for a Finalist spot between two (2) or more participants, the Promoter will judge the tied entries (based on the originality, creativity and entertainment value of the tied participants‟ Submissions) and determine, in its absolute discretion, the ranking of each participant in order to determine the ten (10) Finalists.
15. Finalists will be selected based on the outlined criteria and chance plays no part in the selection of any Finalist.
PHASE FOUR – SUBMISSIONS WINNER SELECTION
16. Lenard‟s founder, Len Poulter, will judge the Finalists determined in Phase Three on the basis of originality, creativity and the entertainment value of each Finalist‟s Submission, and select the Finalist that submitted his favourite Submission as the winner (“Winner”).
17. The Winner will receive a family holiday package to a destination in Australia every year for ten (10) years. Each family holiday package will be awarded in the form of a AU$4,000 voucher with Free-2-Travel group that will be redeemable toward a holiday for up to four (4) adults to the winner‟s preferred destination in Australia. The value of the voucher can be used toward flights, accommodation, transfers and selected meals. Each voucher must be redeemed within a period of twenty four (24) months of issue. The voucher will be issued on 1st of August each year, starting on 01/08/2013. In the event that the winner selects a holiday package that exceeds $4,000 in any one year, any difference will be payable by the winner (however, individuals can
combine two (2) vouchers to use toward a single holiday during the period where two vouchers are valid). If the winner selects a holiday package that is less than $4,000 in any one year, any remainder of the $4,000 will be forfeited and will not be rolled over to the next year(s) holiday package or awarded as cash. A total of ten (10) $4,000 vouchers will be awarded. All holiday packages are subject to the standard terms and conditions of Free-2- Travel group and individual services providers (including but not limited to booking and flight availability). A single voucher cannot be used toward more than one (1) holiday, however, two (2) vouchers can be combined and used toward one (1) holiday during the period where the validity of any two (2) vouchers overlaps. Any ancillary costs associated with redeeming the holiday voucher are not included. Total value of the prize is up to AU$40,000, depending on the holiday package selected by the winner each year.
All travel using the vouchers is subject to availability at all times and may be dependent on select seat class with airlines or specific room category availability with accommodation partner. All travel vouchers must be booked through Free-2-Travel and their suppliers, no direct bookings are permitted. Vouchers (or any portion of a voucher) are not redeemable for cash or cash products ie, Travelex, foreign currency etc. All bookings and documentation regarding each voucher must be made via Free-2-Travel Holidays Pty Ltd or their agents. Redeeming the prize is conditional on acceptance of the terms and conditions of travel as detailed by Free-2-Travel Holidays Pty Ltd and the airline carriers in accordance with normal travel practices. Vouchers are not refundable or transferable. In the event the winner is under the age of 18 years, they must be accompanied by a parent/guardian during all travel booked using the voucher. The Winner is responsible for any amendment fees issued by airlines or suppliers once booking is confirmed and ticketed, due to changes requested by the winner. Any visas, valid passports, spending money and any other similar ancillary costs, including but not limited to insurance and any applicable insurance excesses, not listed above are the responsibility of the travel prize winner and his/her nominated travelling companions as incurred (and cannot be paid using the voucher). It is the winner's responsibility to organise transport to/from the airport departure/return points for any holidays booked with the vouchers. The Promoter recommends that the winner and their companions obtain travel insurance for any holiday, however, costs of such insurance must be covered by the winner and their companions as incurred (and cannot be covered using the voucher).
18. Len Poulter may rank each Finalist in order from best to worst, in case that an invalid Finalist is initially selected as the Winner and needs to be invalidated. In such a case, the next best valid Finalist would be selected as the new Winner.
19. This is a game of skill and chance plays no part in selection of the Winner.
20. The Winner will be notified via email and telephone.
DISCOUNT OFFERS
21. Upon submission of a valid entry in Phase One, each participant will receive a discount offer (featured on the thank you/successful entry page) from the Promoter that will be redeemable for a product or discount (as indicated on the offer) at the participant‟s local Lenard‟s store. Only one (1) offer will be available during the Entry Period and each participant who enters will receive the same offer. There is a limit of one (1) offer per transaction. The offer will be subject to the conditions specified on the offer. For the sake of clarity, individuals will not be eligible to receive the discount offer (or any other offer or prize) for voting in the promotion.
