The Block Sky High – Suzuki Competition
Terms and Conditions

Entry Instructions

Throughout the 2013 season of Channel Nine’s television show, The Block Sky High (“The Block”), five (5) couples will be required to each renovate rooms in a designated level of the building (each a “Level”). In order to be eligible to enter the draw to win a prize in the competition (“Competition”), participants must:

1. go online to www.ninemsn.com.au/theblock/win/suzuki (“Competition Website”);
2. follow the prompts to select the Level relating to the couple that they wish to submit a vote for;
3. complete the Competition entry form including their full name, full street address and telephone number;
4. agree to the Competition terms and conditions; and
5. submit their fully completed Competition entry form.

Bonus Entries for Competition Website Entries

Entrants who have submitted an entry via the Competition Website can also choose to share this Competition via either their Twitter account or their Facebook account in accordance with the prompts provided following submission of their initial entry.
The entrant will receive one (1) initial entry into the draw for entering the Competition, as well as one (1) additional entry for sharing the Competition. Entrants may only share the Competition via Twitter or Facebook (not both) on one (1) occasion per entry
.

PRIVACY
Entrant personal information ("PI") will be collected to enable the Promoter to administer and promote this Competition and its winners and, if an entrant consents, may be used to market its services to the entrant. The PI of winners may be provided to others assisting, including prize suppliers and deliverers, and to authorities that regulate this Competition. Entrants may contact the Promoter at the address given below to request access to any of their collected PI that is still held. If an entrant does not truthfully provide all requested PI, the Promoter may determine that they are not eligible to win a prize.
If an entrant wishes to receive information about news, events and offers (including via electronic means) from Suzuki Australia Pty Ltd (“Suzuki”), they may tick the opt-in box at the time of entry. Without limiting the Promoter’s privacy policy, by entering this Competition and indicating their relevant consent, an entrant also agrees to the Promoter sharing their personal information with Suzuki. By selecting this opt-in on the entry form, the entrant acknowledges that Suzuki is solely responsible for its use of that information and will be bound by its own privacy policy located at www.suzuki.com.au/privacy.

1.14 Prize(s), the method by which they are awarded, any additional conditions that apply to the prize(s), and their individual values -
Each couple on The Block Sky High will be allocated a Suzuki vehicle for use during The Block Sky High as outlined in the below table.
At the conclusion of the competition, all valid entries submitted will be tallied to determine the Level that received the highest number of votes during the competition.
The Suzuki vehicle corresponding to the couple associated with the Level that receives the highest number of votes will be awarded as the prize for this competition. For the sake of clarity, the Suzuki vehicle awarded as the prize is determined by the Level that receives the highest number of votes, not on the vote submitted in the winning entry.

The first valid entry drawn from all entries received will win a new model representative of the Suzuki vehicle allocated to the couple of the winning Level, as specified in the table above. For the sake of clarity, the winner will win a new vehicle of the same model, colour and specification as the vehicle used by the couple associated with the Level with the highest number of votes, they will not win the actual car used by that couple during The Block Sky High itself.
Prize value includes registration, compulsory third party insurance, stamp duty and dealer delivery charges (which may vary between each State/Territory).
Additional insurance, vehicle options, petrol, tolls and all other ancillary costs are the responsibility of the winner. The winner must collect the prize from their nearest authorised Suzuki dealership.
In the case of a tie between two (2) or more Levels, the prize awarded will be the winner’s choice of Suzuki vehicle from those tied.

2. WHO MAY ENTER
The only persons who may enter and be awarded prizes are those who (i) are residents of the place specified in Condition 1.1, (ii) meet the criteria, if any, specified in Condition 1.2 (iii) if an age is specified in Condition 1.3, have attained the age specified in that Condition, (iv) are not (a) employees of, or contractors to, the Promoter or any of its agencies involved with this Competition, or of any entity specified in Condition 1.4, or (b) members of the immediate family of any such employees or contractors.
"Immediate family" means spouse, defacto spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the employee/contractor.

3. ENTRANTS BOUND BY CONDITIONS
By participating, entrants agree to be bound by these conditions.

4. ENTRY INSTRUCTIONS
Entry instructions form part of these conditions.

5. AUTOMATIC AND NON-PERMITTED ENTRIES
Any entry that is not lodged by the entrant, that is lodged by automatic, repetitive, robotic, programmed or similar entry methods or agents, including the use of a Competition entry service, will void all entries by that entrant.
The Promoter reserves the right, at any time, to invalidate any entries which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information and/or which have been submitted through the use of multiple identities, handsets, email addresses or accounts, including but not limited to App StoreTM accounts.
The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant: (i) fails to establish their entitlement to enter the Competition to the Promoter's satisfaction; or (ii) submits an entry which is not in accordance with these conditions.

6. NUMBER OF ENTRIES PER ENTRANT
An entrant may enter no more than the number of times specified in Condition 1.5.

7. COST OF ENTRY
Where entry is permitted by SMS, 1900/1902 call or post, the cost of submitting each permitted entry, including any GST, is as specified in Condition 1.6
Each entrant is responsible for any costs incurred in accessing the Competition Website or App and participating in this Competition.

8. DURATION
This Competition commences at the Sydney time specified in Condition 1.7 on the date specified in Condition 1.8.
Entries must be received by the Sydney time specified in Condition 1.9 on the date specified in Condition 1.10.

