Terms and Conditions

1. Instructions on how to enter and prizes form part of these conditions of entry. Participation in this promotion is deemed acceptance of the terms and conditions of entry.

2. The promotion is open to all residents of Australia aged 18 years and over. Employees of the Promoter and their immediate families and agencies associated with this promotion are ineligible to enter.

3. The promotional period commences May 20, 2013 at 12:01am (AEST) and closes 11:59pm (AEST) on June 16, 2013. The judging will be done by a panel of judges appointed by the Promoter. The judging will take place at the Promoter’s premises, 54 Park Street, Sydney NSW 2000 and will begin on June 19, 2013. The winner will be contacted by telephone and in writing using the contact details provided in their entry.

4. To enter, individuals must log on to www.cleo.com.au and follow the prompts to the competition page and fill in the entry form, including full name, mailing address, current email address, daytime telephone number, answer to the competition question (“In 25 words or less, tell us about the best date you’ve ever been on?”), and submit the completed entry as directed.

5. The Promoter will not be responsible for any late, lost, misdirected entries, or incomplete or incorrect entrant contact details. Incomplete, illegible, incorrect and incomprehensible entries will be deemed invalid and will not be included in the judging.

6. Only one entry per person permitted.

7. This is a game of skill, chance plays no part in determining the winner. Each entry will be individually judged based on its literary and creative merit of the answer to the question provided. The judges’ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.

8. The Entrant warrants to the Promoter that the entry submitted is an original artistic work of the Entrant that does not infringe the rights of any third parties. If the entry or any part of the information provided to the Entrant in relation to the entry was provided by a third party, the Entrant warrants that they have obtained the relevant copyright permission to submit the entry for the purposes of this promotion. The entrant agrees to indemnify the promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition.

9. The Promoter is entitled to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including using the entries for future promoter’s or their agents’ book publications, promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. The promoter is entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry.

10. Entries must not be offensive, defamatory or racist. Any entry which the judges deem inappropriate will be invalid. The entrant agrees to indemnify the Promoter.

11. The best (1) entry, as determined by the judges, will be deemed the major prize winner and will win: 

• Dinner for two people (winner and Darren McMullen) at a Sydney restaurant valued at up to $300.00 (Prize will be prepaid at the restaurant venue. Prize includes meals and beverages to the value of $300.00. Any additional cost over the prize value will be the responsibility of the winner. Venue will be determined by the promoter in its complete discretion.)
• One (1) x one-way limousine transfer to the restaurant only valued at up to $400 (depending on point of departure)

If the winner is from ACT, VIC, TAS, SA, WA, NT or QLD, the winner will also receive:
• One (1) return economy flight to Sydney from the winner’s nearest capital city valued at up to $1000.00 (including taxes, depending on point of departure)
• One (1) night’s accommodation in a standard twin share room in a minimum of four (4) star hotel valued at up to $500.00

Total value of the prize is valued at up to $2200.00 (including taxes, depending on point of departure).

In the event the winner is from NSW – the flights and accommodation component of the prize will not be awarded to the winner. No alternative prize or cash will be awarded in lieu of the flights and accommodation.

12. The Promoter is neither responsible nor liable for any loss or damage suffered in the event that Darren McMullen is unavailable or postpones, cancels, reschedules the “date” for any reason whatsoever. Darren McMullen’s appearance is determined by his schedule and other various factors determined at the complete discretion of Darren McMullen and his management. No correspondence with be entered into.

13. Prize must be redeemed in full and as a package by December 19, 2013. All components of the major prize are subject to availability at the time of booking. At winner notification, the winner will be advised of dates of which they will be able to redeem the prize. All dates are subject to the schedule and availability of Darren McMullen. All dates will be determined by the Promoter at its complete discretion. The restaurant venue will be determined by the promoter in its complete discretion.

14. The prize does not include any travel to or from the winner’s place of residence to the departure point or return travel from the restaurant venue. These costs are the responsibility of the winner.

15. Changes to flight schedules may require additional overnight accommodation at either commencement, during the itinerary, or on completion of the trip, which is at the winners expense.

16. The winner is responsible for all other expenses including but not limited to taxes, surcharges, spending money, additional meals (unless specified), drinks, transfers (unless specified), transport to and from departure point, additional domestic flight travel, laundry charges, activities (unless specified), incidentals, energy surcharges, gratuities, services charges, items of a personal nature, in-room charges and all other ancillary costs.

17. A credit card imprint or cash deposit will be required from the winner at check-in of the hotel for all incidental charges.

18. Frequent flyer points will not form part of the prize. Standard conditions for tickets and accommodation apply. The Promoter’s decision is final and no correspondence will be entered into. It is each winner’s responsibility to ensure that they have all relevant documentation in order to travel. All elements of a prize must be taken together within the one trip. Winners will not be compensated for unused portions of a prize.

19. All prizes must be taken as offered. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be redeemed as cash. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass. The Promoter will not be liable for any voucher / ticket / pass that has been lost, stolen, forged, damaged or tampered with in any way.

20. Prize is subject to the standard terms and conditions of individual prize and service providers.

21. The Promoter and restaurant venue hereby expressly reserve the right to eject the winner for any inappropriate behaviour, including but not limited to intoxication, whilst redeeming the prize.

22. The winner must not engage in any illegal or unsafe behaviour whilst participating in the prize. To the extent allowable by law, the Promoter and its partners exclude any legal liability or responsibility for legal or otherwise incidents or activities engaged in by the winner during participation in the prize.

23. In the event that for any reason whatsoever the Winner does not take the prize at the time stipulated by the Promoter, then the prize will be forfeited by the Winner and cash will not be awarded in lieu of the prize.

24. In the event that a prize, or part of a prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value.

25. The promoter is neither responsible nor liable for any late, lost or misdirected mail (including but not limited to prizes).

26. The Promoter is not responsible nor liable for any prize damaged in transit in the delivery of their prize.

27. This promotion is being conducted for entertainment purposes only. This does not create a relationship between the winner and Darren McMullen.

28. It is a condition of participating in the competition that the entrants agree to be interviewed, photographed and filmed at any time during the redemption of the prize or their entry or part of their entry to be used by the Promoter or their agents for a story or feature on this promotion to be developed and featured in CLEO magazine, website or social media pages (or any other form of media it deems suitable) without further remuneration or reference to the participant. Details may feature in CLEO magazine, website or social media pages on a date to be determined by the Promoter. The inclusion of any such feature (including but not limited to creative control of the feature) will remain with the Promoter at all times.

29. As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

30. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the internet service provider used.

31. In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including  but not limited to natural disaster) the Promoter reserves the right to subject to reference to all relevant  state and territory rules and regulations, to cancel, terminate, modify or suspend the promotion.

32. If a medical circumstance in some way restricts your ability to enter the competition through the required mechanic, you are still eligible to enter however you must briefly state your circumstances upon entry.

33. If your entry is selected as a winning entry, validation of your circumstances/ the validity of your entry will be undertaken by the Promoter. Method of validation (without limitation) will be determined by the Promoter in its complete discretion. If the winning entry is deemed to be a winner, the winner will be notified as per the terms and conditions herein. In the event that the Promoter requests the entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoter. It is a condition of accepting the prize the winner sign any such legal documentation.

34. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”).