GENERAL
22. Information on eligibility requirements, how to enter and vote and the prize and discount offers form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
23. The Promoter reserves the right, at any time, to verify the validity of entries, votes and participants (including a participant‟s identity, age and place of residence) and to disqualify any participant who submits an entry or vote that is not in accordance with these Terms and Conditions or who tampers with the entry or voting process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
24. The Promoter reserves the right, at any time: (a) to invalidate any votes which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information and/or votes that have been submitted through the use of multiple identities, email addresses or accounts, including but not limited to social networking accounts; and/or(b) to disqualify any individual (or invalidate his/her entry and/or vote) that the Promoter reasonably suspects has paid, bartered or offered payment or other consideration to another person in exchange for votes or has otherwise encouraged or procured any person to submit votes contrary to these Terms and Conditions.
25. Incomplete or indecipherable entries and votes will be deemed invalid.
26. If there is a dispute as to the identity of a participant, the Promoter reserves the right, in its sole discretion, to determine the identity of the participant.
27. The Promoter‟s decision is final and no correspondence will be entered into.
28. If the Winner is under 18 years of age, the prize will be awarded to the Winner‟s parent/legal guardian on the Winner‟s behalf. If any person taking a holiday is under 18 years of age, a parent/legal guardian must accompany such a person for the entire duration of the holiday.
29. If for any reason the Winner does not take the prize (or an element of the prize) or any participant does not redeem a discount offer, by the time stipulated by the Promoter, then the prize (or that element of the prize) or the discount offer (as applicable) will be forfeited.
30. If the prize (or part of a prize) or a discount offer is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) or discount offer with a prize or discount offer (as applicable) of an equal value and/or specification.
31. The prize (or any unused portion of the prize) and discount offers are not transferable or exchangeable and cannot be taken as cash, unless indicated otherwise by the Promoter.
32. When a participant submits any materials via the promotion including comments and Submissions (“Content”), the participant, unless the Promoter advises otherwise, licenses and grants the Promoter, its affiliates and sub- licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. Participants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.
Participants agree that they are fully responsible for the Content they submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove any Content without notice for any reason whatsoever. Participants warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (b) they will obtain prior consent from any person or property that appears in their Content; (c) they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (d) their Content shall not contain viruses or cause injury or harm to any person or entity; and (e) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
Without limiting any other terms herein, the participant agrees to indemnify the Promoter for any breach of the above terms.
33. Participants consent to the Promoter using their name, likeness, image and/or voice in the event they are the Winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any
outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
34. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any participant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
35. Any cost associated with accessing the Promotional Page is the participant‟s responsibility and is dependent on the Internet service provider used.
36. The use of any automated entry or voting software or any other mechanical or electronic means that allows a participant to automatically enter or vote repeatedly is prohibited and will render all entries and/or votes submitted by that participant invalid.
37. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
38. Except for any liability that cannot by law be excluded, including the Non- Excludable Guarantees, the Promoter (includingits respective officers, employees and agents)is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter‟s control); (b) any theft, unauthorised access or third party interference; (c) any entry, vote or prize/offer claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by the Winner or participants; or (f) use, redemption, taking or collection of a prize or a discount offer.
39. As a condition of accepting the prize, the Winner (or the winner‟s parent/legal guardian if the winner is under the age of 18 years) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
40. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry and voting is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the participant. Participants should direct any request to opt out, access, update or correct information to the Promoter. All entries and votes become the property of the Promoter.
41. Entry and continued participation in the promotion via a desktop computer is dependent on participants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php.
42. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Participants understand that they are providing their information to the Promoter and not to Facebook. The information a participant provides will only be used for the purposes outlined in these Terms and Conditions. 13. Subject to clause 14, the ten (10) participants who submit valid entries that
receive the most valid votes as at the conclusion of the Voting Period will
each become a finalist (“Finalists”).