9. DRAW TO DETERMINE WINNER
The draw to determine the winner will take place at the address specified in Condition 1.11 at the Sydney time specified in Condition 1.12 on the date specified in Condition 1.13.
The Promoter’s decisions are final and the Promoter will not enter into any correspondence.

10. PRIZE(S)
The prize(s), the method by which they are awarded, any additional conditions that apply to the prize(s), and their individual values in Australian dollars, are as specified in Condition 1.14. The Promoter takes no responsibility for any variations in prize values.
The maximum total value of all prizes in this Competition, in Australian dollars, is as specified in Condition 1.15.
Except with the written consent of the Promoter, prizes are not transferable or exchangeable and non-cash prizes cannot be taken as cash. The Promoter has absolute discretion as to whether it will provide such consent and need not provide any reasons to any person for providing or withholding consent.
If a prize, or any part of a prize, is “cash”, the “cash” will be paid by cheque drawn in favour of the winner.
In the event that any prize item is unavailable, the Promoter reserves the right, subject to the approval of any relevant trade lottery authority, to substitute a prize item of equal or greater value.

11. WINNER NOTIFICATION
The winner(s) will be notified by the means specified in Condition 1.16, using the contact details provided in their entry.

12. WINNER PUBLICATION
The name and suburb of the winner(s) of prizes valued at more than $250 will be published (i) in the publication specified in Condition 1.17 (if any) on the date specified in Condition 1.18, and (ii) on the Competition Website specified in Condition 1.19, from the date specified in Condition 1.20 until the date specified in Condition 1.21.

13. UNCLAIMED PRIZES
Subject, where relevant, to any written directions given under the legislation regulating this Competition, if a prize is unclaimed by the winner drawn under Condition 9, (i) that winner will forfeit all entitlement to their prize, and (ii) the prize will then be awarded in a further draw to be held at the time, on the date and at the place specified in Condition 1.22. The winner(s), if any, will be notified by the means specified in Condition 1.23, using the contact details provided in their entry. The names and suburbs of the winner(s) in this draw of prizes valued at more than $250 will be published in the publication specified in Condition 1.24 on the date specified in Condition 1.25.

14. TAXES
Any taxes which may be payable as a consequence of a winner receiving the prize are the sole responsibility of the winner.

15. NO QUALITY, ETC, REPRESENTATIONS
The Promoter makes no representations or warranties as to the quality/suitability/merchantability of any of the goods/services offered as prizes.

16. EXCLUSION OF LIABILITY
To the extent permitted by law, the Promoter is not responsible or liable for:
(i) inaccurate / incorrect transcription of entry information,
(ii) purported entries that are not received for any reason, including because they are lost, misdirected or stolen, or that are received, but are late, illegible, incomplete, sent with insufficient postage (where entry is by post), or sent other than as directed in the entry instructions,
(iii) any problems or technical failures of any kind, including malfunction of any telephone network or lines, computer online systems or network, servers or providers, computer equipment, or software,
(iv) the unavailability or inaccessibility of any service whether or not caused by traffic congestion on the Internet or at any website,
(v) unauthorised human intervention in any part of the Competition (including without limitation manipulation or tampering of the entry process),
(vi) electronic or human error which may occur in the administration of the Competition,
(vii) any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to a prize winner and, where applicable, to any family/persons accompanying a winner,
(viii) any injury or damage to persons or property, including to the participant's or any other person's computer related to, or resulting from, participation or downloading any materials in this Competition or participating in or using any element of a prize.
The winner must sign and return any liability release and indemnity provided by the Promoter and/or its contractors as a condition of a prize being awarded. Failure to return the signed releases and indemnities will result in the entitlement to the prize being forfeited and the selection of another winner.
This condition does not affect, and is not intended to affect, any rights a consumer might have, which cannot be excluded under applicable consumer protection laws. To the fullest extent permitted by law, any liability of the Promoter or its servant or agents for breach of any such rights is limited to the payment of the cost of having the prize supplied again.

17. OWNERSHIP OF ENTRIES
All entries become and remain the property of the Promoter.

18. PUBLICITY
As a condition of participating in the Competition, the winner consents to their name and State/Territory being broadcast on television during an episode of The Block. In addition, the winner consents to the use of their name, suburb of residence and image for promotional and marketing purposes and agree to participate in reasonable promotional activities as requested by the Promoter.

19. TAMPERING AND OTHER FAILURES
If for any reason this Competition is not capable of running as planned, including infection by computer virus, bugs, tampering, manipulation, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who manipulates or tampers with the entry process or who may benefit from such tampering and, subject to the approval of those authorities that have issued permits for the conduct of this Competition, to cancel, terminate, modify or suspend the Competition.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR THE INFORMATION ON A WEBSITE, OR TO OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THIS COMPETITION, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, WHETHER SUCCESSFUL OR NOT, THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.
20. HEADINGS
The headings in these Conditions are for convenience only and do not affect interpretation.

21. ENTIRE CONDITIONS
These conditions constitute the entire agreement of the parties relating to the entry into and the conduct of this Competition.

22. PROMOTER
The Promoter is the entity specified in Condition 1.26.

23. DISCLAIMER
This Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook or Twitter. Entrants understand that they are providing their information to the Promoter and not to Facebook or Twitter. The information an entrant provides will only be used for the purposes outlined in these Conditions. Any questions, comments or complaints about this Competition must be directed to the Promoter and not to Facebook or Twitter.

24. PERMITS
The permits/licence issued for the conduct of this Competition are specified in Condition 1.27.