14. In the event that there is a tie for a Finalist spot between two (2) or more
participants, the Promoter will judge the tied entries (based on the originality,
creativity and entertainment value of the tied participants‟ Submissions) and
determine, in its absolute discretion, the ranking of each participant in order to
determine the ten (10) Finalists.
15. Finalists will be selected based on the outlined criteria and chance plays no
part in the selection of any Finalist.
PHASE FOUR – SUBMISSIONS WINNER SELECTION
16. Lenard‟s founder, Len Poulter, will judge the Finalists determined in Phase
Three on the basis of originality, creativity and the entertainment value of
each Finalist‟s Submission, and select the Finalist that submitted his favourite
Submission as the winner (“Winner”).
17. The Winner will receive a family holiday package to a destination in Australia
every year for ten (10) years. Each family holiday package will be awarded in
the form of a AU$4,000 voucher with Free-2-Travel group that will be
redeemable toward a holiday for up to four (4) adults to the winner‟s preferred
destination in Australia. The value of the voucher can be used toward flights,
accommodation, transfers and selected meals. Each voucher must be
redeemed within a period of twenty four (24) months of issue. The voucher
will be issued on 1
st of August each year, starting on 01/08/2013. In the event
that the winner selects a holiday package that exceeds $4,000 in any one
year, any difference will be payable by the winner (however, individuals can
combine two (2) vouchers to use toward a single holiday during the period 4
where two vouchers are valid). If the winner selects a holiday package that is
less than $4,000 in any one year, any remainder of the $4,000 will be
forfeited and will not be rolled over to the next year(s) holiday package or
awarded as cash. A total of ten (10) $4,000 vouchers will be awarded. All
holiday packages are subject to the standard terms and conditions of Free-2-
Travel group and individual services providers (including but not limited to
booking and flight availability). A single voucher cannot be used toward more
than one (1) holiday, however, two (2) vouchers can be combined and used
toward one (1) holiday during the period where the validity of any two (2)
vouchers overlaps. Any ancillary costs associated with redeeming the holiday
voucher are not included. Total value of the prize is up to AU$40,000,
depending on the holiday package selected by the winner each year.
All travel using the vouchers is subject to availability at all times and may be
dependent on select seat class with airlines or specific room category
availability with accommodation partner. All travel vouchers must be booked
through Free-2-Travel and their suppliers, no direct bookings are permitted.
Vouchers (or any portion of a voucher) are not redeemable for cash or cash
products ie, Travelex, foreign currency etc. All bookings and documentation
regarding each voucher must be made via Free-2-Travel Holidays Pty Ltd or
their agents. Redeeming the prize is conditional on acceptance of the terms
and conditions of travel as detailed by Free-2-Travel Holidays Pty Ltd and the
airline carriers in accordance with normal travel practices. Vouchers are not
refundable or transferable. In the event the winner is under the age of 18
years, they must be accompanied by a parent/guardian during all travel
booked using the voucher. The Winner is responsible for any amendment
fees issued by airlines or suppliers once booking is confirmed and ticketed,
due to changes requested by the winner. Any visas, valid passports,
spending money and any other similar ancillary costs, including but not
limited to insurance and any applicable insurance excesses, not listed above
are the responsibility of the travel prize winner and his/her nominated
travelling companions as incurred (and cannot be paid using the voucher). It
is the winner's responsibility to organise transport to/from the airport
departure/return points for any holidays booked with the vouchers. The
Promoter recommends that the winner and their companions obtain travel
insurance for any holiday, however, costs of such insurance must be covered
by the winner and their companions as incurred (and cannot be covered
using the voucher).
18. Len Poulter may rank each Finalist in order from best to worst, in case that an
invalid Finalist is initially selected as the Winner and needs to be invalidated.
In such a case, the next best valid Finalist would be selected as the new
Winner.
19. This is a game of skill and chance plays no part in selection of the Winner.
20. The Winner will be notified via email and telephone.
DISCOUNT OFFERS
21. Upon submission of a valid entry in Phase One, each participant will receive a
discount offer (featured on the thank you/successful entry page) from the
Promoter that will be redeemable for a product or discount (as indicated on
the offer) at the participant‟s local Lenard‟s store. Only one (1) offer will be
available during the Entry Period and each participant who enters will receive
the same offer. There is a limit of one (1) offer per transaction. The offer will
be subject to the conditions specified on the offer. For the sake of clarity,
individuals will not be eligible to receive the discount offer (or any other offer
or prize) for voting in the promotion.
GENERAL
22. Information on eligibility requirements, how to enter and vote and the prize
and discount offers form part of these Terms and Conditions. Participation in
this promotion is deemed acceptance of these Terms and Conditions.
23. The Promoter reserves the right, at any time, to verify the validity of entries,
votes and participants (including a participant‟s identity, age and place of
residence) and to disqualify any participant who submits an entry or vote that
is not in accordance with these Terms and Conditions or who tampers with
the entry or voting process. Errors and omissions may be accepted at the
Promoter's discretion. Failure by the Promoter to enforce any of its rights at
any stage does not constitute a waiver of those rights.
24. The Promoter reserves the right, at any time: (a) to invalidate any votes which
it reasonably suspects have been submitted using false, incorrect, fraudulent
or misleading information, including but not limited to personal details and
contact information and/or votes that have been submitted through the use of
multiple identities, email addresses or accounts, including but not limited to
social networking accounts; and/or (b) to disqualify any individual
(or invalidate his/her entry and/or vote) that the Promoter reasonably suspects
has paid, bartered or offered payment or other consideration to another
person in exchange for votes or has otherwise encouraged or procured any
person to submit votes contrary to these Terms and Conditions.
25. Incomplete or indecipherable entries and votes will be deemed invalid.
26. If there is a dispute as to the identity of a participant, the Promoter reserves
the right, in its sole discretion, to determine the identity of the participant.
27. The Promoter‟s decision is final and no correspondence will be entered into.
28. If the Winner is under 18 years of age, the prize will be awarded to the
Winner‟s parent/legal guardian on the Winner‟s behalf. If any person taking a
holiday is under 18 years of age, a parent/legal guardian must accompany
such a person for the entire duration of the holiday.6
29. If for any reason the Winner does not take the prize (or an element of the
prize) or any participant does not redeem a discount offer, by the time
stipulated by the Promoter, then the prize (or that element of the prize) or the
discount offer (as applicable) will be forfeited.
30. If the prize (or part of a prize) or a discount offer is unavailable, the Promoter,
in its discretion, reserves the right to substitute the prize (or that part of the
prize) or discount offer with a prize or discount offer (as applicable) of an
equal value and/or specification.
31. The prize (or any unused portion of the prize) and discount offers are not
transferable or exchangeable and cannot be taken as cash, unless indicated
otherwise by the Promoter.
32. When a participant submits any materials via the promotion including
comments and Submissions (“Content”), the participant, unless the Promoter
advises otherwise, licenses and grants the Promoter, its affiliates and sublicensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and
sub-licensable right to use, reproduce, modify, adapt, publish and display
such Content for any purpose in any media, without compensation, restriction
on use, attribution or liability. Participants agree not to assert any moral rights
in relation to such use and warrant that they have the full authority to grant
these rights.
Participants agree that they are fully responsible for the Content they submit.
The Promoter shall not be liable in any way for such Content to the full extent
permitted by law. The Promoter may remove any Content without notice for
any reason whatsoever. Participants warrant and agree that: (a) they will not
submit any Content that is unlawful or fraudulent, or that the Promoter may
deem in breach of any intellectual property, privacy, publicity or other rights,
defamatory, obscene, derogatory, pornographic, sexually inappropriate,
violent, abusive, harassing, threatening, objectionable with respect to race,
religion, origin or gender, not suitable for children aged under 15, or otherwise
unsuitable for publication; (b) they will obtain prior consent from any person or
property that appears in their Content; (c) they will obtain full prior consent
from any person who has jointly created or has any rights in the Content, to
the uses and terms herein; (d) their Content shall not contain viruses or cause
injury or harm to any person or entity; and (e) they will comply with all
applicable laws and regulations, including without limitation, those governing
copyright, content, defamation, privacy, publicity and the access or use of
others' computer or communication systems.
Without limiting any other terms herein, the participant agrees to indemnify the
Promoter for any breach of the above terms.
33. Participants consent to the Promoter using their name, likeness, image and/or
voice in the event they are the Winner (including photograph, film and/or
recording of the same) in any media for an unlimited period without
remuneration for the purpose of promoting this promotion (including any
outcome), and promoting any products manufactured, distributed and/or
supplied by the Promoter.
34. If this promotion is interfered with in any way or is not capable of being
conducted as reasonably anticipated due to any reason beyond the
reasonable control of the Promoter, including but not limited to technical
difficulties, unauthorised intervention or fraud, the Promoter reserves the right,
in its sole discretion, to the fullest extent permitted by law (a) to disqualify any
participant; or (b) to modify, suspend, terminate or cancel the promotion, as
appropriate.
35. Any cost associated with accessing the Promotional Page is the participant‟s
responsibility and is dependent on the Internet service provider used.
36. The use of any automated entry or voting software or any other mechanical or
electronic means that allows a participant to automatically enter or vote
repeatedly is prohibited and will render all entries and/or votes submitted by
that participant invalid.
37. Nothing in these Terms and Conditions limits, excludes or modifies or
purports to limit, exclude or modify the statutory consumer guarantees as
provided under the Competition and Consumer Act, as well as any other
implied warranties under the ASIC Act or similar consumer protection laws in
the States and Territories of Australia (“Non-Excludable Guarantees”). Except
for any liability that cannot by law be excluded, including the Non-Excludable
Guarantees, the Promoter (including its respective officers, employees and
agents) excludes all liability (including negligence), for any personal injury; or
any loss or damage (including loss of opportunity); whether direct, indirect,
special or consequential, arising in any way out of the promotion.
38. Except for any liability that cannot by law be excluded, including the NonExcludable Guarantees, the Promoter (including its respective officers,
employees and agents) is not responsible for and excludes all liability
(including negligence), for any personal injury; or any loss or damage
(including loss of opportunity); whether direct, indirect, special or
consequential, arising in any way out of: (a) any technical difficulties or
equipment malfunction (whether or not under the Promoter‟s control); (b) any
theft, unauthorised access or third party interference; (c) any entry, vote or
prize/offer claim that is late, lost, altered, damaged or misdirected (whether or
not after their receipt by the Promoter) due to any reason beyond the
reasonable control of the Promoter; (d) any variation in prize value to that
stated in these Terms and Conditions; (e) any tax liability incurred by the
Winner or participants; or (f) use, redemption, taking or collection of a prize or
a discount offer.
39. As a condition of accepting the prize, the Winner (or the winner‟s parent/legal
guardian if the winner is under the age of 18 years) must sign any legal
documentation as and in the form required by the Promoter and/or prize
suppliers in their absolute discretion, including but not limited to a legal
release and indemnity form. 8
40. The Promoter collects personal infformation in order to conduct the promotion
and may, for this purpose, disclose such information to third parties, including
but not limited to agents, contractors, service providers and prize suppliers.
Entry and voting is conditional on providing this information. The Promoter
may, for an indefinite period, unless otherwise advised, use the information for
promotional, marketing, publicity, research and profiling purposes, including
sending electronic messages or telephoning the participant. Participants
should direct any request to opt out, access, update or correct information to
the Promoter. All entries and votes become the property of the Promoter.
41. Entry and continued participation in the promotion via a desktop computer is
dependent on participants following and acting in accordance with the
Facebook Statement of Rights and Responsibilities, which can be viewed at
www.facebook.com/terms.php.
42. This promotion is in no way sponsored, endorsed or administered by, or
associated with, Facebook. Participants understand that they are providing
their information to the Promoter and not to Facebook. The information a
participant provides will only be used for the purposes outlined in these Terms
and Conditions. Any questions, comments or complaints about this promotion
must be directed to the Promoter and not to Facebook. Facebook will not be
liable for any loss or damage or personal injury which is suffered or sustained
by a participant, as a result of participating in the promotion (including
taking/use of a prize), except for any liability which cannot be excluded by law.
